That's the thing, it's not illegal to refuse service. It is illegal though to refuse service on grounds that they're gay. The point being refuse service all you want, just don't say why, and you're not required to say why.

That's... not good legal advice. In point of fact that's really bad legal advice. The law really can make the distinction that if your business is available for straight couples and mysteriously has no opening when gay couples ask that you're discriminating.

Except you're wrong. You can't offer a service to one person, and then say you won't offer it to another person based on their sex, race, religion, and a few other ones.
There's good reason for that. If you want to operate a business in the United States you must obey the laws that govern the land you're doing business. The law gives protections to everyone, because everyone is equal. That way you can't say "black people won't be served at this restaurant." Or something of the like. That's just an example because we had problems with that in the past.

Well there's the rights of equal protection under the 14th amendment. You can argue that it doesn't expressly say businesses have to follow that but we use a WHOLE LOT of interpretation in our constitution. We let the supreme court do that and there are plenty of situations and laws where we say you can't discriminate against gender, race, religion, or orientation

By opening a business you are entering into a social contract. From society you receive the benefits of: road, currency, educated customers and employees, police and fire protection, technology, etc, etc, etc. But there is also a cost in the terms of regulations that you must adhere to. And one of the regulations is that if you are a public accommodation, you must be a public accommodation, not just whoever you personally feel like.
Just because you want to be a leech who gains the benefits of opening a business in society for free doesn't mean you get to. You have no "right" to be serviced by society if you aren't willing to undertake the cost.

Title II of the Civil Rights Act of 1964 prohibits discrimination because of race, color, religion, or national origin in certain places of public accommodation, such as hotels, restaurants, and places of entertainment.
Any business that is open to the public and not a "private" group, like a club or Church, has to abide by these laws.
And they have been amended to offer the same protections to gay citizens, including them on the basis of sex.

They'll recieve backlash. Enough backlash over enough time and things change. Just don't go there, talk shit about the place, tell your friends to go there then write bad reviews. Fining a small business 80k is overboard regardless of their views in my opinion. That could potentially put them out of business.

Citizen rights trump business rights. Private citizens have the right to deny people entry into their homes for any reason. They have the right not to talk to someone for any reason. They also have the right to not be denied service for discriminatory reasons. Because allowing something like that to occur creates significant changes in the socio-economic environment of the country that damages our ability to function as a whole. We are STILL recovering from the economic gaps created by segregation. When you choose to enter into the business world, you do so under the agreement to abide by the laws that protect our citizens. These are the same laws that protect our citizens against monopolies and price gouging. If you don't want to abide by those laws, close up shop and seek income elsewhere.
