I drank a 500ml can of coke at work once. My boss thought it was a beer can from a distance, cause it's a taller can usually used for beer.

What he did though, was just walk closer to the object and read the can. Then he said "Oh, I though that was a can of beer for a minute." I reckon your boss overreacted.

Ah yes, the rational approach

I see you've played Spritey Cokey before.

approach

I see what you did there

I...don't.

My dad's mom insists on drinking caffeine free diet sodas. He bought her the generic Sam's Choice ones from Wal-Mart once, which have a brown tint to the can. And she insisted on 24-packs and wanted like 5 cases of them. So he's pushing around a cart with all these Caffeine-free diet sodas in Wal-Mart and a woman from our church walks by and asks, "Who's going to drink all that BEER?" [My dad doesn't drink, btw]

She apologized later. "Even if I thought it, I shouldn't have said that." So glad we don't attend that church anymore.

Caffeine free diet soda has to be the polar opposite to beer. Mormon church?

Go Agnostic drink Dr. Pepper

what do atheists drink?

Whatever the hell we want to. We can drink a little root beer one day, a little cherry coke the next, hell, we can even have a mello yellow if we are feeling a little screwed in the brain, but in the end all that matters is that there is some alcohol poured into each of those cans after the first sip!

You remind me of my friend. He pours vodka into his soda especially yello mello whenever he gets the chance

I prefer Dos Equis.

Way better than Mr. Pibb. That dude didn't even get his degree.

Independent Fundamental Baptist, If I had to guess. I grew up as one and was raised that alcohol turns you into a wife-beater and/or murderer 100% of the time. I knew a bunch of people who refused to eat at Outback Steakhouse because "It feels too much like a bar and I don't want to ruin my testimony."

But Jesus drank wine? How do they even take communion?

This really isn't the place for religious debate, but something to consider:

In the days of Rome and Jesus, people really couldn't purify water. That is, unless you want to turn it into alcohol. It happens that alcohol is a lot more sanitary then the water of the time. Now that we can purify water to the extent we can now, it's the better option.

in beer there is strength, in wine there is wisdom, in water there is parasites

Everywhere is the place for a religious debate. Regardless, it was a valid question.

How dare she make a stupid statement and apologize for it later! The nerve of some people. I can definitely understand not wanting to be around people who would apologize for mistakes they make... /s

How dare she make a stupid statement

And yet if it was beer she would have gone home and almost had an orgasm over her righteous indignation. People like that are shitty people, even if they apologize later. Nice people would just keep their yap shut.

Maybe, but you aren't in her head. Everyone does things from time to time that they aren't proud of. Once someone has apologized (especially for something as benign as this), you are an asshole if you continue to hold a grudge.

Seriously overreacting. I drink Ale-8-one (google it) in green glass bottles all the time at my desk. I have had half the company ask me if I was drinking little kings by now.

The official drink of Kentucky. Especially useful when trying to look cool when you don't drink alcohol at a party.

I drink Blenheims all the time in my car/at work/anywhere I can get my hands on it and I have been stopped and questioned about it numerous times. Shit is so good I can't put it down

I had a cop light up my truck because I got into it, greeting him because he was parked in front of me, holding a bottle of root beer.

He was like "just a second, hold on." I'm like "this is root beer." and he was like "oh." And I was like "why did you wait for me to put the keys in the car? It's still against the law to drink a beer in public." (I was drinking it in the parking lot enroute to my car).

Gotta get that DUI charge! It's about $10,000 more revenue than a puny PI charge!

Difference between public intox and DUI is probably $$.

Yes, and op asked the cop about that to show that he understood the cop's intention to make charges worse.

Your boss seems like he possesses at least the intelligence of an average, reasonable person.

OP's boss is as dumb as a box of rocks.

I brought one of those 24oz Arizona Ice Teas to work and put it on the front desk (I worked at a canoe rental). My boss came out and exclaimed, "Oh, how is that I heard they're really good!" It sounded really sarcastic but I replied that I loved them and drink them all the time. He looked completely surprised and announced that I can't actually have that on the floor. At second glance, it was a twisted tea. Whoooops! It was a super lax place and once the doors were locked he pulled out some Jack and let me have my twisted tea.

