"Vicious" dog complaint (self.legaladvice)

My roommate and I live in California. On Tuesday, she opened the front door of our apartment and her 20 pound Bichon ran out and nipped at a man's pant leg. According to my roommate, there was no contact made. The man then proceeded to yell and swear at my roommate and called Animal Control. Animal Control said since no skin was broken, there was nothing they would do.

The man (also a resident at the apartment complex), then went to apartment management and complained. The apartment complex is now requiring that the dog be removed.

This man is being unreasonable, but it's a he said/she said situation. Obviously, she does not want to give up her dog. What advice can you give me, Reddit?

Also, the dog is NOT vicious.

Her dog went after someone and was not being controlled properly. Thankfully it wasn't a small child.

Remove the dog, work out breaking the lease, or be evicted.

Yep. Landlords are extra-cautious about stuff like this because they can be held liable if they're aware that a dog is out of control and do nothing about it. They're looking to lose big if that dog hurts someone in the future. OP's friend's belief that the dog is harmless is a little ridiculous under the circumstances—even if the dog doesn't bite, someone could injure themselves running from the dog, or it could cause a car accident. (Both of these things have been the subject of more than one lawsuit.)

I do wonder if OP's friend has a small chance to work it out with the management. If she's calm and reasonable, it's possible that they might respond to an offer to, say, keep the dog on a leash every time it's outside the apartment. But that possibility seems a bit remote given the potential liability.
