The guy should sue the police department that arrested him. Obviously they don't know the law or the constitution enough. Even I was taught this in elementary school about the US History.

Personally when I see some leftist scumbag burn or stomp on a U.S. flag I have this irresistible urge to piss on a quran but I burnt the last one I had so I am out of luck.

Probably because he's a troll, or easily knew that Illinois police would try to arrest him for it, with him getting an easy million dollars law suit filed on his behalf, or anything else.

What's laughable is that you focus on why he hates the US, instead of the fact that his constitutional rights were violated.

The constitutional right was always there in the first amendment. It took for the case to reach the Supreme Court where they reinforced the first amendment and interpreted it more clearly. As that's the purpose and power given to them by the Constitution.

That being said, you're distracting from the issue. You can argue whether or not the burning of the flag should fall under the first amendment. But what you cannot argue is that the cops are justified in violating the Constitutional rights given to him currently. Law enforcement officials need to do exactly as their job asks them to do. Enforce the laws. Not make one, or interpret the laws.

Even before then, just because it had never been decided doesn't mean it wasn't so.

We didn't have an individual right to bear arms until 2008 based on that logic.

Actually the court ruled the 2nd as individual after the Civil War in Presser v. Illinois.
