Mentality Polish – Mistakes Happen But This Response Is Unacceptable

Mentality Polish - Mistakes Happen But This Response Is Unacceptable

The nail world can be a vicious one at times. I’ve talked about indie brands and double standards before but we’ve all (well, if you’re far enough down the rabbit hole to be a part of facebook polish groups) seen brands torn a new one for fading polish, curling glitters, etc. And while those things are perfectly reasonable to not be happy with- there’s a situation that happened recently that isn’t seeing an ounce of the outrage you’d expect. I’m talking about Mentality Polish causing reactions of nail lifting, burning, redness, etc.

I shot off a quick facebook post this morning before leaving to work and was shocked by how many people still hadn’t heard of what’s been going on, so I decided to take the time to write a quick post about the issue and my thoughts on it. I’m not going to write out a detailed timeline but here’s the basics that you need to know-

Customers began experiencing what Mentality refers to as ‘sensitivity’ (a real misleading word for the Onycholysis people are experiencing IMO) from using polish produced by them from April through June of this year.

Mentality Polish - Mistakes Happen But This Response Is Unacceptable

“sensitivity” photo credit to @dmm_nails, one of the people who had this occur because of Mentality – thanks to the reader who shared with me this photo of the actual damage!

It was not limited to a particular collection (although I believe many people experienced it with their neons) which made them narrow it down to their base. They issued a statement on their facebook page and encouraged those who experienced the ‘sensitivity’ (again, really BS calling it just that) to contact them for replacements. I believe refunds were not initially offered but are now being offered with a delayed timeframe (which is understandable as this is a big hit to a small business).

There are rumors of bloggers knowing in advance of the issues and not saying anything (which I don’t want to believe that anyone could keep their mouth shut on that while knowing it could be harming their readers) and of the actual reason this batch of base is bad (citric acid as an ingredient was being thrown out as a potential explanation at first but many argued that it is also in bath bombs and other nail products and is unlikely to be the sole cause) but what I really want to talk about is the brand’s reaction. Because it really, really has sucked.

What should they have done? In my opinion, immediately close shop for a day or two while formulating a plan for replacements/refunds/figuring out what exactly was the issue with the polish. At this point, they first should have IMMEDIATELY taken the time to compile an email list of those who purchased during this timeframe and should have sent an email directly to them warning them of the potential dangers of using the polish. If they then needed to have a sale to help with the turnaround time of refunds- explain upfront to the customers their reasons for doing so and only start that after every single customer has been informed directly of the issue.

Here’s the problem- they posted once on instagram and (possibly? hearing varying stories) once on facebook. Both posts were quickly buried because…..oh, they’re releasing new polish. According to some of you on my facebook thread, some of your emails requesting refunds or replacements were ignored. And the co-owner is making wonderfully professional statements such as this:

Mentality Polish - Mistakes Happen But This Response Is Unacceptable

Not everyone is active on facebook and instagram and while sure, it’s okay to only post information about sales and new releases there- when you have a product out in the world causing ACTUAL BODILY HARM to your customers, you should be doing anything in your power to notify your customers ASAP. Yes, post on FB & IG but send out a mass email, too! At the time of this post, there is nothing on their actual shop website, either!

Do I feel for them as small business owners? Absolutely, this is a nightmare of a situation but do you know who I feel worse for? The customers whose nails were ruined, and even those customers whose aren’t but who now have to deal with the hassle of waiting a long time for refunds and not being able to use what they purchased. And I think an appropriate response from the company in the first place (with a little less condescending responses from the co-owner) would have made people a lot less upset.

If this had happened to me as a nail blogger and they’d attempted this kind of response to the situation? My Eagle Freedom American sue-happy self would be calculating damages!

Mentality Polish - Mistakes Happen But This Response Is Unacceptable

If fading polish, bleeding and curling glitter, restocks with low stock and stockists deciding to close sends the community into a frenzy, an actual serious health issue like this should as well. That’s my two cents on the situation. What are your thoughts? Leave them in the comments below!

P.S. I knew I was sick of neons for a reason

EDIT 2: Please check out ‘s comments below! She shared some very helpful screenshots to give you an idea if your bottles may be part of the bad batch. The sad thing is the date stamp in the photos, though….4 weeks and still no direct emails to customers from Mentality.

EDIT 3: It’s gone from bad to worse. Here is their latest update (again, via their social media):

Screen Shot 2015-08-23 at 10.19.58 AM

Screen Shot 2015-08-23 at 10.20.06 AM

Elsewhere, the only person I see answering the questions THEY should be answering is one of their bloggers. It’s a sad situation with a loss of credibility all around- but their latest update truly makes my blood boil for all of those of you who have purchased from this brand (‘sensitivity’ experienced or not). This response just confirmed for me (in my opinion) that they did not originally contact customers because of issues obtaining email addresses and but because they did not want the issue to be widely known about.

I think the community as a whole has given them plenty of time to handle this properly and they have failed again and again. I encourage anyone who had any type of reaction to report it to the FDA. If you’re in paypal’s claim window, I’d suggest filing it there as well.

EDIT 4: A reader just sent me some really troubling information, especially considering their facebook update this morning. Turns out, Mentality filed as a corporation on 06/29/2015. Just speculating here- Mentality’s first public acknowledgement about the issue was 07/22/2015. Did they know a month prior to that and were just preparing themselves for potential lawsuits and issues? There were rumors that some swatchers/bloggers knew mid june. Did they wait until customers contacted Edgy Polish (a day or two prior to 07/22/15) about the issues they were having to say something (at that point only because it’d been brought into the public because of someone else)?

Screen Shot 2015-08-23 at 11.00.12 AM

EDIT 5: This was their response to one person filing a paypal claim. Please, if you’re within the 180 day window, file a claim.

11951831_10100918215565725_2370280043902591195_n

EDIT 6: Aaaaand now they’re having a 50% off sale. Just as one last fuck you to the community, I guess.

Screen Shot 2015-08-23 at 6.28.14 PM

EDIT 7: There’s some indication that the affected batches may span back longer than Mentality is indicating- @spilledmilknails had a similar reaction 40+ weeks ago but at the time attributed it to acetone overuse, not the Mentality Nail Polish she’d been swatching. You can read more on her instagram here. It is being insinuated by some people currently that this indicates that Mentality KNEW a year ago about this issue- I think that is untrue as @spilledmilknails did not even realize it was Mentality until others started coming forward recently. There is enough crappy things that Mentality has done in this situation without needing to add misinformation to it.

However, it does indicate that the polishes that were part of this bad batch may be more than they thought/are claiming. Personally, I’d be wary of using anything from the last year at least.

EDIT 8: I will continue responding to comments later, just updating what happened overnight quickly before I head to work. Just some more baffling updates from Mentality (who is now deleting comments on their facebook page)- including ‘firing’ their bloggers. Which is a strange way to put it, if you’re not paying them, they aren’t your employees. As far as what I’ve seen, no one has been bullying any of their bloggers- however, people are (rightly so) wary of trusting anyone who has worked with Mentality in the past and is not making some kind of statement/warning to their readers now.

Screen Shot 2015-08-24 at 7.11.57 AM

The worst part? One of the only people who had been standing up for them (this is the swatcher who went to them in June with her concerns) wasn’t even given a heads up about it:

11960198_10152900049646184_3252450554792903309_n

Oh, and they also introduced their gel line- phrased in another condescending manner.

Screen Shot 2015-08-24 at 7.11.19 AM

A few more random comments sent to me-

11909804_10153895059645839_540434848_n 11910926_10153895224085839_54090357_n 11913219_10153895211765839_819325444_n 11921688_10153526883830406_9135940121338846586_n

This is also just speculation at this point, but many other brands think that Mentality blaming the base is just using Arminex as a scapegoat (and thus why they are not turning to them to make them whole financially). I’m not sure if the brands want to be tied to their suspicions publicly so I won’t list their names here but I’m thinking it’s likely not just the base alone.

Comment #1 – It’s possible it was the neon pigment that is the culprit, not the base. Some illegal pigments can react and produce copious amounts of formaldehyde. Someone said that they work in a lab or something and got formaldehyde on their skin and it turned brown like some of the nail photos are showing. That sounds pretty reasonable to me, especially since people are saying the polishes smell really bad.

Comment #2 – Ok this Arminex base? no maker i know of had heard of it in july. I dont think Arminex makes it; they import it? There were 2 base companies left in 2012, a third opened later that year due to demand and it’s out somewhere further inland in CA, wonder beautys base. I guess I need to hunt around and ask. so they pretend like its a common name among indies; its not at all. the biggest indies I know of hadnt heard of it.

