Formerly NC, formerly juvenile delinquent here. Can't give you a code cite but they are correct but only during school hours. It is part of the truancy laws. The kid makes up the excuse about being suspended so I would bet that is the case.

They can detain a juvenile under suspicion of truancy. They also don't need probable cause to detain a juvenile. They just need reasonable suspicion (ie wandering around the back of a department store / being teenagers) to detain them for questioning.

Basically, if you're a juvenile, police officers can pretty much stop you for walking down the street. They just have to suspect that you could be doing illegal things, which a lot of teenagers make really easy for cops.

Possibly depending on the day and time. I'm actually going to give this a look up. I was always told a person that looks enough of a minor to be in school can be stopped and IDed if it's a school day and time. Or if it's late at night and they are out past a curfew,

I've never actually looked it up as it sounded reasonable. Gonna have to look it up I think.

I can't speak for this particular jurisdiction but many areas have truancy laws that may apply here, so if they were skipping school and are minors (and from what they were saying, they were) they can absolutely be detained.

He says "I think i'm an OSS, i don't think i even have to be at school". I take that to mean they are committing truancy. If that is the case then the officer can (to my knowledge) legally assume temporary custody of the juvenile for up to 12 hours, without a court order.

Keep in mind that I'm neither a lawyer nor an American, but this is my understanding from this pamphlet i found.

I don't get why they still do out of school suspension. Most everybody's parents work so it ends up being vacation time for the kid.

We used to have in school suspension. ride the bus to go to school and sit in a broom closet sized room, with only a desk and chair, by yourself all day, and only leave to use the restroom. That is a punishment. Especially at the end of the day when you get to leave and see that all your friends were interacting and having fun like a hundred feet away from the grey wall that you stared at for seven hours.

I agree with you but there are some other factors. Budget cuts, no one to supervise the kids. What do you do if they don't cooperate while in the in school suspension?
