小倉秀夫弁護士が、「あなたとは違うんです。」で、電話の状況について説明されていますので、私からも補足説明させていただきます。
私としましては、個人間の電話の内容を公にすることは適当なことと考えておりませんが、小倉秀夫弁護士が、電話の相手が私であると明示されました。
そうしますと、小倉弁護士が以前から触れられている電話の相手も私であることを明らかにしたことになります。
これまでの小倉弁護士による電話内容の紹介には、やや一方的な部分もありますので、ここで憶測を避ける意味でも私からも明らかにしておくことにします。
私は、３月３０日の午前中に「教授たるに相応しい業績」を読みました。
そのときの文章は以下のようなものです。
某宗教団体の発行する雑誌って，電車の吊り広告等で見出しを見る限り，特定の個人等を口汚く罵る記事が執拗に掲載されるという特徴があります。常々末端の信者はああいうのを見て却って引いてしまうのではないかと不思議に思っていたのですが，ああいう執拗な個人攻撃が好きな人が信者になっていくから，それはそれで彼ら的には問題がないのだと最近実感した次第です。それにしても，その種の宗教団体が運営する大学院って，これといった著書・論文等がなくとも，信者に「教授」の肩書きを与えることができるようなので，それもいかがなものかなあという気はしないではありません。一応，学校教育法上の大学院である以上，教授たるに相応しい業績のある人にしか「教授」の肩書きを付与しないくらいの矜持がないとよろしくないように思ったりします。

「la_causette」の読者であれば、上記の「某宗教団体」が何で、「その種の宗教団体が運営する大学院」がどこの大学院（法科大学院）で、「信者に「教授」の肩書きを与える」の「信者」が私を意味していることは、誰でもわかる程度に明白です。
つまり、このエントリは、私及び私が所属している法科大学院に対する明らかな名誉毀損です。
それまでの泥仕合とは一線を画する悪質性を有しています。
私は、このままエスカレートしていくと本気で懲戒請求を考えなければいけないと考えましたが、懲戒請求はするほうにとっても面倒くさいものですし、こんな弁護士同士の揉め事で綱紀委員会の先生方のお手を煩わせるのも心苦しく思われました。
そこで収束の方向を考えてみたわけですが、これまでの経緯から考えて、小倉弁護士に直接抗議したところで話がこじれるだけの可能性もあるので、小倉弁護士の所属する法律事務所の先輩弁護士に仲裁をお願いできないだろうかと考えたわけです。
このような問題でいきなりボス弁の先生にお電話するのは恐縮すぎる話ですので、ナンバー２（私と修習期も近い）と思われる先生宛にお電話しました。
いきなり電話というのも失礼かも知れないと思いましたが、事前にファックスというのも事務員の目に触れて小倉弁護士の事務所内の名誉にかかわるかも知れないと思いましたし、電話のほうが相手の先生の本音などもわかりやすいと考え、失礼を省みず電話をすることにしました。
最初に事務所に電話をしたときはご不在でしたので、事務所に戻られる予定をお聞きし、あらためて私から電話をする旨お伝えし、午前１１時過ぎころに私からお電話しましたが、そのときもまだ事務所にはおられなかったと記憶しており、そのときには私の事務所にお電話をいただくようにお願いしました。
それから、まもなく事務所の若手の弁護士さんから電話がかかってきました。
どうも、事件関係の電話だと勘違いされたようで、先輩弁護士からの指示で電話をされたようです。
それまで事務員の方には、小倉弁護士の名誉の問題があるので用件を伝えておりませんでした。
私が、若い弁護士さんに「私の名前をご存知ですか？」とお聞きしたところ、「知りません。」とお答えになりました。
これで、この若手弁護士さんは小倉弁護士の「la_causette」を普段読んでいないことが分かりました。
読んでいれば、あれだけ私の氏名が書かれているのですから、私の名前は記憶にあるでしょうし、私から電話があれば、当然ブログの内容に関するものかも知れないと思われたはずですが、そうではありませんでした。
ということは、ナンバー２の先輩弁護士も、少なくともその時点では小倉弁護士が「la_causette」で何を書いているのかご存じなかったと思われます。
そこで、私は、若手弁護士さんに、「実は小倉弁護士のブログのことについてですが」と用件を伝えたところ、「そういうことは小倉弁護士に直接話してください。」と言われました。
先方の誤解もあって先輩弁護士とはお話する機会がありませんでしたが、若手弁護士さんの言い分はある意味で正論ですし、これ以上先輩弁護士の仲裁を依頼するのも甘えになってしまうだろうと思い直し、今度は、直接小倉弁護士宛に電話をしました。
そのときは不在でしたが、まもなく小倉弁護士本人から電話がかかってきました。
昼前ころの時間だったと記憶しています。
その電話で、私は小倉弁護士に「教授たるに相応しい業績」（改訂前のもの）を削除してもらえないかと要望しました。
この要望に応えて貰えれば、泥仕合を収束させることもできると思ったからです。
しかし、小倉弁護士の答は、「教授たるに相応しい業績」自体には固有名詞が使用されていないので問題はない、というものでした。
これに対して私は強く抗議したわけです。
小倉弁護士が「高圧的」と受け取ったのはこの部分でしょう。
そして、私が、あらためて削除の意思の有無を確認したところ、「一日考えさせてもらう。」ということでした。
小倉弁護士との電話の概略は以上のようなものです。
電話を切った後、「１日」というのが不明確であることから、事務員さんに電話をかけて、翌日の午前零時までに結論を出してくださいと伝言を頼みました。
なお、私は削除の期限を指定したのではありません。
削除するかしないかの決定の期限を指定したのです。
伝言を依頼したのは、小倉弁護士のお時間をこれ以上取る必要はないと思ったからであり、事務員さんが不安を覚えるような内容ではありません。
小倉弁護士が
矢部教授からは、エントリーの削除を求められたおり、削除に応ずるかどうか検討するにしても昼間はその時間がないからとそれを拒みましたが、
というのは事実ですが、その割に小倉弁護士は速攻で「教授たるに相応しい業績」の本文を全面的に改定するとともに追記まで付加されました。
改訂後の全文は以下のとおりです。

