Criminal LawHelp with police harassment. PLEASE HELP! Clearwater, FL (self.legaladvice)

Question about what I feel to definitely feel to be police harassment. I have lived nextdoor to officer friendly for about 3 years now. We have never gotten along mainly because he judges me because im covered in tattoos. He has randomly stopped me and tried to frisk me over 50 times. He has also arrested me on four different occasions, fucking FOUR. Each time it was for something completely fabricated or just all together bullshit. Everything he has ever arrested me for was dropped by the state, none of them ever even made it to a court. Anyway for about a month or two after his most recent arrest was dropped he didn't really mess with me. I was so happy.I guessed that maybe something was said to him about all the BS arrests and was maybe told to back up off me. I was wrong. For a few days now he has been back at it. Following me around, fucking with me, watching every move I make, just straight up harassing me. Today he crossed the line. A few friends and myself went out to the beach for the morning. Around noon/one we decided to leave. They were driving to drop me and my fiancee off. We turned on to my street and drove past him. He immediately turned around and started following us. When we got to my place he flew up next to us screaming at me to get on the ground and everyone out of the car. He made up some bullshit about it looking like a drug deal (I have never been arrested for anything drug related in my life) and started searching everyone and the car for no reason. After all this bullshit he left. Not even an hour later im walking back from the store and he stops me wanting to search me. I am SICK of it. Im on probation for a driving on suspended charge and the smallest thing can put me in jail. Im sick of my friends being scared to come pick me up because he pulls over anyone he sees me with. Im sick of being scared to walk to the store for a damn soda. What can I do?! Can I file a restraining order against him? I dont know what to do anymore and its very unsettling... I dont wanna try and do something and have it backfire and him end upI harassing me more if thats even possible. Help!

Look man, I'm not saying his behavior is okay, but...I took a look at your posting history. You may not have ever been arrested for anything drug related, but have you been arrested for other things when drugs were also possibly involved? Is it possible that even lacking any related arrests, the cops think that you and/or your friends might be users/dealers? These things could matter, and you didn't set yourself up to get the best possible advice here by omitting your involvement with drugs.

Holy crap nuggets, what doof discusses meet ups and dope corners, dark markets and even dealing... and all that other shit on his permanent Reddit account....then acts like 'woe is me!' when he has a legit LE all up his ass.......I am pulling my advice about cameras. He is being an idiot, and being treated accordingly.

I have nothing against people that occasionally use, responsibly, carefully, privately......this guys history goes way beyond that.

I mean, OP is on felony probation for DWLSR and apparently gets himself clean for a week every month before his drug tests, despite a $400 a day drug habit when combined with his fiancee. So yeah, I'm thinking the cops are pretty damn aware of his drug involvement.

Complain to his superiors. Document, document, document. If he's truly had four charges on you dropped due to lack of evidence, then this should be pretty easy.

If that doesn't work, look into talking to your local FBI office, the local prosecutor, or the county or state.

He will definitely hear about it. They aren't going to discipline him solely based on your word without talking to him first.

It might get worse. That's a chance you have to take. I doubt it will get better without action on your part. Your call.

Get a camera for your car, home, and person. Notify him immediately, every time, that you are recording the situation, and plan on filing a complaint with Internal Affairs if the harassment continues. EDIT: forget this advice. OP, your history is a clear indication of why LE is all up in your ass.

The "by the book" answer is that you're unlikely to get any kind of restraining order against him. If you feel he is harrasing you, your best bet will be to speak to Internal Affairs or the supervisor at the station. But be prepared for this to accomplish nothing, or even increase the scrutiny from other officers instead.

Your best option is to move. Failing that, eventually he will escalate things to a point where you can bring a civil rights lawsuit against the city. They're only going to put pressure on him to stop when the city has to write a big check. So make sure to keep a detailed and impartial log of every interaction you have with him, even if it's just him saying good morning. When you feel like you have enough proof, take it to a local civil rights lawyer.

You might want to look into a civil rights attorney to sue the officer and the department for violations of your constitutional rights. If the facts are not exaggerated, I cannot imagine 50 stop and frisks and four tossed arrests withstanding scrutiny.
