Wouldn't matter if Kane didn't know, even if he met her at a bar. Statutory rape is a strict liability crime in almost all jurisdictions, including NY state. Basically what that means is there is no intent or knowledge element to the crime. All that is required is for a person to have sex with someone underage. That's it. Doesn't matter if the victim lies about their age. If Kane had sex with her, and she's under 17 (the age for statutory rape in NY state), Kane is guilty of statutory rape (which is why strict liability crimes are terrible, no room for subtlety in the enforcement).

A handful of people may misinterpret the meaning of "turn himself in" in this situation. If charges are filed, then obviously he would turn himself in to the police ASAP, he would be booked and processed into the jail, then questioned.

If he were to "turn himself in" prior to charges being filed, all that means is that he walks into the police station and begins to cooperate with the investigation. He can answer questions prior to charges being filed, and may save himself some trouble if he does so - all at his lawyer's discretion, of course.

The point of prison should be rehabilitation not entirely punishment, even for heinous crimes like rape and murder. If he is actually convicted he should serve his 8 years (is it eight in the U.S.? Whatever the penalty is) and be allowed to return to the NHL if he still has the ability.

Although Kane would just exit prison to a bank account of millions of dollars and this doesnt necessary apply to him, the principle stands that continuing to socially punish criminals after they've served their sentence is what creates prison lifers and a system in which criminals can't be rehabilitated or returned to the work force.

As a fan I would hate to have a convicted rapist on a team I support. I would be comfortable having my taxes done or my groceries scanned by a rehabilitated felon but I wouldn't want them being my doctor or babysitting my kids. Some doors close to you after committing a crime and it's up to society to deem which doors they are. I also wouldn't want to wear the same jersey as him and cheer on while he was on the ice. I get emotionally invested in a team and wouldn't want that with a rapist. Especially as, other than serving their time, you have very little idea of how much they have changed.

A high profile case, a rich defendant, if you wanted to lie and force someone to settle with an amount that sets you up for life, this is how you do it. Again, not saying she wasn't raped, or that any rape claim is just a chance to get rich, but if it was, then this is how you would do it. Those cases make it more difficult to prosecute for real rapes, however, because arguments like the one I just gave will always come up. I feel like a total fucking tool for even mentioning it. She doesn't deserve my questioning the legitimacy of her claim.

Again, I know nothing about this case, and it doesn't seem fishy, but it would be a situation in which dubious evidence could point to an accusation that is not entirely grounded in reality. God I'm an asshole.

It is scary to think of the Blackhawks maybe not having the Kane and Toews duo that is supposed to keep the dynasty going for the next 8 or so years. After watching Kane since he joined the team I have been one of his biggest supporters. If he is found guilty there is no way he will ever play again and all that history is going to be tainted. Should be noted that in some jurisdictions involving Rape/Sexual Assault cases, the victim has no say in charges being pressed. Once the police is called, the investigation reports are given to the prosecutor/DA who decides whether or not charges will be filed. So basically, even if the victim changes her mind or doesn't want charges filed it's out of her hands. Prosecutors have a very broad discretion in this; There are no legislative or judicial guidelines about charging. Given Kane's previous history, and celebrity, I wouldn't be surprised if a prosecutor decides to file charges.

Also, there are reports of this occurring after a night at a bar. If alcohol was actually involved, the whole "consent" issue comes into play; was the girl too drunk to give her consent to have sex.

Say that this does turn out to be true, and he is convicted, and the league suspends him indefinitely. What does this mean for the Blackhawks? Will they get some type of compensation? A draft pick, extra player protection in an upcoming expansion draft? How will that Hawks fill the gap?

What does this mean for Kane? Does he have the opportunity to appeal a suspension? Will he lose all of the money promised to him in his contract? What will he do after prison? Go play in another league?

at this point, pkane doesn't have the benefit of doubt in my mind. he has a history of violence, rumored violence against women, and makes super shitty decisions while drunk. rape is an ugly charge, and it's so hard to see through for many reasons, including people assuming you're lying, pressure from all sides to just shut up and take money to "make up for it", and the embarrassment of showing how vulnerable you are. if he's charged, I sincerely hope the NHL and whole fanbase take this seriously and don't try to brush it off. love the hockey he plays, hate the person he seems to be.

Heard a lot of statutory talk going on, so I just thought I'd clear something up. Age of consent in NY is 17. There are some laws about people younger than that giving consent but it only applies when the other person is under 21. So for Kane the girl would have to be 17 or older.

Rape kits are not pregnancy tests that have positive or negative results. The medical procedure does test for semen but also checks for DNA from other sources. Also checked are injuries, bruises, etc. Pictures are taken as well. The patient is offered the chance to speak to an advocate and (I believe this is across the board) offered the "morning after pill" if he/she wants it.

Rape kits most commonly occur at the very beginning of an investigation, or prior to law enforcement even being notified of the complaint.

In United States law, the term Glomar response (aka Glomarization or Glomar denial) refers to a "neither confirm nor deny" response to a Freedom of Information Act (FOIA) request. There are two types of instances in which a Glomarization has been used. The first is in a national security context, where to deny a request on security grounds would provide information that the documents or programs which the requester is seeking indeed exist. Glomarization is also used in the case of privacy, in which a response as to whether or not a person is or is not mentioned in law enforcement files may have a stigmatizing connotation.

Lower courts have thus far ruled the Glomar response to have potential merit if the secretive nature of the material truly requires it, and only if the agency provides "as much information as possible" to justify its claim. Otherwise, the principles established in FOIA may trump claims to secrecy.

The Glomar Explorer was a large salvage vessel built by the Central Intelligence Agency (CIA) for its covert "Project Azorian"—an attempted salvaging of a sunken Soviet submarine.