We were on holiday with another family in Fiji a couple of years ago and we were drinking ginger beers (a non-alcoholic drink but bottled in a beer styled glass bottle). One of to boys in the other family (aged about 8 or 9) was sipping one when his mum comes up and slaps it out of his hand and starts going off at him until we calm her down and tell her. I think she bought him another one.

This. The approach of a normal person. OP's boss needs some fire sauce.

I hate those kind of people. A normal person would just say, "What are you drinking?" That would avoid this entire confusion, it's like she's right out of a movie where I'd watch and say, "This would never happen because she'd just ask."

Yeah, her reaction really wasn't okay and it would make it seem like she is not a good boss or a reasonable person. You don't even think she will take you out to lunch. She probably told HR that to save face.

I guess I'm an angry person because I wouldn't enjoy being put through what OP was put through. I'd question everything that boss has done recently, what else is that boss making rash decisions about?

She just almost fired someone for drinking a soda out of the a company vending machine.

In all honesty, I'd look for another job right then and there and put in my 2 weeks as soon as possible.

Bad idea. OP got on HR's side. Never cross HR. If things go well, OP will outlast their boss.

Absolutely. She acted with -478.4 professionalism. As if approaching your employee and respecting him/her enough to see what was actually going on is so difficult. Plus, is it not standard procedure for most large companies (any large enough to have a seperate HR dept) to contact HR before making any moves towards sudden employee dismissal? Seems like her actions could have ended up resulting in her company being sued in similar circumstances.

Is OP some muscle bound ex-con working there on parole? Why is his boss so afraid of him?

HR is there to protect the company, not the employees. If HR called the boss for a meeting, I guess her actions are probably liable for a lawsuit against the company and that would put her job at risk.

[–]Physicsnerd_throwawa 482ポイント483ポイント  (2子コメント)

Sounds like your idiot boss should be here writing the TIFU, not you.

You did fine.

Since it was TIFU I was waiting for OP to claim he somehow didn't realize he was drinking a beer. He definitely wasn't the one who screwed up.

Same here. I expected that somehow a beer had been placed in the vending machine by mistake.

I don't see why your boss thought that was alcoholic.... because normally you would investigate something like that before straight up accusing someone. Jesus.

Surely you would confront the employee then and there. I mean it's like she's afraid you're going to attack her or something.

Sounds like HR fucked up too. What are they doing there just observing the firing. They are HR, they'd better be involved in validating the 'investigation'.

If someone was getting fired and our office didn't tell HR, there'd be a shitstorm.

Given the company's strictness, surprised the boss hasn't been fired. Totally unacceptable.

Yep, a lot of paperwork that goes along with a firing. Especially any company that has any sort of security badges.

Yeah, if I were OP I'd be looking for a new job now. This company sounds awful.

That's probably why she got a talking to. Imagine the liability of firing someone based on that "evidence" just to get sued for wrongful termination.

All I could think of was something like this while reading:

If I'm fired for drinking on the job, can I call the non-emergency police number before I go?

Why?

I want him to meet me outside to use a breathalyzer and give me a written statement that I haven't been drinking. I hear that kind of thing could come in handy in a wrongful termination lawsuit.

What's that from? I wonder if you could actually do that. I feel like cops wouldn't give a shit and wouldn't show up though

They wouldn't show up, so instead you would want to call your local drug/alcohol testing lab and pay out the ass to have a certified lab tech meet you with a portable breathalyzer tester.

Then walk into your local civil court in your work-at-will state and hear their lawyer snicker at you while he considers what 1k an hour expert witness he should bring in for you to pay for once they are the prevailing party...

In America, in a non-unionized work place, typically employment is "at will" which means employers can fire you for whatever reason they want barring sexual discrimination, disability, religion, race (there might be one or two other things that are protected) unless there is a contract saying otherwise.

The difference that matters is a little thing called Unemployment.

If you get fired for drinking on the job against company policy, then you walk out the door with nothing but a box with your shit in it.

If you get fired on the whim of an idiot manager because she mistook a sprite can for a beer can, then you walk out the door with a box with your shit in it, as well as a semi-weekly cheque made out to you by the state unemployment office that usually amounts to about half of your regular income for the next six months.