I know a lot of people may feel wary of indies in general right now, but there are so many wonderful brands who IF they had an issue like this (which is still pretty unlikely, all things concerned- and many test much more extensively) would have handled this much, much better. I asked you for brand recommendations over on facebook. I know that to a certain degree this is going to change the indie polish world as a whole but keep these amazing brands in mind who don’t deserve to be painted with the same brush.

ALSO ADDING THIS IN AT A READER’S REQUEST RE: DISPOSAL: If you choose to not keep your Mentality Polish, I encourage that it be disposed of properly, as the EPA (in the US) classifies polish as HHW – Household Hazardous Waste. It doesn’t belong in a landfill.

EDIT 9: A few more things that were sent to me to include here-

Some information from a former NUBAR employee (Mentality is claiming their base is the same as NUBAR’s):

unnamed

Some now-deleted comments from Cosmetic Chemisist (?) Mike Levine which suggest that Mentality was possibly making their own base (illegal without a specific lab setup as far as I know) or adding components to it-

11912900_10153896610895839_2144648864_n

11925933_10153896623930839_1994676116_n

EDIT 10: A little more speculation from Mike Levine:

Screen Shot 2015-08-24 at 9.29.57 PM

EDIT 11: Some indication that Mentality was looking into the requirements to manufacture their own base in early 2014-

11903361_10153899371545839_2084632152_n

And hey- we made it onto Jezebel! If anyone is here after reading that article, please take note that the vast majority of indie brands are awesome and simply mixing glitter, pigment, etc into pre-made base that they purchase that comes along with MSDS info and batch quality testing. If you’re new to indie polish- don’t let this one bad apple spoil it for you!

Speaking of Jezebel, Danny posted his entire email to them on Mentality’s facebook page:

Labmuffin posted a great read on some of the speculation going around about what caused the nail lifting issue and what’s truly likely.

And just for fun- join in our fun with google translate and a Russian nail communities discussion of this issue over on my facebook page! I then do varnish will not fly until the memory is not gone, I’ll erase polish Golden Rose.

  • http://manicuredandmarvelous.com Roselynn787

Thank you for writing up something about this as well. The more of us who join together to bring awareness to this issue the better the chances that more ladies don’t get harmed. I’ll update my post to include a link to yours right now too.

    • http://www.themercurialmagpie.com/ The Mercurial Magpie

      I completely agree. Thanks, Roselynn!

  • Melissa Mims DiBona

When I saw your post this morning, it was the first I had heard about it. I was about 15 minutes from out the door, so I couldn’t comment. I bought the Neon Opaque collection from someone off NNR. I have used it with no issues, but now I’m concerned. I can’t refund or exchange since I didn’t buy from the company. I hope the person I bought from didn’t know about this, but I don’t know. I agree with you about the lack of response. One polishmaker seems to get crucified for a color fading (which she corrected for people with refunds), and again for choosing to change from stockist to individual retailer (Her choice, her company–People’s reactions were crazy), but Mentality seems to be getting a pass. I don’t get it.

    • http://www.themercurialmagpie.com/ The Mercurial Magpie

That’s a sucky situation to be in for sure! I wonder if the person you purchased it from could request it on your behalf? I don’t get it, either.

  • Sara Morgan Perea

Thank you so much for writing this up. I have recently experienced exactly, though not as severely, what is pictured, and had no clue it was due to those polishes. After reading the little that was available, and looking at the date that I used those polishes and when I started to experience pain and lifting, I now know for certain what happened, thanks in no part to the company.

    • http://www.themercurialmagpie.com/ The Mercurial Magpie

I am so sorry this happened to you :( At least now you know why but I know that doesn’t make it any better.

    • LettuceBalm

Did you go to the dermatologist? It would be useful to know what they said.

  • Angela F

I hadn’t purchased anything from them, but after the way Mentality handled the situation with llarowe (stockists carrying Mentality product), I can tell you I unliked Mentality’s facebook, twitter, and IG. Completely unprofessional.

    • http://www.themercurialmagpie.com/ The Mercurial Magpie

What happened there? I missed that part!

      • Angela F

Sorry!! Not llarowe! Harlowe and co. I did a screenshot of what happened.

        • http://www.themercurialmagpie.com/ The Mercurial Magpie

Oooh, I didn’t even hear about that! That makes all of this sound even worse :

          • http://peachynoon.blogspot.fi/ noon

Edgy Polish was the actually only responsible thing I saw in this incident too. They sent out a mass newsletter to all their customers at least a month or so ago (I got it myself though I’d never bought Mentality’s polish) letting everyone know they should be careful and they were removing Mentality from purchase until this was resolved. Then like a monthish later…this happened. I guess Mentality just dropped em like a hot potato or something. :/ It’s sad as hell when the stockist is more upfront and concerned about the safety than the actually polish maker.

          • http://www.themercurialmagpie.com/ The Mercurial Magpie

I completely agree with you! I would feel very comfortable purchasing from them (Edgy Polish) in the future.

  • http://seizethesparkle.com/ SJ Rueppel

Well said. Hopefully the news will reach more of the affected individuals. Having your nails disattach from their nail beds is a very serious health concern! Thanks for posting!!!

    • http://www.themercurialmagpie.com/ The Mercurial Magpie

      Extremely serious! And you’re welcome!

  • Jbh Jbh

I almost bought from them during their sale, so glad I didn’t! Even if I hadn’t had a reaction, their response is appalling.

    • http://www.themercurialmagpie.com/ The Mercurial Magpie

I am definitely glad I have not purchased from them. Right now I’m pissed FOR other people but I’d be really, really irked if it also happened to me!

  • Jenna Roby

Yeah, the lack of compassion in the face of causing ill health to their customers is glaringly obvious. Granted, it’s a smallish number known to have been injured & there really isn’t a way to predict who will react to any given ingredient, but the lack of sympathy in the posts you shared really turns me off buying from them in the future. I’m in in-home sales & if any of my customers has an issue with any product, I see to it that not only do they get a credit or replacement pronto, but that the home office knows asap about the issue so they can fix it. Doing proper customer service can be a stressful thing, but it’s an important thing to do right if one wants to stay in business.

    • http://www.themercurialmagpie.com/ The Mercurial Magpie

Even with the 40 people he said in that screenshot- that’s a huge chunk of customers to an indie brand IMO! But yeah, I totally agree- it comes off as very uncaring.

      • Jenna Roby

Good point! If 100 peeps have used polish with the bad base that’s a 40% reaction. If 400 peeps have used it, that takes it down to 10%. Even 10% may be over the FDA limit for a severe reaction to a cosmetic ingredient. The supplier should have known if that base was suitable for making polish. Even if they didn’t, that particular base (or the ingredient or combo of ingredients that caused the reaction) needs to be banned from use in cosmetics. Even if 1000 peeps have used this base with no probs, it totally sucks for the 40 known & who knows how many unknown peeps who’ve had to deal with their nails falling off. I don’t know if Mentality will be able to recover from the back lash that they could have prevented with open communication and a bit of sympathy for those damaged by their product.

        • http://www.themercurialmagpie.com/ The Mercurial Magpie

I agree. A different approach from the get go would have made this still costly but (imo) wouldn’t have harmed their reputation longterm.

    • Gina Wentworth

Plus – think of it as this – only 40 have figured out that the reaction was caused by the polish – there are a lot of people who had reactions and thought at first it might be their remover, or something else – sometimes it’s really hard to track what is causing the issue down – when it takes it a week or more to develop.

      • Jenna Roby

Exactly, Gina! There are 40 that he mentions, but what isn’t known is how many more of have contacted him because they had a reaction, how many customers reacted & haven’t said anything or haven’t used the bad base polishes they bought, so don’t know if they’d react badly to it or not. I read this morning than they aren’t issuing refunds, just replacements. While is less costly for Mentality in the short run, it just increases peeps upset over how this has been handled & many polish peeps I know now don’t want to buy from them. Not because of the bad base, but because of the bad customer service on this.

        • http://www.themercurialmagpie.com/ The Mercurial Magpie

No, now at this point they aren’t refunding OR replacing for anyone else!

          • Jenna Roby

So anyone who hasn’t heard about this & has a bad reaction in the future is SOL? Well that little rid bit just cost them another customer. I don’t like giving my money to companies that hurt their customers, even if it wasn’t on purpose, and then refuse to make it as right as they can for all of those effected.

          • Gina Wentworth

Yes – they have handled this whole situation poorly – I wouldn’t trust anything they say – or use their product personally – something is very wrong with them and their product.

