The real issue here is a lack of due process

Also, its a conflict of interest, the agency in charge of handing out your benefits has an incentive to not give you your benefits. It's like your boss saying you're not competent enough to manage your paycheck (so he'll handle it for you) but you competent enough that he doesn't have to fire you or put you in a mental institution.

The VA doesn't manage your finances for you. They ask you to appoint someone you know and trust (mom, brother, etc).

Did, you read it? It says " ...therefore, we will find someone to manage them for you."

That doesn't sound anything like find yourself someone you trust to manage your finances for you.

The fiduciary selection is based on an assessment of the qualifications of the proposed fiduciary. When seeking a fiduciary the following individuals may be considered: A spouse or family member Court-appointed fiduciaries Another interested party, or A professional fiduciary

An assessment of the qualifications of a proposed fiduciary includes, but is not limited to: The willingness to serve and abide by all agreements An interview with a VA representative Credit report review An inquiry into the criminal background, and Interviews with character witnesses"

They use language like that to ensure it is understood that they have ultimate authority to decide. Of the three people I know who have fiduciaries, all three of them were appointed their family members (two use their respective sisters, one selected his wife).

If he is deemed incapable of managing his money, couldn't this also mean he is incapable of finding someone to do it for him?

Even if he could, how can they be sure that person is reliable and not just a puppet willing to do whatever the veteran wants?
