Not legal advice, but you're kind of a jerk.

People are prescribed those for seizures or panic attacks. So they need them, but they are highly controlled. She may not be able to get more if she needs them and you stole them.

Also, you may not know this, but it has a long half life, so if you drank up to 24 hours later increased side effects such as nausea can happen. Also, you know, death.

Meh, kind of hard to feel bad for you. I have PTSD and use them for when I have pretty intense episodes. Not for like funsies.

First, I highly doubt that she poisoned them, in part because 1) common poisons don't present the way you are describing and 2) she would have had to poison her entire supply of a controlled substance on the off chance that you took one (that you take every six months, you claim) that day.

More likely, she just swapped the pills in the bottle with something else, which would be illegal if she was carrying a mislabeled drug, but probably wouldn't be considered booby-trapping.

You, meanwhile, would have to admit to a felony in order to report her.

By definition to make an accusation against her you have to admit to a serious crime. "I was stealing her meds and she switched them to make me sick."

So you will start with a confession and she will still have reasonable doubt on her side. plus you have medical diagnosis of the flu not "poisoning".

She can go to the police with only "I have a prescription for a drug that can be abused, they are very expensive and I have noticed my medicine frequently disappears when my roommates BF is over and he seems to be using them." The police may or may not decide to look into it.

So me personally, I'd pay her back with no admission of guilt and stop stealing her medically necessary medication.

Here's one of those situations where, by living outside of the law, you have forfeited its protection.

Yes, poisoning you was a crime. However, stealing prescription drugs (especially opioids, if that is one) is also a (very serious) crime.

So, if you want to waltz into the police station and tell the cops that you want to file a report, because someone did an illegal thing while you were doing a very illegal thing, be my guest. But I wouldn't recommend it.

It's a benzodiazepine not an opioid, but they're just as highly controlled. This guy thinks that he understands how benzos "work with his body" but as someone who was prescribed them for panic attacks, sometimes the meds would give me the symptoms he's describing, sometimes not. I can't tell if this is real. If she swapped the pills out she would have had to find an almost identical pill. Then the pill would HAVE to be harmful to someone who isn't supposed to take them. Then she would have to match however many she usually has in the klonopin bottle. Maybe OP stole some pills then got the flu, but his conscience won't let him believe it's the flu.

Girlfriend's roommate intentionally poisoned me to prove that I was stealing from her and now demands that I pay her back

My girlfriend's roommate keeps a prescription of clonazepam in their bathroom. Occasionally, I take one, and by occasionally, I mean once every 6 months.

One day, I was over at my gf's place and her roommate was out, and I took one and the roommate poisoned them all because I had this sudden tiredness and nausea that I don't get with benzos and then had this uncontrollable twitch while sweating a lot even though the room was cold. Her roommate comes back and was like, "I knew it. I hope you learn to not take other people's prescriptions and you also better pay me back for every one you stole." And my gf was like, "wtf?" And her roommate said that she knew I was stealing her pills and said that the way I was acting proved it, though she did not explicitly say that she poisoned them. She says I owe her $200 or she'll press charges for theft and that she has all the evidence she needs because of how poisoned I was.

My question is, can she really do this, and isn't it illegal for her to be poisoning me, and should I report her to the police considering that she poisoned me or should I not because I was stealing from her.

She's also been harassing my gf now about me and about how I need to pay.

Do you leave your narcotic medications in areas shared by all the roommates and any of their possible guests? What if your roommates have a family member visit, and they didn't know that the family member had started using drugs? Just seems like you could avoid possible future trouble by keeping narcotics out of shared areas.

And not everyone is able to have roommates they have known for years and trust. Sometimes you have to interview roommates and go with the one you feel the best about. But you never know how it can turn out.

It's her medication. The fact that you had to steal them implies that she had no intention of giving them to you in the first place. If someone put rat poison in cheese to catch some rats, and you steal the cheese, that someone isn't going to get in trouble because you weren't supposed to be eating that cheese anyways. If she poisoned /your/ medication that was prescribed to /you/ then maybe you would have a case. But right now, if you don't do what she says, you might me looking at a Fellony.

Go get a blood test to see what she tainted the meds with. If it is a poison you need to get treatment. You are between a rock and a hard spot, you can't really press charges since it happened in the act of a crime.
