My uncle did geneology and traced some of our ancestors back to pirates, some of which even have our last name. I'm still waiting for some pirate booty.

I'll take my share in Spanish doubloons.

While there are maritime laws and procedures that have influence here, let's play the "descendant" game. There are a lot of people who might claim some of the treasure, including the descendants of the people who Kidd, a pirate who was eventually executed in 1701, stole the treasure from. The descendants of the crew member he murdered might want to claim something, too, for wrongful death. As well as the descendants of the crew members he tortured.

To put it more simply, if I rob a bank and then die, do my great-great-great grandchildren get the cash if it's discovered centuries later?

Just curious - it looks like Kidd was issued a Letter of Marque authorizing him to take French ships. Would decedents have any claim to treasure taken under that method (ie as a privateer vs as a pirate)?

They just recently found William Kidd's treasure and my friend happens to be his direct descendant. Does he have a case to get some of that gold?