"At will employment" just means you can't sue the company for firing you for drinking a sprite. So you were right to shut down whoever you were replying to. But at the same time, the company is responsible for paying a share of unemployment, so it would still be a liability to have your managerial staff firing people for drinking sprites.

At quick glance it looks like a rolling rock can.

I see why your boss thought that was an alcoholic drink.

She still should have come up and asked first. Even if it's the "are you seriously drinking a beer at work?" He could have still responded before they tried to remove him from the building.

That's what's so annoying about this and a lot of TIFU stories that happened at work. People immediately jump to conclusions and assume the worst without asking a single question. Like the story awhile ago where the guy got fired because he went under his desk to plug something into a socket and the girl that sits across from him immediately assumed he was down there trying to get a peak at her goods. A simple "What do you think you're doing!?" would have saved him from losing his job. Shit like that pisses me off.

They watched Office Space and got out their jump to conclusions mat. Where you literally jump to a conclusion.

I see it too, but instead of just firing him on the spot why not ask "what are you drinking?" like a normal person.

What the fuck does that phrase even mean anyway?

It's a perfectly cromulent phrase.

Does that really say "living longevity to the destiny"?

It's like a shitty random phrase generator.

edit Oh, it's rap lyrics: http://genius.com/175913/Nas-if-i-ruled-the-world/Strictly-living-longevity-to-the-destiny

I don't see why she thought that. There is nothing on the label that would indicate beer or any other alcohol.

If she was thrown off by the font, Op should have explained that letters, when used in conjunction with one another, form words that can be used to covey concise ideas.

he could have explained that the next time she is confronted by a mass of letters in suggestive font that confuse her, she should then resort to putting the letters into some kind of a contextualized format (like words, for instance) and see if she can derive more concrete information that way.

What I'm really trying to say here is that, if I had been in OP's position, I would have gotten fired anyway even after it was proven that what I had was a soda.

I see the point of confusion, though definitely your boss could have handled it better. Once I had a supervisor at work talk to me in confusion because he mistook my L&P for a beer.

All it would have taken is for the boss to pick up the can and look at it for a second instead of losing her mind and going to defcon 1. Shitty boss is shitty.

But how? It's world famous (in New Zealand).

I showed him that and he just walked away in confusion.

Your mission, should you choose to accept it, is to find a new way each week to simulate drinking an alcoholic beverage.

Well tomorrow will be cream soda in a corona bottle

[–]mouse_fitzgerald222 37ポイント38ポイント  (34子コメント)

What beer can looks like that? I wouldn't have thought of a beer when I saw that.

Rolling Rock.

Obviously it wasn't Rolling Rock if OP was willingly consuming it.

There are a heck of a lot more canned beers than sodas, so it's not unrealistic for someone to think "unrecognized canned beverage, not soda (because it's easy to recognize soda cans), must be beer".

Whoever in charge of can design at Sprite was probably drinking a beer while designing this.

What the fuck. When did sprite change their can design? (It looks hideous)

edit: It's a good thing they didn't fire you. That would have been a REALLY EMBARRASSING wrongful termination lawsuit for them.

That would have been a REALLY EMBARRASSING wrongful termination lawsuit for them.

If that was a thing, then yes. If he's at will, in almost all states you can be fired for anything that isn't protected (e.g., being Jewish is protected). Both drinking soda and beer as well as a mistake are all legal reasons. In most places she could walk in and say, you've got a unicorn horn, you're fired! That's what at will is.

They could be sued for providing the soda, though, since it was an on-premises vending machine.

that DOES look very much like a beer can.

[–]the_bearded_wonder 42ポイント43ポイント  (18子コメント)

It does, and it's not alone. Seagram's ginger ale would have probably gotten a similar reaction and maybe Schweppe's too. And, God forbid if he were drinking ginger beer!

I was at a Carl's Jr connected to a gas station late at night and some lady was having her mind blown by the new Coca-Cola Freestyle machine that an employee had just updated. When she saw the Seagram's logo she said "WOAH, IT HAS ALCOHOL TOO?"

... late-night gas station Carl's Jr customers are not the brightest bunch, I guess

I saw a customer try to use the Freestyle machine at a Burger King. The guy took like 15 minutes trying to get soda but got ice instead. And he kept doing the same thing over and over.