        • Ftloosenfanzfree

Yes, seriously! If they have 40 confirmed cases they should not be acting like it stops there. They should be assuming there are a lot more cases where people didn’t realize what caused the problem.

And along similar lines, it is really pissing me off that in many of their statements about refunds they are speaking as though the people who haven’t had a reaction should not be owed a refund. These people don’t want to try your polish and find out the hard way whether they have the same reaction!

          • http://www.themercurialmagpie.com/ The Mercurial Magpie

            Exactly!!

  • Sharon Parayos Merritt

Thank you so much for this! What a horrible mess. I will certainly never buy from them because of their attitude. Unacceptable.

    • http://www.themercurialmagpie.com/ The Mercurial Magpie

      Same here. :

  • Tricia

Whoa? I had no idea. Thanks for the update

    • http://www.themercurialmagpie.com/ The Mercurial Magpie

I’m surprised how many people haven’t head about this yet!

      • Israeli Princess

I purchased a few Mentality lacquers 2-3 years ago when I met them at an indie party/gathering in San Jose. Just today I was on Harlow&Co as well as a couple other sites that carry multiple Indie brands and was surprised I didn’t see Mentality when I could have sworn I had seen it there before (now I know why). I actually came across your blog for the first time on Thirsday (2 nights ago) and have been hooked because your posts are so well written and you/your personality is so REAL and incredibly humorous. I honestly could not have discovered your blog at a better time because this is the first in hearing of this chemical reaction to a specific product line/release & all I wear is Indies!

It’s incredibly unfortunate that a bad situation was made horribly worse and quite possibly caused irreparable damage all because the CEO wasn’t able to keep their cool and blasted every single one of their customers for expressing legitimate concern over a product they have purchased and may (or may not) have used. The customers who have not had a a chemical reaction are JUST AS INPORTANT as those who have had a reaction.

Having heat put in you is part of being a business owner regardless of how big or small your business is. Harlow&Co was incredibly diplomatic as I am sure they felt the heat from selling a product line that had hurt people (mad respect for that). Mentality on the other hand…essentially told each and every one of us who has ever purchased from them that they don’t give a flying fat rat’s butt if we are concerned for our physical health from using their product unless THEY tell us.

What is most crappy is the individuals who have suffered physical harm as well as the other Indie makers who inevetibly, could end up feeling the backlash from this as I am sure this could end up deterring people from products that wre made to be healthier than mass produced store brand lacquer.

        • Israeli Princess

          Here are the screenshots

          • Gina Wentworth

It’s funny how in one comment they are saying – oh it’s these bottles – and another, it’s the ones from April to June, another says the holo neons – sounds like they are trying to cover up the extent of the issue.

          • http://www.themercurialmagpie.com/ The Mercurial Magpie

Agreed. Especially because it looks like there is at least one swatcher from 40+ weeks ago who had similar issues but attributed it to using too much acetone.

          • Israeli Princess

I had to read them a few times because I was getting confused. Then I came to the same conclusion as you

        • http://www.themercurialmagpie.com/ The Mercurial Magpie

First, thank you so much for your compliments on my blog and I’m glad you stumbled across it! “The customers who have not had a a chemical reaction are JUST AS INPORTANT as those who have had a reaction.” I completely agree with you and I’ll even say in a way they’re more important than those who have- because it’s still possible to PREVENT them from having one!

Thank you for those screencaps as well. I am going to add a note to the bottom of the post to make sure people see your comments.

  • http://www.twi-star.com/ Angel – twi_star

Never tried Mentality….. Do we know of any other brands that may have used this base? As a blogger this scares me because I do swatch for quite a few brands. Eeekk!

    • http://www.themercurialmagpie.com/ The Mercurial Magpie

From what it sounds like it was a bad batch of the base. I have not heard of other indies that are having the same trouble.

      • http://www.twi-star.com/ Angel – twi_star

        Ok thank you!

    • Gina Wentworth

They sourced their base from china from the sounds of it – trying to find cheaper ways to make the polish – hopefully no other makers have tried this tactic – and use only base that’s been approved/regulated in the US.

      • http://www.themercurialmagpie.com/ The Mercurial Magpie

I am wondering if it’s more than what we think and something along the lines of this…

        • Gina Wentworth

Honestly – I don’t think we can believe anything they tell us at this point. I would think if it was a base issue from a large company like Arminex (makers of Nubar polish) – we’d see way more of the same issue with several brands – not just theirs – it has to be an ingredient they are using – whether it be a base they are claiming is A’s or a pigment or who knows what else…

          • Anastacia Cooke

            This makes it interesting…

MNP claims they can’t afford to get the base tested, but yet it is the same base (apparently) as the stuff that Nubar uses…

Do you think that Nubar would test the base for them? It would be a good way to remove themselves from the controversy.

  • Natalie Carlson Brown

Wow, this is very serious. I understand that they’re a small business but that makes it even more important to quickly and effectively respond to this issue. Thanks for the update. :)

    • http://www.themercurialmagpie.com/ The Mercurial Magpie

I agree. I think if they had handled this another way they could have easily still maintained their reputation (and in some ways strengthed it).

  • Sara

Thank you Kirby so much for bringing this situation to light. Your fb post was the only one I saw in my feed regarding this problem. I’m not highly active in social media nail polish groups, so your post was very appreciated. I, too, am shocked to hear how this situation is being handled by the owner(s), what with being apathetic and rude to customers that are seriously worried. I was concerned about all of this BEFORE seeing a picture of one woman’s proof of damage to her nails, and she may be one of only a few with such severe damage, but now I REALLY feel for her and other similar customers! I never have been a customer of Mentality’s and never will be; there are too many amazing woman and men out there with amazing products who truly care about their customers, so why give patronage to a business who can’t seem to be bothered with a real problem?

    • http://www.themercurialmagpie.com/ The Mercurial Magpie

I’m so glad you saw my post but I’m also sad that it was the first one you saw! That’s why I’m so angry at how this has been handled! I definitely agree with everything you said.

  • Yadi Lopez

I thought I saw something weeks ago about this, but I didn’t know it was this bad! Wow! I have never tried this brand, but had seen a swatch of a polish from them that I thought about getting. Definitely won’t be a customer now! Thanks for the warning!

P.s. Is your dog a Chow chow?? I love chow chow!!

    • http://www.themercurialmagpie.com/ The Mercurial Magpie

You’re welcome! And yes, he’s a Chow chow! 😀 They are the best!!

I heard about it through a Facebook group a few weeks back. Not Mentality-a Facebook group. I bought a few polishes from them during a sale in June that have yet to be used, and I’m not going to risk my nails, especially now that I know various collections of theirs were affected. The nail in the coffin was the extremely disrespectful and unprofessional “response”. Customer service means so much but some don’t either get it or just do not care. They’ve lost my business.

    • http://www.themercurialmagpie.com/ The Mercurial Magpie

I don’t blame you at all, I’d be really afraid to use them if I had them. :( And I completely agree- this could have been handled much differently and they could have come out with a strengthened reputation for caring about their customers and proactively fixing problems but the way it’s been handled has been a big mess.

  • http://hand-some-girls.blogspot.de Anne Schenk

Thank you for your honest opinion.
That really is not the right way to act with your customers!

    • http://www.themercurialmagpie.com/ The Mercurial Magpie

      You’re welcome. I totally agree!

  • spinningdust

Wow, thank you so much for this post, I bought polishes (the VERY expensive Crystalchrome collection) from them right in the middle of the time period they said could have the issue and had no idea.

    • http://www.themercurialmagpie.com/ The Mercurial Magpie

That’s what makes me so angry about this. They could have proactively warned you and contacted you directly but what if you hadn’t seen my post? You may have used them and ended up having to grow out damaged nails for 6 months.

      • spinningdust

I’m now especially glad I saw this post yesterday and immediately emailed them – it looks like due to a lot of people realising they had bad product (likely thanks to you!), Mentality are no longer refunding or replacing anyone’s orders. Their post on instagram is here.

        • http://www.themercurialmagpie.com/ The Mercurial Magpie

So I’m a bully and a troll? Lol, I’ll take it if it means saving some people’s nails!

  • Diane

Thank you so much for posting this. I am @dmm_nails and that is my hand in that photo. I knew in my heart there was not enough knowledge out there about this serious situation and am so happy people are becoming more aware thanks to several bloggers. Thank you from the bottom of my heart for discussing this!!!

    • http://www.themercurialmagpie.com/ The Mercurial Magpie

Thank you for being brave enough to share what happened to you! It seemed like you were a huge Mentality fan which to me makes the way you’ve been treated even worse.

