            I'm not a lawyer or anything like that but I did really take an interest in my law class senior year in high school (I know, not impressive but still) and soooo many people would get assault and battery mixed up. Battery is simply unlawful physical contact while assault is carried out by threat of bodily harm coupled with an apparent, present ability to cause harm. I'm pretty sure this, if anything, would fall under battery. No way it would be a felony assault charge. I mean, you could argue that this pie prank actually did hurt the person but who knows.
