That's right -- Gemini Trust Company, LLC, a New York state limited liability trust company, which makes us a fiduciary, and allows us to accept both individual and institutional customers under New York Banking Law (unlike the BitLicense, which does not convey such fiduciary powers).

Just curious, but is the Gemini exchange something that needed to be opened before the ETF is allowed to be launched? As great as the exchange is, I think the ETF is what is really going to be a game changer for BTC. I know that there might be rules as to why no comment can be made on this.

Personally right now I don't use any of exchanges because I'm paid 100% in BTC. But back in time 10-12 months ago I was buying only from exchanges. 5 min using them. Enter - buy - transfer coins to my wallet - close the exchange - bye. Never give the opportunity to be hacked, robbed, scammed.
Even then I was buying BTC with my grandma details :)
But yes people are greedy and use the exchanges like their personal wallets or stay with coins in there waiting to sell them to make some bunch of other shity fiat. But those they get what they expect: shit.
Many of the exchanges are not created to help you to get in the bitcoin train... but to make them rich. If you are smart enough you can find your way do not be trapped into their game.

It wasn't banned, they just made it really hard to get licensed, so a lot of companies left.

Bitcoin isn't banned, it never has been.

Running an unregulated or unlicensed money transmitting service (yes, including bitcoin) is illegal. It has been for a long time. This is not the same thing as bitcoin being illegal.

For a common person or a small startup, you essentially can't use bitcoins because the costs and process required to get licensed are too high. For someone with deep pockets, it's not impossible.

You have to adhere to the NewYork BitLicense to operate a bitcoin company there. It's expensive to do so only wealthy institutions will be able to offer bitcoin services.

The downside is the innovation from small startups will go to every other state/country due to these high costs, the upside is the remaining ones are likely to have deeper pockets for marketing and doing things professionally.

Time will tell if a license barrier will produce better services over more nimble start ups... It certainly good for Gemini since they'll have little competition there for a while.