  • http://www.themercurialmagpie.com/ The Mercurial Magpie

Your english is fine! I was not aware that international distributors were handled just as badly as the others! That is unacceptable not only to ignore notifying customers but ignore emails from multiple distributors!

  • http://www.themercurialmagpie.com/ The Mercurial Magpie

Oh no! I’m so sorry to hear that happened to you. Did your emails to them go without response as well?

  • Emma B

I hadn’t heard about this until yesterday when someone commented on an old post if mine about lifting I had experienced. I haven’t been affected by mentality polish (unless it turns out to be also a problem in older bases) but I certainly had the very same issues caused by allergy to gel polish. It has taken two months for my hands to recover, but my nails are still ridged and they aren’t fully grown back on nail bed, the lifting is not so far down now. I feel for anyone else suffering with this as I know first hand bow uncomfortable it is

    • http://www.themercurialmagpie.com/ The Mercurial Magpie

It does appear that at least one person experienced lifting outside the timeframe Mentality is suggesting- it could be unrelated, though.

  • Erika Elswick

Well said Kirby ! I am so glad to see bloggers spreading the word about this issue. Its awful that it has taken so long to come to the fore. If this happened to me I would be devastated.I came close several times but never actually purchased from Mentality(and now I won’t for sure .) Its a shame because their prices are really good but this is so scary and I’m appalled they didnt personally contact everyone who bought these polishes and make many announcements on social media. The first I saw of it was Harlows announcement and I didn’t like how Mentality handled that situation, needless to say the big picture is much worse. I’m also disappointed in their bloggers .Anyone close to this situation should have cared enough to warn others !

    • http://www.themercurialmagpie.com/ The Mercurial Magpie

Yeah, I’m not sure how early their bloggers knew (I think a lot are just finding out now) but if I’d reviewed/recommended anything by them I’d feel obligated to spread the word about this mess.

  • Renee

Omg I had no idea about this! I have never tried Mentality brand. Thank you so much for writing this! what awful, disgusting and uncaring display of customer service I have ever seen. My goodness those poor ladies whose nails are ruined I would be devastated if that happened to me. I really hope those ladies sue them. This is why I love your blog and it’s my favorite I read everyday. you are completely genuine and truly care about us all and give very honest and truthful opinions and reviews on each polish and product. I’ve tried many many products upon your recommendation and love them! Thank you again for this post making us all aware of this I appreciate it very much.

    • http://www.themercurialmagpie.com/ The Mercurial Magpie

Thank you for such kind statements about my blog! :) I agree that I’d be beyond devastated if this happened to me & it’s ridiculous that they still are not contacting those potentially effected!

  • Clara

Your blog post is the only unbiased and not sugarcoated one I’ve seen so far. Thank you for helping to spread the word about this- I was a customer of Mentality in the past but not again, this is appalling.

    • http://www.themercurialmagpie.com/ The Mercurial Magpie

I don’t blame you- how anyone can excuse the way they’ve handled this baffles me.

  • thepolishaholic

Thanks for this post, I’ve shared it across my blog twitter and Facebook. This is so scary and the response from the brand, especially the comment from Danny is unacceptable. My heart aches for those who have had a reaction to their polish, I hope they are being compensated for the pain and suffering along with any medical care they have had to seek due to the damage

    • http://www.themercurialmagpie.com/ The Mercurial Magpie

Thank you for helping spread awareness!! It is truly scary and I’m still coming across people who had no clue…how any company could be okay with not warning everyone as soon as they knew is beyond me.

      • nikki w

What is worse is the comment that I made about how mentality said possilbly there 5 free and gloss polishes were also affected, has since been deleted of mentalities page. They posted that and then they deleted it awhile later. I have the screen shot of where they said this too. They probably deleted it due to the fact that it would cause more people to file a claim.

        • Maureen Holtzinger

Post the screenshot and send it to some of the bloggers. That’s important info since many think it’s just the neons

  • Kelly Gibson

OMG this is SO scary! Thank you so much for letting people know! I love polish but have a really hard time with my nails splitting and peeling if I use remover with too much acetone, or use it too frequently, and don’t give me nails substantial breaks in between colors, with lots of treatments in between. I was JUST about to break down and buy some MNP because I’ve been eyeing their colors for years. I am SOOO relieved I saw this post before I started using their products. The bad customer service is the icing on the cake. No company, but ESPECIALLY a small indie brand that needs every single customer it gets, should treat its customers like that!

    • fireweaver

me too! i keep eyeing some colors with plenty of their new collections and yet somehow never got around to an order from them… and i’m crazy glad right now that i never did. WOW!!!

      • http://www.themercurialmagpie.com/ The Mercurial Magpie

        I’m glad you didn’t!!

    • http://www.themercurialmagpie.com/ The Mercurial Magpie

      I completely agree!

  • Gayle

I find this profoundly disturbing for lots of reasons, but one big one is that there are aspects that don’t make sense. Did Mentality did something to their polishes that’s unique to them that caused a chemical reaction that led to this? Because I can’t see any way a large supplier would make base just for a single indie polish maker. Other indie makers have likely bought the same base. So why are there not more reports of this? I’m wondering if either Mentality added something that caused a reaction just in their polishes, or if there’s soon to be a wave of complaints from customers of other indie makers who used the same base. I’m a bit unnerved by the nail damage. I’m not sure I’m comfortable wearing any/most of my indie brands until I have a better grasp of what caused this significant damage and compromised the health of MNP users. And no way can MNP ultimately pay pain and suffering, much less damage. A major brand wrecks your hands or health, you can sue and potentially get compensation. But blood out of turnip rules apply here. Even if the affected users sue and win, they can’t get money out of a company so small. And I’m guessing the owners set it up as an LLC so that their own money can’t be affected. The lack of skin in the game for indie polish owners has always disturbed me. This illustrates why it’s a problem. They’re so small they can’t really make their customers whole in any meaningful way. All they have to do is shut down to avoid any real repercussions for their sloppy, damaging behavior. This is chilling news.

    • http://www.themercurialmagpie.com/ The Mercurial Magpie

You definitely made some points that are good to think about. I do feel that so many in this community would have handled this in a much better way- but I’m sure that some thought that of Mentality as well before this happened. I will still wear my indies but may be a little more cautious.

      • Gayle

I think I wasn’t clear enough with my first post. There is no way that base wasn’t sold to other indies and probably some other smaller commercial firms. If the problem is the base, similar problems from other brands would have been or will be soon forthcoming. The fact that there hasn’t been leads me to strongly suspect that the issue was something that happened to the base between the time it arrived to MNP and the time it was sold by MNP. I personally think they are hiding what they did to change the chemical nature of the base. Or they’re too stupid to even understand what they did to the base to cause this problem. I just worry that there might be other indie makers equally unaware of bad chemical mixes. Which scares me about indies that I haven’t already tried out and been reassured about.

        • http://www.themercurialmagpie.com/ The Mercurial Magpie

Ooooh, yeah I totally see what you’re saying. Personally I also think it must not be *just* the base- potentially what they mixed into it or some other factors.

  • http://paintednubbs.blogspot.com/ Ashlee(PaintedNubbs)

I knew of the issue but I had no idea it was being handled so badly! I thought the comment I saw last night from the girl who contacted them about replacements and they told her to try the polishes first and see what happens was bad, but his response just takes the cake. I’ve been using their topcoat for swatches but that stop now! I’ll also be trashing the polishes I reviewed from them last year, I want nothing to do with this brand. I feel so bad for all the people this has affected and hope they can get some type of resolution.

    • http://www.themercurialmagpie.com/ The Mercurial Magpie

This is why I follow you and can trust you as a blogger!

    • Ftloosenfanzfree

They actually told someone to try the polishes!?? That seems like literally the worst possible response.

      • http://paintednubbs.blogspot.com/ Ashlee(PaintedNubbs)

My wording was off and I guess it technically doesn’t sound as bad the way she was told, I should have quoted her directly, but it’s still a horrible response. To possibly put your customers in pain over a refund? Rediculous!

        • http://www.themercurialmagpie.com/ The Mercurial Magpie

I think it totally sounds as bad as you put it!!

  • Ricky Cole

My trip down the rabbit hole started with Indie eye shadows & thankfully I never had a sever reaction. I had a few that left my eyes irritated & assumed it was the glitter and didn’t wear them again. My old aging eyes don’t need to be wearing blinged out shadows anyways…and then came the Orglamix scandal.

I never really thought I was risking any damage because I paid attention when products were listed as Lips only – not for use on eyes. It never occurred to me that someone would use pigments that were deemed not safe for cosmetic use.

