Parking meter theft (self.legaladvice)

Last night while heavily intoxicated I stole a parking meter(the ones that have a time limit and don't use money) and knocked two more over. A Witness saw me and called police and the police caught me running away with nothing on me. I was arrested for public intoxication, theft of 2nd degree, and criminal mischief 2nd degree; both class D felonies. I live in Iowa and this occurred in Iowa as well. My question is if I plead not guilty, will that work? There is no evidence that I stole the meter and the police only went with what the witness said. And if I am found guilty, what is the most likely punishment ill receive and would I be able to lower the felonies to misdemeanors or reach a plead deal? This is my first offense.

Witness testimony is evidence. And you have no evidence to refute it, as you can't claim you didn't do it.

You are always free to plead not guilty. If you do so, you'd be smart to hire an attorney to help you formulate a defense.

A witness identification and testimony is evidence. If I hit you with a baseball bat then burn the bat and the police catch me with no evidence other than your word, am I free to go?

The fact that you were drunk, the fact that you were running away, and the fact that a witness identified you as the person who was stealing it is all evidence, and I'm sure they have more.
