Assault is a person feeling the imminent threat of physical harm while battery is actual physical violence. This is battery, but the referee didn't think he was going to get hit so its not assault.

Yeah I just read that he MAY get charged with assault. Getting suspended isn't a consequence, it's a vacation. Don't delude yourself.