But my passion for eye shadows waned as I discovered Indie nail polish.
And somehow nail polish just seemed safer than eye shadow – my perception at least was less risk of something going wrong vs potentially going blind. Clearly this is not the case. ( I should add I am not accusing MNP of knowingly/intentionally using unsafe materials.)

As I said in the comments on your Facebook post, I follow a ton of nail blogs on Bloglovin but there are very few I follow on FB or any social media so I am really glad you went ahead with a blog post to reach as many people as possible.

I almost exclusively wear Indie nail polish & the commercial/mainstream polish I do wear tends to be as undies. This situation won’t prevent me from buying Indie nail polish from brands OTHER than Mentality.

It will however make me more cautious on trying new brands & more selective on where I spend my money. Exceptional customer service & transparency from brands like Ellagee & Ruby White Tips matter now more than ever to me.

It will also likely thin out the nail blogs I follow too. I buy a lot of polish based on reviews & swatches. It may sound harsh, but if I see Mentality Nail Polish in a blogs archive & no post about this serious issue then I will un-follow because how can I trust that blogger & their reviews again? I don’t have a problem with sponsored posts but transparency & integrity…its important to me.

The integrity of Edgy Polish + Harlow & Co also makes an impression on me & they now have a fan in me as well as a future customer.

I went & liked every reseller mentioned in the comments on FB. And with Llarowe not reselling other brands anymore, I am in the market for a new “dealer”.
My job is stressful & having amazing nails gets me thru the day.

(And this now makes me wonder if this contributed to LeAnn’s decision to semi-retire…

I also just went thru my order history on Llarowe to make sure I never ordered any MNP because checking the Helmer drawers is a daunting thought & holy balls I need more supervision!)

My heart goes out to all those affected & best wishes for a speedy recovery.
Thanks Kirby for the service you did to us all for getting this out there for all of us who were still in the dark about it.

There are just too many other Indie Nail polish makers out there who don’t deserve to be “painted with the same (nail?) brush as MNP who I can give my support & money too instead of buying MNP because I didn’t know about the risk & how they treat their customers.

    • http://www.themercurialmagpie.com/ The Mercurial Magpie

Oh my goodness Ricky, this is such an excellent comment. Everything you said just hit the nail on the head perfectly. ESPECIALLY about the bloggers involved. I also don’t want to bash any by name as I don’t think they are bad people but I feel like you have a responsibility to your readers and the way some are treating it is not inspiring confidence to me.

  • Anna He

Oh. my. goodness. This is ridiculous! I can’t believe that I haven’t found out about this until now. I bought two polishes from a recent sale- thank goodness I haven’t worn them yet! (Needless to say, I never will!) I just don’t understand how she could let this happen to all of her customers! Without happy customers, a business can’t hope to be successful. Her business depends so heavily on its consumers, yet she treats all of us so rudely. Not to mention, she sold us a product that could cause considerable harm. She’s lucky no one has taken any legal action against her yet. I’m definitely more cautious with indie brands now because of this incident (though I know there are plenty of brands who truly care about their customers). This is all so saddening…

    • http://www.themercurialmagpie.com/ The Mercurial Magpie

It is really and truly sad. Every post and update from them has given no indication that they care how much they’ve injured some of their customers.

  • Linda Wikenhed Kronqvist

Hi! Thanks for bringing this up. I can tell you it starts with this horrible pain (painkillers for 3 days, Waking up at night due to the pain! ) and then a week later it starts….
Imagine a work where you have to use a keyboard all day. I almost called in sick….
And yes, calling this to be sensitive is pure bs. I’ve been using polish every day since before America was discovered 😉.
I’m getting angry just to think about it….The pic above is from like a week ago. It looked so much worse in May….and it’s august!
I’m not saying that this ruined my summer, but it sure has been a big part of it 😕.
    /Linda Wikenhed Kronqvist

    • http://www.themercurialmagpie.com/ The Mercurial Magpie

Yes, referring to it as sensitivity is minimizing and hiding the real impact it’s having! It would totally ruin my summer as well :( I feel so bad for you and I hope that your nails will recover.

  • Krista A

Is there any info what will happen to nails after allergic reaction? I had reaction three weeks ago.

    • Emma B

Apologies if this is too detailed or graphic. I have had the same reactions as in the photos but mine was caused by gel polishes. If you have had lifting and mega sore finger tips (mine were weeping at one point) then you will find over a week or so the skin dries out, I had to let it really dry too, no creams or oils at all apart from some steroid cream from my doctor. I’ve the following week or two, the hardened thickened skin on my tips came off in big lumps. The new skin underneath was fine.

My nails however, well they were lifting really badly, the worst were my little fingers which had almost fully lifted. They nails were looking odd, sticking out at a funny angle (because they were attached they almost looked to curve up.). I had horizontal ridges where they would be normally attached and now aren’t.

Time scale wise I had the worst of my reactions in April, although I did use a gel again in June and instantly had problems. Now, late August, my hands are almost normal, my skin has healed. No pain in the nail beds. My nails have grown through and are now lifting less than they were. I do have some ridges, but nowhere near as bad as previously.

Research shows it can be 4 months + for nails to fully grow through. I am giving them plenty of TLC and using only “safe” tried and trusted products and only changing my polish every four or five days to avoid exposure to acetone.

      • http://www.themercurialmagpie.com/ The Mercurial Magpie

Thank you for sharing this info! Hopefully those who are experiencing this will have their nails recover.

  • Lacky Corner

I used to love Mentality. I still think that the older polishes (that is safe to use) is amazing for stamping, but I have lost all trust I had for that company. Not only do they treat their own customers badly but look at the way the have treated their resellers like Edgy Polish and Harlow & Co. They refuse to compensate them for all the polishes that they have kindly and very customer friendly given refund for.

I’m from Sweden and our nail community is pretty small so I know lots of those who have been injured by the polishes and know how much agony and pain they have been through. I still can’t belive that Mentality call this sensitivity when the truth is something much more serious and horrible.

I might still use the polishes that I really love for stamping and lead light manicures, but I will never again buy a new polish from them and I will never again give them any kind of credit on my blog, Instagram or Facebook. And to be honest they have gotten lots of attention from me before this.

    • http://www.themercurialmagpie.com/ The Mercurial Magpie

I agree- the way they’ve treated their stockists is truly unfair and minimizing the damage of the victims is ridiculous. I’m so sorry for the pain your friends are going through :(

  • Naomi

Thanks for the info!! I hadn’t heard anything about the issue. Very sad that serious concerns like this go unnoticed when gossip-y issues get spread like wild fire. I follow someone on Instagram who regularly swatches mentality, and had blisters under her nail beds, but she put it down to a reaction to the acetone she was using.. Sounds like it was more about the polishes though!
Nuggles (non nail polish obsessed people) wouldn’t understand but I would be soooo devastated if something like this happened to my nails! And the fact that mentality don’t seem to care is astounding!

    • http://www.themercurialmagpie.com/ The Mercurial Magpie

It’s really astounding! None of their posts have given off even the slightest impression that they care about what they did to their customers- only that ‘haters and trolls’ (i.e. me) have made it so that they aren’t receiving more money.

  • katierose295

Their new Facebook post says no more refunds or exchanges on the defective and harmful polish. Wow. That kind of “customer service” is just beyond the pale. I will never, EVER buy from these people.

    • http://www.themercurialmagpie.com/ The Mercurial Magpie

My blood is still boiling from reading that post. I’ve added it to my post here but yeah- not customer service at all.

  • http://www.jennybeaned.com Jenny

Thanks for posting! This is scary stuff!! I hope it all gets resolved and the girls get compensated for the pain they’re going through.

    • http://www.themercurialmagpie.com/ The Mercurial Magpie

I hope so as well :(

  • http://www.britnails.co.uk/ Allie Wills

Thank you for this post! The way Mentality have handled this is nothing short of disgusting. I can’t believe a so-called business owner would come out with a response like that, what the hell?! I’ve never tried Mentality and I never will after this. If this had happened to me it would have affected my income so I would be suing some asses, to be quite honest.

    • http://www.themercurialmagpie.com/ The Mercurial Magpie

I agree 100% with everything you said.

  • http://pennyforthemuk.com/ claire s

kirby, i thank you for bringing this to the attention it needed. i had heard only the vaguest of details…i had no idea how bad this had got. I feel especially bad for those directly affected – and even more so for those who have been completely shunned by Danny…..
It had been a brand i have never really tried – no real reason,…it just never appealed to me….
but surely the first thing to think of in any type of business is “customer satisfaction”? I cant see how they will bounce back from this, and if the way things are unfolding, im not sure they deserve to…..
If its ok with you Kirby, i have put a link to this post on my FB Blog page and if its ok would love to put a link to it on my blog – i wont until you say its ok, but i think it should be something seen by all polish lovers.
Sad day for Indie lovers. And makes you appreciate the very good ones we do have <3

    • http://www.themercurialmagpie.com/ The Mercurial Magpie

Absolutely! Thank you for helping to spread the word! And I agree- there are so many great brands who would have handled this entirely differently and this makes me sad for the community.

