That wasn't assault, that was straight battery. Assault is more the threat of physical violence and battery is actually hitting someone. Battery is worse with the legal implications.

Edit: As it has been pointed out this really depends on where you are. Most countries combine the definitions but as for the U.S. the common law states that Assault is merely the threat of battery but many states couple them together.

I understand your intentions are pure and you mean well but this is completely wrong and I would like to clear it up a bit for anyone who bothers to read this.

The phrase "common assault" refers to assault and battery together, and this is frequently shortened to "assault".

So on a side note, you know what people mean by "assault", no need to be pedantic.

Furthermore, and this is my main point, you say that battery is "much, much worse". It's really not. It is worse, yes, but not "much" worse. I'm going to explain it in terms of the English court system but it's basically exactly the same in America as your legal system is based on ours.

Assault and battery are both summary offences. That means it's the least serious type of criminal offence. They are both heard in a Magistrates' court so the maximum possible sentence is 6 months for both.

Battery, essentially, is assault combined with ANY touching. Even touching of clothing can be battery (R v Thomas 1985, in which the touching was not even evidently indecent)

Generally injuries inflicted in sport do not merit criminal liability, however in this case the attack was not a part of the game and therefore would.

The only way the assault in the GIF would be charged as more than a battery is if there was any physical injury. Any physical injury that is more than trivial takes it higher than battery. Even moderate bruising is potentially enough.

I won't go into details (unless anyone is interested), but a concussion would be ABH and brain damage would be GBH. The specific type (i.e. section 18 or section 20) would depend on the defendant's intention, they carry very different sentences. If this was on a field and they were wearing studded boots, then a resulting cut could cause it to become GBH provided all layers of the epidermis were broken.

Edit: As others have pointed out, battery does not require the apprehension of unlawful force whereas assault does. I knew this was the case, but I usually find that assault+touching is an easier way to explain it to get the gist of it. But here's the clarification :)

Lawyer here: you're both wrong, since you're both speaking as if what you're saying is true everywhere. Assault and battery definitions can vary by state. In New York, for example, assault is intentionally causing physical injury to another. What is often called assault is calling Menacing.

Thanks for the info! We don't have GBH (Grievous bodily harm) in America. The next step up for assault/battery would be aggravated assault/battery. But neither of those would apply in this case. In America, the exact crime and punishment depends on the state. In Colorado, for example, there's no difference between assault and battery in terms of the criminal charge or punishment (similar to England).

So I'll split it into two categories. Most criminal offences require a Mens Rea (MR) and an Actus Reus (AR). The MR refers to the mental aspect of the crime - the level of intent. The AR is the actual act itself. Some crimes require different levels of intent.

The AR for ABH is inflicting actual bodily harm that is more than trivial. Whether the injury is trivial is judged on a case by case basis. Usually something like a slight bruise is trivial unless the victim (V) is especially vulnerable to harm (e.g. very elderly person or a newborn baby)

The MR for ABH is subjective recklessness. This means that even if you didn't foresee that the injury would occur, you can still be guilty of ABH.

The maximum sentence for ABH is 5 years. If it was racially motivated it's 7 years.

The AR for GBH is inflicting serious bodily harm on or wounding a victim. This is where the thing about skin comes in. Wounding is a break in all layers of the epidermis. So if you paper cut someone that would not be GBH, but if you sliced them deep with a razor (as in R v Eisenhower) that would be. Additionally, multiple smaller injuries that would not alone amount to GBH can become GBH altogether.

The MR for GBH is where there's a split. There are two sections of the Offences Against the Person Act 1861 under which a person can be charged for GBH.

Section 20 GBH is less serious. This is where the D foresaw only some harm to the D, but did not intend to cause the serious damage. It carries a maximum sentence of 5 years.

Section 18 GBH is extremely serious. This is requires direct intent. This means that the D knew that he wanted to inflict the serious damage to the V, and did it knowingly. The maximum sentence for s.18 GBH is life.

Interestingly, you can be guilty of murder even if you only intended to cause GBH (i.e. the MR for s.18)

Again, I am explaining this in terms of the English court system but I suspect it will be very similar in America and any member of the Commonwealth

I've been in a similar situation where someone kicked my friend and teammate on the ground after he got pushed over when playing with the ball to run out the clock because we were up. I ran up and grabbed the kicker by the jersey and out of nowhere my other teammate came up and clocked the dude in the face. Complete sucker punch, completely justified. Both benches clear, some more punches were thrown. I got a yellow, the pusher got a yellow, and 2 others got reds. The only player on the other team whose hand I shook was their keeper. I think maybe half my team shook hands with the other team. Refs tried to get everyone to do it again and another brawl almost broke out before they decided that it was best to just separate everyone. I HIGHLY doubt the kid ever intentionally kicked anyone on the ground again after almost getting knocked out cold.

    I've played soccer against teams that completely outclasseed my team, but at the end of the day you just have to accept that you justifiably lost. They're better. Sure, it's frustrating to feel helpless against your competition, but unless your livelihood or something is on the line, then leave your pride at the door and just suck it up. The best you can really do is try to put enough pressure on them within the rules so that you don't get absolutely trounced. And if your livelihood is in fact on the line, then maybe you're in the wrong line of work since you suck shit.

    I agree. I've been a competitive athlete basically since I could walk. As a former wrestler, I've been embarrassed too many times to count. My first college match as a freshmen, the guy I wrestled was an all-american and a senior and broke two of my ribs and pinned me in 13 seconds. Aside from the broken ribs, I found it pretty comical. You just have to accept that there are people better than you, and work your ass off to get on that level.

    In soccer, when someone intentionally pulls flashy and unnecessary moves on another player, it's considered the highest form of disrespect a soccer player can give. Basically, orange was shaming white as hard as she could. And orange was good at it too.

    played football all my life, whenever i get schooled like that through sheer skill (and it's happened plenty), i've never once considered it 'disrespectful'. nor would anyone i've ever played with, no matter how frustrating it might be. those are the people that make you a better player in yourself.

    Disrespectful or not, that doesn't mean you should get kicked in the side of the head. Sure a foul during the play that isn't going to potentially maim them. But that kick can easily have caused a concussion, broken jaw, broken teeth, broken orbital (had she landed the kick higher). Hell I'm sure she could have killed her had she kicked her in the temple. That was vicious and no matter how disrespected she felt, it was not needed.

    Really though. Soccer is such an irritating sport. You always had fun as a kid when people didn't try more than a light kick around your legs to get the ball. Then you grew up, and people would violently push you around and you'd barely dare get near their legs.

    You don't hear about good things in reddit or news that often, if your opinions are based only on the bad side of things/places, you'll never do anything you wanted in life.

    Brazil is a great place to visit, lots of beautiful (and safe) cities and places to visit, it's a vacation paradise if you do your research beforehand.