教授は、専攻分野について、教育上、研究上又は実務上の特に優れた知識、能力及び実績を有する者であつて、学生を教授し、その研究を指導し、又は研究に従事する。と規定しているのですが，法科大学院を濫立させる中で，これといった著書・論文等がなく（法学系だと，紀要論文を含めた法学系の雑誌に論文が掲載されると，判例データベース運営者が提供する法律文献情報データベースで検索可能となるので，パソコン雑誌等畑違いの雑誌への掲載でない限りは論文の有無・ありかは分かりますし，畑違いの雑誌へのエッセイ等は普通「実績」に含めないようには思います（私も，ゲームラボへのコラム連載は実績に含めていませんし。）。），また実務家として特に優れた実績を有するわけでもない人を「教授」としているところもあるようです。法科大学院自体，政策的に「（法務）博士」号を濫発することが予定されているのだからそこでの「教授」号も他の教育機関と同視しなければ良いではないかという考え方もあり得るのですが，それでは「教授」たるに相応しい「研究上又は実務上の特に優れた知識、能力及び実績」があって法科大学院において「教授」に任命された人が（法科大学院の「教授」の価値が他の研究機関における「教授」よりもレベルの低いものとみなされかねないという意味で）お気の毒だという気も，一方でしてしまいます。
もちろん，法文上は「研究上又は実務上の特に優れた......実績」となっていますから，研究上の実績が皆無であっても，実務上の実績が特に優れていれば問題がないとはいいうるわけですが，単に裁判官や検察官としての経験が十数年あるというだけでは，法律実務家としては当たり前の実績であって，「特に優れた......実績」とは言えないように思われます。「研究上又は実務上の特に優れた......実績」を有する実務経験者を集めるのは（特に，法曹養成機関としての実績がそれほど大したことがなかった）法科大学院にとっては大変だという事情はわからないではないですが，逆に言うと，そういうところまで無理をして法科大学院を創り，維持する必要はないのではないかと思ったりします。

