We reserve the right to suspend, restrict or terminate your access to all or any part of the Services at any time at our sole and absolute discretion.

We may also permanently ban or temporarily suspend you from using the Services if you do not comply with these Terms or any other applicable terms, at our sole and absolute discretion.

What are our obligations and limits on liability?
All of our Services are provided on an ‘as is’ and ‘as available’ basis. We cannot promise that our Services will be free from errors or omissions nor that they will be available uninterrupted and in a fully operating condition, or free from viruses or other harmful components. Cost: Any applicable charges for participating in the interactive service are as indicated in the relevant promotional information or any additional terms and conditions for the interactive service. Permission of the bill payer must be obtained before participating in the interactive service. There will be no refunds for the cost of participating in the interactive service. There is no charge when participating in the interactive service via email, freephone number(s), post or via the internet unless otherwise stated. Submissions and Licence

As between you and us, and subject to any intellectual property rights (including, without limitation, any copyright, design right or rights in trade marks, whether registered or unregistered) in any underlying work (including any such underlying rights held by us), you retain all ownership rights in any Submission you may make.

Subject to any underlying work which we may supply to assist you in making Submissions for any competition, forum or other functionality on the Website, the Platforms or in relation to the Services (as the case may be) you promise that your Submission is your own original work, and that you are the owner of any Submission you make or that you have all necessary licences, rights, consents, and permissions to authorise us to use your Submission. In particular, you promise that you have obtained the permission of all of the people featured or referred to in the Submission (and if they are under 18, the permission of their parents or guardians as well) to our use of the Submission. You agree to give us evidence of all such licences, rights, consents, and permissions upon request. You acknowledge that the contents of any Submission will be considered non-confidential.

By making a Submission, you grant us a licence (which means permission) to use (including, without limitation, use on the Website, on the Platforms and in relation to the Services and use in the television programme called "THUNDERBIRDS ARE GO"), edit, reproduce, record, modify, enhance, encode, translate, distribute, play, perform, make available to other users, prepare derivative works of and to display your Submission by any media or methods whether now known or later developed, which licence may be exercised in our sole discretion throughout the world at any time. This licence includes the right for ITV to make available your Submission together with advertising and/or sponsorship content that we may include in, on or around your Submission.

You agree that this licence is: perpetual (which means it lasts forever); non-exclusive (which means you are free to grant this permission to other parties as well); royalty-free (which means ITV won’t pay for the permission either now or in the future); and transferable (which means ITV can transfer the licence to ITV group companies or any other third party) and you agree that ITV can sub-license this licence (which means ITV can grant an equivalent permission to ITV group companies or other third parties in respect of your Submission). You also agree to waive your "moral rights" in your Submission.

You are responsible for the contents of any Submission you may make and the consequences arising from its use on any ITV platforms or channels and/or as part of any ITV services or on any third party platform, channel or service. You will not upload any material or content which is in any way defamatory, obscene, unlawful, harmful, offensive or inappropriate or infringes the rights of a third party or may have the effect of being harassing, threatening, abusive or hateful or that otherwise degrades, discriminates against or intimidates an individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age, disability or any other legally protected characteristic. You agree not to infringe any laws in producing or making a Submission. You agree not to transfer files which contain viruses or other harmful programs. Further, you must not endanger yourself or others, or take any unnecessary risks in order to produce or make a Submission. You promise that you will not make any Submission which in any way infringes any applicable laws or infringes the rights of a third party (such as any Submission which contains third party content such as music, third party trademarks, logos, insignia, location signage, photographs, artwork, or sculpture).

You also agree not to advertise or promote third parties’ or your own goods or services in any Submission, including but not limited to by way of the distribution of "spam" email. In addition, you agree not to use any ITV services to provide links to third party websites.

You agree and acknowledge that we may accept, modify, withdraw or refuse to display your Submission at any time at our sole and absolute discretion. We may do this without notice to you for any reason, including, without limitation, where we suspect that your Submission does not comply with these terms and conditions.

You (or your parent or legal guardian if you are under 18) may, at our discretion or at the discretion of the producer of the applicable programme, be required to sign a subsequent consent form and/or subsequent release and/or to grant any additional rights which may be required by us or the producer with respect to your Submission.

You agree that we may authorise the producer of the programme to exercise any of the rights that you grant to us under these terms and conditions, which may be in addition to or instead of us exercising them. To the extent that the producer exercises any such rights, you acknowledge that it does so in its own right and not on behalf of us, and we bear no responsibility for the consequences of any such use by the producer.

We do not guarantee, represent, undertake or warrant that it or any authorised third parties will broadcast on-air or make available in any other media the programme or include your Submission on the Website, on the Platform, through the Services or in any episode of the programme "THUNDERBIRDS ARE GO", or that your contribution(s) will be considered or will otherwise be used in whole or in part despite being received by us, even if you have received an acknowledgment of sent and/or receipt message.

You acknowledge and agree that we may in our sole discretion include your contribution and your personal details in the programme and/or in any future episode of the programme, on website(s) including without limitation on the Website, on www.itv.com or in any other media in connection with the programme and/or broadcast or otherwise make it public via any media or otherwise exploit it in any manner without notice and without any fee being paid.

We and/or third parties authorized by us may modify any contribution(s), or may accept it, or refuse to consider it in our/their sole and absolute discretion. You agree that all or part of your contribution including your personal details may be edited, adapted, displayed or published in all media and/or otherwise made publicly available in our discretion and/or in the discretion of authorized parties. If we in their sole discretion, deem it necessary to do so we may disguise and/or conceal the identity of a participant in the interactive service.
