Enough people saw that promo that it is a big deal. Especially because he did it to another artist. It's selfish and egotistical of him to think that he can just do that. And anyway, the point is not how many people saw it, but the fact that he did it at all and the only reason it even became a story was his completely inappropriate reaction when he was called out by the original artist.

Maybe he thought it was like sampling other people's music for a beat, but visual arts and marketing/advertising are a completely different ballpark. (source: I work in visual arts and advertising/marketing)

I work in advertising, too. Big deal. Visual arts is not a completely different ballpark at all. Do you get clearance from the creator every time you post a gif? Have you never downloaded a film? The hypocrisy is palpable.

also the artist who made it probably got just as much exposure as diplo's cause

This argument is always made when people complain about their creative content being stolen. I work as a photographer, if I took every job where the person said "it'd be good for exposure" I would have never made any money. Doing things "for exposure" only works for a brief period of time so you can build a portfolio, after that it's completely unreasonable to take a job without some sort of compensation.

He used that gif for commercial reasons without permission from the copyright holder. Nothing specious about it, that's textbook copyright infringement. Then to double down, when confronted with this he thought it would be funny to blame the victim and start a twitter misogyny war.

take it to court. i'd love to hear the argument that someone is infringing on copyrights over a 7 second snap with no outbound links or proof. the misogyny part, definitely, but it's pretty absurd to get so wound over a snap.
