Are you actually over the link at the time? That particular gesture should either open a link in a new tab (if there is a link) or duplicate the current tab (if no link is indicated).
You don't need the "| Duplicate page" if you don't want it ...

You can't, but if your mouse has a wheel, you can use Mouse Wheel Down (provided your mouse has that, but most newer ones do), to open a link in a background tab.
If you want to use MS Wheel Down in another way, press Shift + Mouse Wheel, and it will show a dialog.

There is no need to argue at all — change it yourself to whatever order you like.

Open on the right-click menu is not redundant. Disable "Reuse current tab" in preference, and left click on the link above — it will open in a new tab as expected. Now, right-click and choose "Open.