To be fair, I don't think I've ever seen somebody drink a ginger beer that didn't have vodka in it. God damn I love Moscow Mules.

SEE, IT SAYS BEER RIGHT ON THE CAN!!!!!

Now your fired for using reddit when you should be working. Good job!

Shit man. Whoever let that design thru has probably already been fired.

(•_•) ... I guess you could say

( •_•)>⌐■-■ .... OP almost got

......

(⌐■_■) Canned

Wow. Your boss is an absolute fucking moron.

Good lord yes, the fact that people like this manage other people and somehow got to the position they are in is why I fucking hate the corporate world so much.

I have worked with all sorts of awesome people that I have stayed friends with but there is always someone like this who fucks up the entire work place.

Does OP mention where they work and how this jackass became a manager?

I have to wonder, in what kind of wacky world does this boss live?

It's as if she finally caught someone doing something she thinks everyone is doing all along. I mean, wouldn't even one question be in order? Does she think so little of you that she thinks you wouldn't have the sense to hide your drinking at work?

I honestly can't imagine what would cause a person's first reaction to be to call security even if the person was drinking a PBR.

That boss is weird in a very peculiar way.

eh.. I've had that kind of boss before, Would jump on you for every little thing and writing people up like it ain't no thang.

Wasn't before long that I just said fuck it and left this toxic work environment. Wasn't long after I left that half the store's workers(3-4 baristas) straight up walked out and my manager got fired.

I think your boss did this just to Sprite you

Your boss has definitely been FANTAsizing about this moment.

She's been wanting to Dew it forever

Good thing the HR lady let you Faygo the consequences

Come in at 10:00 then lunch at noon, where do I send my resume?

Between that and then hiring a bunch of 20 year olds, and the super strange way they treated him I'd guess it was a camp or something. But then I don't think camps have "heads of HR." Sounds like a super weird place to work.

I'm guessing call center.

I'm guessing balloon factory.

At least we know it's definitely not an iPhone factory, he's too old for that.

Or just shitty scheduling. Lunch two hours in then six more without a break happens way too much.

UPDATE: My boss is planning to find someway to make this right She isn't a terrible boss

Uh, OP, hate to break it to you but yes she is. She almost fired you over a snap decision where she didn't even bother to fully process the information right in front of her - the Sprite can THAT IS SOLD IN YOUR COMPANY'S VENDING MACHINE to determine it was in fact alcohol. If you hadn't had a chance meeting with the head of HR as you were being dragged out the door you'd be out of work without even a reference.

As she told me, she has had problems with others in the past that have violated that rule and got into some pretty serious problems for not catching it.

So rather than FIX her problem of being inattentive and actually doing her job properly, she instead swings the pendulum all the way over to the other side and takes the tactic of "if you've got a drink I don't recognize I better fire you just to be sure". Again, a shitty boss.

I totally agree. The part that really got to me was when you where trying to explain it to them and they where not listening. I'm no Sherlock Homes but there are a few things that should have immediately clicked when you where talking. Beer smells nothing like sprite! And to not listen to an employee is stupid as a boss. She was wrong. Find a new job while you are working there then just leave.

Agreed. She may sound like a "nice person", but in the business world, there are a lot of people that are so worried about looking good that they do knee-jerk stuff like this to always cover their butt. They might always come in with a smile, but they won't hesitate to throw you under the bus.

Sounds like a terrible company atmosphere. I wouldn't be able to work somewhere so damn up tight.

Definitely. Sounds like they treat all their employees like replaceable cogs. I also would bet money that they're the same kind of company that gets insulted when someone leaves without giving notice, despite their shitty treatment of their people.

Messed up place to work, no questions, no rebuttal. They deserve the problems they get with this. Freaks!

Your boss is an idiot.

This is not normal. Your boss is a power hungry asshole.

Sounds like the description of any twitch/reddit mod.

More like TYFU by not allowing yourself to get wrongfully fired so you can file a lawsuit and retire young.

I was actually wondering this myself. Don't know about retiring young, but I'd imagine there could be some sort of serious consequence for the company.

Yep, don't fight it (until later in court)!

Almost all US employees are employed "at will." Meaning they can be fired for any reason given its not discriminatory. Even if their reason for the firing is not factually correct.

