Some of them, yes. Mostly ones with high fees.

However, there are ~32k which aren't confirming, and it's been at that number for quite a while now.

A lot of wallets underestimate fees, which makes this a particular problem.

What's funny to me is the lack of thinking.

Okay, we assume that this is a spam attack, and just pay some higher fees until the spammers get board or run out of money.

But this doesn't address the problem that the spammers are highlighting.

Sure, maybe we currently have enough capacity for all the "real" transactions, but what about 6-12 months from now? SegWit isn't going to increase capacity quickly enough to cover a doubling of usage. And that's assuming we have SegWit in April and it gets adopted quickly. Even if everyone adopts it within a month, that will only get us another 6-12 months of capacity.

Here is a transaction I just made and it was included in the exact next block.

Hint to the guy doing the stress test (because I hate the phrase "spam txs"): Next time use high fees to see how this plays out.
