Smoking weed vs possessing weed. (self.legaladvice)

So bare with me because I know this is kinda a dumb question.

Now selling weed is illegal.. as is buying it no?

What about the act of giving it away?

Possessing weed is also illegal. But what about smoking it? I know it may be impossible to smoke it without being in possession of it so it may be a moo point but what if I constructed some type of apparatus that allowed me to smoke it while the actual weed was in someone else's possession..like a long bong that went across to another house where all the weed was and someone else lighting it for me.. Or someone shotgunning it into my mouth. would that act be illegal?

I live in CA and yes I am high

OP, in case it's not clear, that's what the concept you're describing is called. It's in a place where you both control it, the control you both exert over the space where it is amounts to possession. Also, you're going to honey the shit out of the inside of the apparatus and you lack the lung power to pull what's left over distances longer than a metre or two.

In California, possessing marijuana with the intent to distribute it and the act of distributing marijuana are different crimes. The price doesn't matter at all.

..as is buying it

The act of purchasing or receiving marijuana is not a separate crime. It is treated as possession.

What about the act of giving it away?

In some other states, and at the Federal level, giving away a small amount of marijuana is not considered to be distribution, but rather is treated as simple possession. In California, there is no such "distribution of small amounts without remuneration" exception.

The thing is moot point. What you're doing is either incorrect on purpose for the purpose of being funny (which would still make you incorrect) or you are ignorant and believe "moo point" is the correct terminology. In either case it is still incorrect usage.

    It is a joke from the 90's show Friends where the loveable idiot on the show thought moot point was pronounce moo point.

    The joke makes fun of Joey's misunderstanding of the term.
