It was never going to be homicide, the guy had already assaulted him and was closing aggressively, the host had every legal right to defend himself and he did so with a reasonable amount of force to protect himself.

Comedy clubs seem to have a terrible reputation for handling these types of things properly. At least that is the impression I get from listening to a bunch of podcasts with stand ups telling road stories.

It isn't a reasonable defense for Rade (the guy that got kicked), but it completely gets rid of all hopes of self defense for the host. He goaded the guy after the situation was basically over. Then leveled him with a kick before the guy even touched him.

Both guys are in the wrong and the host could be charged with assault and incitement (in some jurisdictions).

I would argue that the host's statements could be considered fighting words. The situation had cooled off and instead of proceeding with the show he continued to verbally attack Rade. Rade had already shown he would get physical (he had previously pushed the host) so the host could reasonably expect Rade to get physical again. The host then loses the ability to claim self defense since he was the inciting reason for Rade to approach him and get kicked.

Besides that, I'm not saying Rade didn't deserve to get kicked. He seems like a giant double who had it coming for awhile. I'm just saying that the host has no legal defense and is actually in the wrong. "I'm a comedian" is not a legal defense to assault & battery.

The guy was already beaten, he retreated to the back of the room. If the host want to own it he could have made an off handed remark about the situation that wasn't directed at anyone in particular. Instead he directly engaged someone who he already knew to be violent.

Torts was a while ago so take this with a grain of salt, but the comedians duty to retreat was nullified in that he had no where to go to get away from the heckler the second time around. He'd likely argue that he had a reasonable fear of bodily harm, and defended against such. His argument for self defense wasn't nullified, but it was definitely weakened when he got physical first. The heckler is likely the argue that he wasn't about to harm or touch the comedian in an offensive way, and then we just let the fact finder (jury) sort out who they believe.

The comedian continuing to "verbally attack" Rade isn't legally construed as an escalation of the current situation according to the common law I can recall on a situation "cooling", which IIRC generally requires a "reasonable amount of time" to have transpired (as determined by a jury) for a situation to have cooled. It could be easily argued the comedian continuing to yell at Rade was a part of the initial altercation.

The video starts with the heckler saying "stop making fun of me, stop talking about my mom." The only evidence in this is the comedian likely atagonizing the heckler

The audience member should not have been aggressive but if he is a serial heckler the club has some of the responsibility to address that.

I think you misunderstood me. I said heckling alone isn't enough to be assaulted. I also don't see the audience member initiate the heckling, just upset and asking the comedian not to make fun of him.

The comedian should have moved on after the audience member went back to his seat but he didn't, he kept agitating the already upset audience member. At that point the audience member showed physical aggression and was dealt with. There was plenty of opportunity for cooler heads to prevail. Someone with the club showed have interjected.

The video doesn't really show the comedian being heckled. The audience member says "start the show and stop making fun of me." and "stop talking about my (mom?)" Then the comedian continues it after he goes to his seat with "I'm a sixty-year-old baby."

Keep in mind I watched the video.

I usually love to see dumb-asses get what they deserve but here I feel that the host is in the wrong. He backed down the aggressor and then taunted him. That is a stupid idea in and of itself. Not to mention the gut-kick could do serious damage. He should have just used the mic stand as a range separator.