  • http://www.chosengirlzsalon.com Shannon Andrews

Back in mid June the Neon Matte collection was 50% off so $33. I remember thinking it was odd that a new collection was already on sale but was sad I had missed out because it was gone fast. Looks like I dodged a bullet.

    • http://www.themercurialmagpie.com/ The Mercurial Magpie

You really did! Now we know why :

  • Alysha

Thank you so much for alerting us indie nail polish lovers everywhere! I own 6 Mentality polishes, 2 of them with the bad base. My nails didn’t fall of but it was itching the daylights out of me and developed a slight redness so I immediately removed them and contacted Mentality via Facebook. That’s when I saw the post about “sensitivity” issues (BTW this was in July). They told me to contact Harlow, the stockist I bought the polishes from, Harlow emailed me back for more info and to say they were compling a list of affected polishes, customers, emails you know the whole shebang.
All was good til Harlow released a statement that the co-owner decided to let go Harlow as their stockist immediately. I was like WHAT! Why??? What about your international customers? To this day I still don’t understand why they did that smack center of this disaster. Was it too overwhelming and confusing? Did they want to handle cases directly? I don’t get it.

Also according to Mentality’s posts they used the same base as Nubar. Has anyone used Nubar ‘s polishes and experienced the same issue? I certainly haven’t seen or heard anything.

Well since I won’t be getting my refund I guess I’ll have to drop my polishes off at my nearest hazardous waste site because I certainly do not want anyone to experience the horror of watching their nails pop off or any other kind of reaction. Sorry for the rant and thanks again for posting this!

    • http://www.themercurialmagpie.com/ The Mercurial Magpie

I totally agree- the way they treated their stockists (who AFAIK just wanted information on what was going on with refunds) really left a sour taste in my mouth before they even pulled all this other crap.

    • Gayle

*raises hand*. Yes, I’ve used Nubar. Without issues, and my skin and nails are pretty sensitive to chemicals. And I strongly doubt that Nubar and MNP are the only two companies using that base. So either we will see a crap ton of similar reactions from diverse sources within the next days/weeks OR (as I suspect) it will become clearer that the problem was what MNP did to their base between the time they received it and the time they bottled and sold it to customers. For real, MNP would be first in line to sue Nubar/Arminex if their claim was legit. Every bit of this leads me to conclude they’re lying.

  • Stephanie Ladd

It certainly doesn’t excuse behavior or injury, but is anyone protected by PayPal and can at least get a refund?

    • http://www.themercurialmagpie.com/ The Mercurial Magpie

I hope so- it’s what, 180 days now, right?

  • Sarah

Holy crap, this was JUST POSTED 15 minutes ago on their facebook:

Now the sale that everyone keeps asking for: All neon collections are 50% off for a very limited time! Prices are as marked, no coupon needed. US and International orders welcome! Our current production time is two weeks, as a stream of orders continues. We are filling our recent replacement order requests simultaneously in the order that we received them. Recent neon orders will be adjusted to reflect the sale price. Thank you endlessly for the continued stream of support as we work non-stop for you! ‪#‎payingtoshiptheremakes‬ #‪#‎workingaroundtheclock‬ ‪#‎thankyou‬ Shop at http://ift.tt/1MHbUY5 http://ift.tt/1MHbX6m

    • http://www.themercurialmagpie.com/ The Mercurial Magpie

I would like to know who are these people who were asking for a sale. LOL

  • Anna Antipenko

Why aren’t those with damages seeking compensation? I’d be seeking out a personal injury lawyer if I were hurt, and the company possibly knew ahead of time?? I feel so bad for those suffering, and who knows if they will be “whole” again, i.e. able to grow nails, able to wear polish, etc.

    • http://www.themercurialmagpie.com/ The Mercurial Magpie

I feel really bad for them! I imagine it’s not cheap to hire a lawyer though- especially if they have concerns about the company actually being able to pay a settlement :(

    • Kɐyləə

I have a strong feeling that at least one person is going to be going over this with a lawyer

    • Susan Forest-Rode

They’ll be going bankrupt in a very short while and be out of business is what I predict. There won’t be any money to collect. They don’t have liability insurance because they were either to cheap (read greedy) or too stupid to purchase it. The whole thing is really sad. Not because people are out money but because of the pain and physical damage done. For some people the damage may be permanent too. That’s just awful.

  • http://foreverpurple.com/ Daethian

So I just discovered this issue! I bought 4 bottles of Mentality Polish in June. They are saying the affected bottles have screen printed labels and I’m not sure what that means. My bottle labels are white rectangle stickers with black text. I’ve only worn these polishes one time. I can live with throwing out the neons if I must but I hate to part with Bolt if I don’t really have too. Super shitty customer service saying they’ve maxed out what they can/will replace. :(

    • http://www.themercurialmagpie.com/ The Mercurial Magpie

Very shitty :( I hope you can find a good dupe for Bolt in another brand!

    • Judy Periera

Actually it’s at least any polish in the round bottles that’s suspect. I had no issue being sent replacements about a month ago (and only had slight damage to a few nails, which is now almost grown out). Mine were the neon glazes with white labels and at the time I was impressed with how quickly they handled it and it truly seemed like they were attempting to do things right. Things happen. I get that But how they are responding has gotten worse and worse. At this point they have lost me as a future customer.

  • Madeline KM

Wait… one of the screenshots posted says that the affected base is the one they’ve been using for the past year! Am I missing something? Also, this news of Mentality filing for incorporation is too awful, even as a suspicion (really hard to imagine that it’s not related). I hope that if there are people with proof that Mentality knew of this problem earlier than they are acknowledging that they come forward.

    • http://www.themercurialmagpie.com/ The Mercurial Magpie

One of their swatchers had a similar issue nearly a year ago but attributed it to too much acetone usage. Now that the rest of this has become public, she’s guessing it was actually the mentality polish that caused it, not the acetone. The concerning thing is that it’s way outside of the April-June timeframe Mentality has been sticking behind.

    • FeyonaT

Sorry for asking, but I don’t really understand why filing for incorporation is bad and suspicious? I just don’t understand the mechanism.

      • http://fixintofaff.blogspot.co.uk/ Fixin To Faff

By filing for incorporation suspiciously just before publicly admitting anything wrong with the polish, the indication is that they were making moves to protect themselves from imminent litigation (because without incorporating, the owners would be personally liable).

Thank you for this post. I have also shared it on my social media platforms… Im happy that we are standing together as a community

My bottles from 17 weeks ago. They smell horrible and this is what they look like and are also the ones I got a reaction to. Every. Single. One.

    • http://www.themercurialmagpie.com/ The Mercurial Magpie

Ugh :( I think the horrible smell means something more than just bad base is going on…

  • Amy Beth McMaster

Thank you SO much for updating to reflect my own recent blog post. (I am spilledmilknails) I did not know for a very long time I was having issues with specifically Mentality let alone polish. Once I was sure what the cause was- I brought the information to Mentality. I was suddenly suffering from some other health issues at the exact same time so it was a mess to untangle. I apologize for not coming forward sooner. I meant no harm, I was simply trusting that Mentality was handling their customer base. I only swatch for them- so I am no pro by any means to how to handle all that was going on. This appears to be so much bigger than me. (and for a long time I felt pretty isolated because I did not know of anyone else suffering) Thank you for sharing this information and keeping it updated!

    • Ricky Cole

In my opinion, you have nothing to apologize for. How could you come forward when you didn’t know it was happening to others?

    • http://www.themercurialmagpie.com/ The Mercurial Magpie

I agree with Ricky, I don’t blame you at all for not coming forward sooner- you didn’t even realize until recently that it was Mentality causing your issue.

  • http://www.beaumiroir.com Lulle.Beaumiroir

Uuuh can a company decide not to refund/replace a product that may cause bodily harm to users?? I mean, are they not required to make an official product recall in these circumstances? Their lack of concern is even more unbelievable that this is obviously going to end really badly for them when people start suing…

    • http://www.themercurialmagpie.com/ The Mercurial Magpie

Yep. At least for now it looks like Paypal is putting through refunds!

  • http://lelacquerhookup.blogspot.com/ Michelle

Wow, I am definitely throwing away my Mentality Cupcake! I thought it’d be okay to keep it since I ordered it a little more than one year ago, but after reading Edit 7, I’m just way too scared. Thank you so much for keeping up with this developing situation. I will continue to reference this post until the fiasco has died.

