Yeah, but you're forgetting something. A lot of the people caught up in the criminal justice system are blacks and other such minorities. Which means that they are obvious criminals who deserve less rights than the rest of us upstanding citizens.

How do we know they're criminals? Well, the police officers and institutions tell us that they're criminals. If they weren't criminals they wouldn't have a criminal record. If they weren't criminals they wouldn't interact with cops as much. And of course they're breaking the law, even if they say they're innocent. It's not like cops would lie about such things in a way that would skew statistics much.

Judges base sentences on many factors. This includes disincentivising an action for the public (don't do this or you'll get this sentence, people!), punishment (you're a bad boy, take this), and criminal history (you've done this three times before, so you get more of this).

They all fit within a table of sentencing guidelines for particular crimes and sentences, so there's limited leeway in a sentence to be handed down.

There is no official "I want to see you suffer so take this" section of sentencing that I know of, separate of punitive sentencing.

A couple years ago a law grad explained this to me because we were doing some debate about crime and punishment at my uni debating club. Basically punishing someone for a crime is for:

  • vengeance for the victim (don't think they actually used the word vengeance but that's the concept)
  • rehabilitation of the criminal
  • the public's safety
  • reimbursement for the victim
  • deterrence against others committing the same crime

The justice system has to balance these 5 factors when deciding what punishment fits what crime. So the answer to "justice or vengeance" is essentially "yes".

ALTHOUGH this is for Australian courts, but I'm sure it's similar in the US.

So what are the details of each charge? I caught the last bit on the radio and the last one they said was paying for sex from a 17 yo. Struck me as odd cause typically when we hear about child porn charges it's for atrocities to like 7 yo or something.