The tall cans of Arizona Sweet Tea get the same reaction. I've had people ask if it was a beer before, it's just easier to say yes and go on with my day.

Those are killer when you're high

I'll keep that in mind.

I won't. I'll forget in a few minutes.

Dude I'd just quit anyways. What a cunt.

Seriously I wouldn't want to work in a place where you can just be asked to leave the office by security. Screw that. I would have no appeal?, no argument?, no chance to defend myself? Just get up and go? no way i would work in a place like that.

Agreed, take a shit on her desk first, then put the Sprite can next to it, then walk out.

Seconded. Just search for a different job and then resign from here in a grand way. Catch him down talking to you and tell him that he's in violation of the company policy and you're not working for him anymore.

The new Coke bottles would do this well.

"Share a Coke with... FUCKYOU[BOSS]"

Sounds like a place where a person in power can abuse that power quite easily. If the head of HR hadn't come by for OP...

Seriously, if someone wanted a coworker he/she didn't like fired, all they'd have to do is get a real can of alcoholic beverage, plant it in that person's desk/office, tell on the boss, and boom, person is fired without a chance to explain.

Yeah dude! Just quit! Fuck your job and all that money! Quit!!

Yeah, fuck a stable job! The job market is incredibly kind to 20 year olds! You'll have a job in no time!

I thought you were going to tell me you worked at Frito-Lay (aka Pepsico) and they were busting you for drinking a Coke product. I have a friend that works there and they are fanatical about not have Coke products at the office or around company functions.

Your boss is stupid.

Don't just get lunch you idiot, get documentation and a write up of the incident. This is clearcut harassment. You'll want this for later. Don't be a scrub and go eat an awkward disgusting piece of greasy food you slob. Document! Document!

The way you describe things is completely incompatible with the idea that she is a good boss.

This is so sad. I am sitting here reading this on my phone while in my bosses office drinking a local craft beer with him laughing about this post. I mean, fuck, this is Colorado. We have people vaping weed right outside our window. Wherever you work you need to get the fuck out of there.

All the real alcoholics use those big insulated cups filled with juice and vodka.

Honestly, I would file a harassment grievance against your boss. What she did was unacceptable and embarrassing and would only happen to someone she already doesn't like. If the grievance is legitimate enough for HR to do the paper work, then it's valid. Did anyone else see this happen to you? If your boss asks why you are doing this you can tell her it's to protect your job. If you do this you will need to be looking for other jobs.

Yeah you need to get out of that job, that kind of action is completely unacceptable behavior from a person in power! Either that or I hope she gets stuck on a disciplinary or fired for her actions.

This reminds me of something that happened at my old work.

So, every other Friday, our company would go out and get like... two coolers worth of nice beer, maybe some snacks, and have a little at-work happy hour around 4:30.

These are pretty chill, most people have one or two beers. We never really had problems with people getting too drunk, though we did have a reoccurring problem of people not cleaning up after themselves.

One Friday, a whole bunch of people on my officemate's project were in his office, reviewing something. 6:00 rolled around, and those people left, but my officemate and I stayed and kept working.

After a bit, our Art Director walks in. He sees my officemate, takes a look at his desk, and asks, "___, is everything alright?"

...Just about everyone on this kid's team had left their empty on his desk. He had like eight fallen soldiers around him. Realization dawned on him, and the poor dude's eyes got so wide as he stammered out an explanation.

Luckily, our AD believed him. Not sure if anything would've happened to him if he hadn't, but you still don't want your boss's boss thinking you're getting hammered on the job.

She should have confronted you about it on the spot. She handled that badly and if you were to make a big deal of it she would probably lose her job. She owes you more than lunch.

Your boss has terrible decision making/critical thinking skills and and also just a horrible person. Calling security to escort you out like a fucking terrorist without giving you the courtesy of a rebuttal. What the fuck. You should leave, she should not be in charge of a lemonade stand much less actual people and their actual lives.

I think you fucked up by working at a place that won't let you drink...

You're 20 and you have an office??!??

The smart thing to do would be to bring the exact same can the next time, except this time it's filled with beer. See who gets the last laugh.

Maybe she should have inspected the can more closely instead of reacting.

I imagined your boss as a super large muscley germanic woman with a huge scowl and ponytails...

I thought this was just gonna say "I coulda had a V8!" smack