    • http://www.themercurialmagpie.com/ The Mercurial Magpie

You’re welcome! I’d be feeling wary of using it, too :(

  • http://artavika.ru/ Artavika

You’ve done a great job of collecting all pieces of information in one place. Thank you, this is so valuable.
The way this situation progresses appalls me more and more (just when I think “it can’t get any worse”, it does. It has now happened several times already!).
And it’s so sad and unfair that this nasty thing casts shadows on the whole indie industry! That’s what infuriates me most: that Mentality is now making harm not only to themselves but to fellow indie makers.

    • http://www.themercurialmagpie.com/ The Mercurial Magpie

Thank you so much! And yes- that part really is unfair :(

  • Maria Luu

Has anyone seen their latest facebook post? The whole situation just keeps getting weirder and weirder, especially with their responses….I am one of the people who had no idea about what happened either. I just recently found out thanks to Katie’s post on Harlow and Co.’s fb page. Luckily i saw it right before i was about to buy some of their polish! Anyway, thank you and to everyone else for circulating this around so more people can find out what’s “really” going on with this company.

    • http://www.themercurialmagpie.com/ The Mercurial Magpie

Agreed with everything you said! They aren’t even the slightest bit apologetic and it’s kinda sickening.

  • J

Yeah- they don’t care. They obviously think they are the victims here. These non secured FB posts make me even more sure that they don’t care about anyone but themselves.

    • http://www.themercurialmagpie.com/ The Mercurial Magpie

His timeline reads like a crazy person :(

  • Sparks13

Sue the manufacturer of the base, not the small company that was equally their victim. Really, how much $$$ to you think these two individuals have? Once you ruined them financially, will you demand they be put to death?

    • Jbh Jbh

The polish they sold made people’s fingernails come off… and they ruined themselves with their handling of the situation. How do you think the people that have to pay medical bills feel? What about the people having problems who don’t go on social media and have no idea what is causing their nails to come off? The base being bad is what they have said, but there has been no proof whatsoever that it was, in fact, the base and not something else they added. They have tried to cover this up since the start, I think they know exactly what happened and are trying to pass liability on to someone else. I have not been affected by this (I haven’t purchased from them for a while, so I have no horse in this race), but I can tell you from their attitudes I will never buy from them again.

      • http://www.themercurialmagpie.com/ The Mercurial Magpie

Exactly. Where is the sympathy for the people physically injured?

  • thepanttherlady

I urge anyone who has been affected by this company to file a complaint with the California Attorney General’s office. Mentality can censor their page and comments but with enough complaints, they won’t be able to continue being so blase.

    https://oag.ca.gov/consumers

    • http://www.themercurialmagpie.com/ The Mercurial Magpie

      Great point!

  • Gayle

I’m not a maker, but I’d heard of Arminex base before this mess happened. MNP has made it clear that they took few steps (no liability insurance?!?) to provide basic remedies to their customers. Nubar (who makes Arminex among other nail polish products) has deeper pockets than MNP. If they’re legitimately to blame for this mess, they’d be a smart target and an easier one. It feels like MNP is walking a fine line here, trying to shift blame for MNP’s error onto another company while trying to avoid saying anything that would cause that company to be forced to sue them. If this is legit due to another company, then MNP has been damaged too. Testing isn’t heinously expensive. Bottom line, I don’t believe anyone is responsible except MNP. They don’t understand basic chemistry or chemical reactions. I suspect Nubar is so far unaware, but if they’re not at fault, then MNP is damaging them too in all this mess.

    • http://www.themercurialmagpie.com/ The Mercurial Magpie

I do believe Nubar has now been informed and has requested someone send them a bottle of the bad batch. Truly though- I don’t think MNP is being upfront about what the issue could be. Just saying it’s the base sounds fishy…

  • http://peachynoon.blogspot.fi/ noon

By the way, if it would be formaldehyde by some reason, formaldehyde has been documented causing nails to lift: http://www.ncbi.nlm.nih.gov/pubmed/17868227 & http://www.nailsmag.com/article/91567/onycholysis-or-nail-separation-has-different-varieties

So that correlation would make sense. Here’s sources that say so, in addition to that short anecdote about the lab worker.

    • http://www.themercurialmagpie.com/ The Mercurial Magpie

      Great find!

  • Nicole

This was posted in one of the groups, by a former Nubar employee.

I hope everyone has kept screen shots of these responses as they’ve deleted most of the interaction off of Facebook and it seems we’re no longer allowed to comment or post to that page directly. Even if you weren’t affected, it may help someone who was who wasn’t tech savvy enough or able to keep track of how Mentality has handled this situation. I’m one who filed a PayPal dispute which they escalated by claiming the polish I purchased was outside the time frame of the bad batch. I bought them on June 19th and its my understanding that all polishes from April through June are suspect, by their own admission. Posts like this are extremely valuable in helping people keep the facts straight…thanks so much for updating and keeping us informed!

    • Vanessa S.

For what it’s worth, I made 3 orders from Mentality during the affected timeframe – 2 orders on April 20th and one on June 20th. I requested replacements for my April 20th neons order, and when Mentality was prepping my replacements, they found my June 20th order. This is a direct quote from an e-mail I received from them: “In searching for your address, I found two more orders under your email address that were placed in the same time frame as the bad batch of base.”

I received a box of replacements on Saturday, and all of my April and June polishes were replaced, including the polishes from the order I made on June 20th. My experience just further supports that you were well within the affected time period!

      • V

Are the replacements safe to use? Just curious as there is a lot of speculation that it is unclear at this point if the base was the only cause of this. Since you received the replacements, I was wondering if you have tested them yet to see if they are safe?

    • http://www.themercurialmagpie.com/ The Mercurial Magpie

Thank you! I will definitely keep this around with the screenshots I’ve gathered- if anyone posts some in the comments I will leave those up as well since they’re deleting things!

  • Megan Glazer

I feel like this hole just keeps getting deeper and deeper. And in all honesty, I know that we will never know the entire “true” story about what is going on, as everything that is posted on their page appears to be skewed. I feel so badly for those who were affected by the polishes, as well as those (including me) who spend their hard earned money on something that can not be used without fear, and on something that cannot be refunded or exchanged. And in all honestly, I may even pity him a bit, in some way…he has now isolated himself, as a result of some delusions of grandeur…I would just love to know what the thought processes are behind these “updates” that are put on the page.

Oh, and “firing” bloggers without even telling them? Unbelievable. I never want to see someone fail or crash and burn; that is not the type of person that I am. But I do hope that he is able to take a long, hard look at his practices and maybe learn some humility. Maybe.

    • http://www.themercurialmagpie.com/ The Mercurial Magpie

Yeah, from the weirdness of his updates to his personal facebook page, I feel like there may be something not quite right in his head and that’s sad.

    • Susan Forest-Rode

I was thinking the same thing. We may never know what actually happened. But I’ll bet if the FDA or gov’t gets involved it might be another story. Especially if they were trying to cut corners or doing something illegal. And the “firing” thing was just too weird. I hope some investigative reporter thinks it’s a worthwhile story and write about it. I’m just too curious as to what is really to blame.

  • Meerkat

Wow, this is a really scary story. I don’t know much about indie nail polish manufacturing process, but after reading Mentality’s responses, I am getting a troubling mental picture. It looks like this manufacturer has no knowledge of cosmetic chemistry and has no resources to do any safety testing. They probably mix their nail polishes in the kitchen or garage. I am actually really shocked that such products are available to consumers…

    • http://www.themercurialmagpie.com/ The Mercurial Magpie

Most do mix in their kitchen/garage- but the base is bought premade, they are only adding pigments/micas/glitter to it. There is some indication that it’s possibly Mentality was either trying to make their own base or adding things to it, that scares me more than anything.

  • nikki w

So I got a chance to look at the updates from last night until this morning and the one about the bloggers getting removed struck a nerve with me. What bothered me was the fact that they flat out said they knew their polish had a known issue as far back as September, and not only that but also that it possibly and most likely included any 5 free or gloss polishes. I purchased sexy back in March of this year and on the top of the handle it says GLOSS. I haven’t used it but I am highly thinking about filing a claim as I am still in Paypal’s allowable time frame to file. My only issue is they say they are only honoring april-june but since I took screen shots I will include them if I file a claim. Lastly what bothers me is they said without actually saying that rude comments will not be issued refunds which I think is a load of bull! Grant it, the cost was only $7.50 but I deserve a refund for that!

