Article 202 currently states, "If the suspect or the victim does not speak Turkish well enough to express him or herself, then a translator appointed by the court will translate the essential points in the allegations and defense in the hearing." However, with the planned change, Kurds or people who speak other languages as their mother tongue will be able to testify in their mother tongue even if they can speak Turkish. The judges or prosecutors have to appoint translators for these people testifying in their native languages.
However, limitations will be introduced in several major cases, including the trial of Ergenekon, a clandestine group suspected of trying to overthrow the government, and the Kurdistan Communities Union (KCK), the alleged urban wing of the terrorist Kurdistan Workers' Party (PKK), in order to prevent suspects in these cases from attempting to manipulate this right and from trying to prolong the hearings.
