Yes. But if McDonald's can prove that this location is ADA compliant, you will lose.

You have suffered no loss, despite not liking onions. If you're pissed off enough, you can sue for the amount of the bungled meal, but that's pretty much the value of your "loss" (quotes because you still received food).

Patronize another restaurant, McDonald's or otherwise, if this one is so bad. They're all over the state.

The issue is that they are closest to my house and with my chronic injury I don't have the luxury to go to any other Mcdonalds. What about the onions? This happens EVERY SINGLE DAY. If I was allergic, I'd be dead by now. Surely something can be done to make sure they aren't serving hazardous materials.

Well I don't eat weekends there as I have off work and have time to drive to Subway and step out of the car. But weekdays I have to work and this is the best option. Besides I usually keep the order small like a double cheeseburger or two and only sometimes fries. I always drink water.

No but as I stated, they're the closest restaurant. And with my disability it makes it difficult to step out of my car. So I need somewhere with a drive thru.

You haven't been harmed by the onions. You may not like them, but they're not harming you. If they were, then you'd have gone to the hospital. Barring that, you've got nothing.

If you have to "go inside" to correct the order, the logical implication is that you're driving there. You do have the luxury of driving somewhere else. If your "chronic injury" allows you to drive there, it allows you to drive elsewhere too. Otherwise you wouldn't be allowed to drive anywhere.

My injury doesn't really allow me to walk into a restaurant without sever anguish, which is why I use the drive thru. I live in a Podunk town with only one drive thru. MCDONALDS!

At any rate, if you actually were allergic, and you still proceeded to eat something containing what you were allergic to, then that is 100% on you as well. Onions aren't exactly discreet by any stretch of the imagination.

No offense, but I don't give a hoot. Find another fast food joint if this one fucks up your order every day. If you don't want to do that, and you can't physically shop for groceries, get one of those grocery delivery things once a week, all the ingredients for burgers and fries, and have at it.

You know, when it comes to legal things there are very rarely any absolute answers, but I'm 100% confident this is a case where you have absolutely zero legal recourse for them serving you an incorrect order.

Next time you get your order, take some of Leo Getz' advice...check the bag, if its incorrect send it back through the window before you drive away. It's shockingly simple to do. Try it next time. I have faith in you. =)

This reminds me of the time I saw a woman throw a fit over being served a burger on a bun because she's "gluten free", and then proceeded to order fries.

If you are allergic to common food items, it's probably best to eat only in places where you can guarantee there is no cross contamination. A fast food restaurant (most restaurants, really) is not that kind of place.

Would you say that to someone allergic to peanuts? This isn't some fad diet. I really don't like onions. They make my breath stink. I work nights so I eat at McDonalds before work and I need to keep my appearances for my job. Part of this is not having smelly breath. It really is getting out of hand.

Yes. It's not a restaurant's responsibility to account for people having allergies to common food items.

Yes. You can file a suit first thing Monday. You will lose rather quickly, but the judge will be amused. So that's good, I guess.

That is the actual advice given to people with severe food allergies. Don't eat at places where you can't confirm that the food isn't free of the allergen.

You are not allergic to peanuts. You are not allergic to onions. Buy some mints or gum for use after eating at McDonald's or find a better place.