    • http://www.themercurialmagpie.com/ The Mercurial Magpie

Definitely get that $7.50 back! It seems like Paypal is aware of what’s going on and is processing refunds.

  • Ricky Cole

      Ha! Perfect.

  • Anna He

Hello! Me again! I just wanted to thank you so much for updating your post as thing unfold. Your dedication as a blogger can be seen not only in this post but so many of your other ones as well! I recently did some googling and found a discussion thread about this issue on a chemistry forum. One of the answerers suggested that we consult Doug Schoon. He’s a chemist that specializes in cosmetics, particularly nail polish. We can submit our questions at http://www.schoonscientific.com/contact-Schoon-Scientific.html Hopefully, he’ll be willing to help us figure out what’s going on.

    • http://www.themercurialmagpie.com/ The Mercurial Magpie

Awww, thank you so much Anna!! I hope someone can contact him- I’ve been swamped keeping up with this situation + work or I’d do it myself!

  • Ftloosenfanzfree

I’m currently very intrigued by this now-deleted thread on their Facebook. (Well, the whole thread wasn’t deleted, just all comments posted by Mike who was making very helpful science-based comments.)

    • Anna He

Same here. Do you know where I can find the rest of his comments? Has anybody screenshotted them? I didn’t get a chance to see them before they were deleted.

      • katierose295

I didn’t screen shot his comments, but he was basically calling BS on their claims and I guess they didn’t like it. In their world, it’s probably “bullying” when smart people see through your lies.

      • http://www.themercurialmagpie.com/ The Mercurial Magpie

Someone sent me another reply of his which I just added to the post- not sure if he’d responded more than that, though.

    • http://www.themercurialmagpie.com/ The Mercurial Magpie

      Very interesting!

  • murella

It looks like base contains a big amount of formaldehyde, much more than in treatments like Trind. There is one russian speaking blogger from polishaholics livejournal community said she had pain in her nails when used this polish and it’s also same to formaldehyde contains.

I think this polish needed in lab checking for formaldehyde concentration.

    • http://www.themercurialmagpie.com/ The Mercurial Magpie

I wouldn’t be surprised if that was a factor!

  • Starfish Nails

This is probably the biggest and most in depth and informative post regarding this whole debacle, and for that I thank you. I’ll be sharing this on my social media pages so everyone who hasn’t picked up on it, is aware of the situation.

Every time they post they just dig their own grave deeper and deeper…

  • Ftloosenfanzfree

I didn’t really process it until a little while after I saw it but I feel like they are unintentionally admitting to gross negligence with this comment they posted on their own page. What I am taking away from this comment is:

    1) The reason the timeline they are giving of affected polishes is April-June is because
    2) They had already changed to a different base in June
    3) Which they specifically did *because* of bloggers bringing this issue to their attention, but
    4) They did not bring the issue to the attention of the people who bought the product!!!

This is pretty damning to me.

    • http://www.themercurialmagpie.com/ The Mercurial Magpie

Oh yeah, they are all over the place with their ‘excuses’ :(

  • FeyonaT

First of all, thank you for an extensive work you did writing and updating this post. I am new to nail polish world, but I am felling in love more and more and started looking at indie polishes also reading about making and thinking is it safe to make and sell. I had a lot of questions like is it safe to sell the product made in the kitchen since when it’s a start up, there is no way that somebody will create a lab for this. Also I was thinking what if anybody gets a reaction, will it lead to any ramifications for the seller/manufacturer? And now I see that no customer is protected. I am disappointed, frustrated and completely discouraged from buying indie polishes. Because naturally I have thin, flexible flare shape nails with short nail bed, and I work hard on lengthening the nail bed and making them stronger. And believe me I do not want to screw my naturally vulnerable nails up! So thank you for this eyes-opening post.

P.s. Sorry if there are any hiccups in my comment, my English is getting rusty from non-speaking to native speakers, even though I live in USA.

    • http://www.themercurialmagpie.com/ The Mercurial Magpie

Thank you! Your english is great :) I know how you feel- truthfully, before this situation I was never worried about indie polish because unlike other indie makeup it seemed safer. Eyeshadows go near your eyes, indie lipsticks could be potentially ingested, etc. So I definitely feel a bit more wary but at the same time- I know that there are so many great brands that IF this happened to them, they would have notified customers immediately and taken care of things properly. I also think that it’s highly possible Mentality was doing something to their base and that is out of the norm for indie brands.

  • http://nataliaalexandrov.wordpress.com Natalia Alexandrov

I just wanted to say that, until recently, I lived in California and manufactured nail polish. I met and spoke with Nubar on MULTIPLE occasions (Nubar/Arminex). At one point we had discussed creating a custom base because the one he was supplying me was not thick enough for what I needed. He manufactures his own base, and supplies it to actual global nail polish brands. I can assure you that if his base were the problem, we would be hearing about it on a global scale.

He does have some issues with his base, which was the reason I discontinued my business with him, (he used cheaper ingredients to raise his profit and it showed, because the glitter did not suspend at all and separated almost immediately) but it was most definitely not due to any health concerns. I feel very inclined to believe that Mentality has been experimenting with their own base.

I know other brands that have done it, and they do it well (Nail Pattern Boldness for example) and it’s actually shockingly easy to find the “recipe” on chemist forums. But if they are doing it without the proper lab and paperwork, they are breaking the law, which is why I think they are so eager to throw Arminex’s name out there as often as they can. (when else have you ever heard of a nail polish brand being so eager to disclose their source?)

    • Susan Forest-Rode

I was actually wondering the same thing after reading the comments from the woman who used to work at Nubar and her husband, who’s a chemist. I think there is much more to this story and this company is in a world of trouble.

    • http://www.themercurialmagpie.com/ The Mercurial Magpie

I totally agree with everything you said! I wish some real proof of it would come out but I verrrrrry heavily suspect they were trying to manufacture their own base or adding something to it at the very least.

  • Susan Forest-Rode

Thank you so much for posting such a detailed and informative page on this situation. I have not used their polish but heard about this on another indie polish FB page. The photos of the damaged nails are truly horrifying. It seems to me that the owners were trying to cut corners and relaxed their quality controls or else completely abandoned them. They have little business sense it sounds like and I imagine they won’t be in business too much longer. They way they’ve handled things is not just bad business but is scary as hell for those who have actually used the product and experienced problems with it. I follow you and several other bloggers to get ideas and see photos of new polishes. This is also how I find out about unique polishes and where to get them. I cannot imagine that any nail blogger would not inform her readership of any issues with a polish, if she knew about it. I have just started buying more polishes from indie brands as they catch my eye but mainly from one in particular who has a very good reputation and is very open about how she makes her products. This has not soured me on trying new indie brands just makes me a little more cautious and wanting to know more about the people behind the products before buying. Thank you again for having such a wonderful blog and getting information out there.

    • http://www.themercurialmagpie.com/ The Mercurial Magpie

Yeah, it makes me sad that the blogger/swatcher who knew stayed silent until this all started coming out in the past few days. I definitely feel a little more cautious about what I’m buying now as well. Thank you for your comment!

Jezebel had a big article on this today and you are mentioned: http://jezebel.com/customers-complain-that-mentality-polish-is-seriously-f-1726174682

    • http://www.themercurialmagpie.com/ The Mercurial Magpie

Wow! This info is really spreading! Thanks for letting me know!

      • Aline

I’ve seen so many companies either completely ruined or damaged because of the arrogance of their owner, such as Lime Crime losing Sephora, and Bondi imploding. I don’t know why it’s so hard to apologize and offer some sort of compensation. Eventually, someone’s going to have their polish analyzed and the truth will come out. If they were blaming this on their supplier when they knew it was their fault, their opening themselves up to a lawsuit. The truth always comes out in these situations.

  • http://fixintofaff.blogspot.co.uk/ Fixin To Faff

Hey Chica! Lookin good from the pages of jezebel! LOL. I have touched my blog in weeks buy I guess I need to dust off the laptop and go take down the very few MNP posts I’ve done, though I don’t think I have affected bottles, because I can’t stand the thought of supporting the company with such a nut job at the helm. I’m going to make a prediction that MNP closes up shop soon, and sone time shortly thereafter we’ll see a new indie pop up on the scene with no ownership disclosure. 😉

Isis sends Mugen some face bites, BTW!

Yes! I was really surprised by that since like the only 2 people publicly supporting them were their bloggers lol

mentality goes from “I AM AN INDIE POLISH GOD AND I HAVE NO TIME FOR YOUR PUNY WHIMS” to “guys i’m broke as hell because you all want your money back and i’m just a passionate indie polish designer, stop asking for your money back a bloo bloo bloo”
