IANAL, but according to this site, if one test isn't available, the other will suffice:

Yes, you have the right to choose but if one of the tests is unavailable, you are required to take the other available test."

So no, I don't think that it'll change anything.

Also, please don't drive drunk. Take a cab or get a DD next time.

This is a good answer.

Also, it seems that OP had already consented to and taken the breath test and then decided that (s)he wanted a second test. I don't think the police are required to provide a second test in that circumstance (though I'm not in California, so I could be wrong).

And FWIW, a properly conducted breath test is every bit as accurate as a properly conducted blood test.

Also I find it interesting that OP doesn't say anything about the breathalyzer test being wrong, just that OP then wanted a second test after the first was positive. To me that sounds like they're guilty, and they were looking for a blood test to either somehow contradict the first test or to delay the process (and then take the test and have a lower BAC, which would contradict the first test). Or it's just OP looking for a way to say to the authorities/a judge "Well they refused wanting a test, so they can't charge me right?"

A lower BAC on the second test only contradicts the first test if it the prosecution can't find someone to testify about how the body metabolizes alcohol (or if the test is much lower than it should be based on metabolism rates).

I just honestly felt like it wasnt accurate, I felt I hadn't drank that much to be over the limit. After all the paperwork was done, I was allowed to call a cab, and go home, which I assume that the officers felt that I wasn't intoxicatd. I'm not sure how it works though...I just assume they would keep me like in a detox room or jail, until they felt I was sober enough to go home, if they had felt that I was intoxicated.

I think you aren't going to have much luck with this. Attempting access a military base is absolutely a reason a person might get pulled over. If there was a gate, a base hospital, and military police it wasn't just a recruitment office.

edit because lol, was it fucking Pendleton you tried to drive into? If you somehow missed all the signs to the gate you were drunk as fuck

No, it wasn't Pendleton. I wasn't shit house wasted, I needed to turn around because I made a wrong turn and I ended up there. It was some place downtown on front st. There is a bunch of remodeling stuff going on downtown all the time and at first glance, I thought that's what it was...you would understanding if you saw it. I asked for a blood test because I felt it had to be inaccurate, considering I really only had a few beers playing poker with some buddies, which is why I wanted a blood test. I know I shouldn't drive after drinking, I get it.