当初のエントリーについて，自分が個人攻撃をされていると思いこんで，わざわざ事務所に電話をかけてこれを削除するように求めて来た方がおられましたので，より抽象度の高いエントリーに変更することと致しました。たぶん，著書・論文等の実績がない人を「教授」とすることが問題であると指摘すること自体を禁圧したかったのではないと善解させていただきましたが，「誤読」でしたらメールでご連絡下さい。＞その方

という程度に忙しかったとは思えません。単なる私の想像ですが。
それとも、私を批判するエントリをアップすることのほうが、翌日までに書き上げなければならないお仕事上の書面を書くより重要だったのでしょうか？

何か苦しい言い訳ですね。
オグリンの事務所のＨＰを見ると、オグリンは「パートナー」に昇格しているようですから、「ボス弁」はいないですよね（形式的な雇用関係があったとしても、事務所内で「パートナー」と呼んでいる人を「イソ弁」とは言いませんよね。）。
モトケンさんは３７期。オグリンの事務所には３６期が２名、３８期が２名いるようですけど、誰を呼んだのですかね。見ず知らずの弁護士を電話で呼びつけて仲介を頼んだなんて、誰が信用するのでしょうかね。
ちょっと恥ずかしいですね。

個人ブログを書くのは小倉先生の事務所と全く無関係なことですから、そのことにより迷惑を受けたという趣旨を、全く無関係のナンバー２の先生に電話するというのは、かなり問題有ると思います。
ナンバー２の先生からしたら、純粋に迷惑な話でしょうし。
小倉先生のエントリは、相変わらずの嫌みな内容になっており、閉口しますが、そのことによってナンバー２の先生への電話が正当化されるというものでもないと思います。
業務外の私的な問題について抗議するとすれば、やはり小倉先生宛に直接するしかないでしょうし、小倉先生が対応しないのなら、法的な方法によるのが筋だろうと思います。
また、小倉先生のブログ自体、社会的影響はほとんどないと思いますし（野次馬的な閲覧者が多いかと）、ここでの論争を現実社会に持ち込むのは余り得策ではないようにも思います。
本文でも説明していますが、私は、事務所の先生に抗議するために電話をしたのではありません。
もし、電話が通じていれば、「お時間があれば、小倉弁護士のブログをお読みいただいて適切なご意見を述べていただければ幸いです。もし関知しないということであればそれでけっこうです。」ぐらいのお話をするつもりでした。
事務所の他の弁護士に責任があるとは思っていませんので私から抗議するという筋合いはありませんし、抗議の意図もありませんでした。

抗議ではないとしても、これはまさしくそのとおりだと思います。
ですから、電話するまでかなり迷いましたし、若い先生に振られた時点であきらめました。
ただし、もし小倉弁護士のブログでの発言を知って放置しているというのであれば、見識を問われるのではないかなという老婆心的余計な心配はしています。
私の電話の時点までは「知って放置」ということではなかったと思っています。
現在、誰がどこまでご存じかは分かりません。

上記知るとか知らないというのは、小倉弁護士が弁護士かどうかということではありません。
小倉弁護士の発言傾向のことです。
私は小倉先生が名称は上げないまでも、ほとんど明示されている宗教団体に対して何らシンパシーを感じないのですが、小倉先生が個人的な信仰を何ら必然性無しに冒涜している事には、正直反吐がでそうな気持ちになります。特に修正後の文言で電車の中吊り云々の文章は全く必要がないでしょうに。
その宗教団体に対する憎しみとか嫌悪感から冒涜しているのならまだしも、モトケン先生個人を攻撃するための道具として使っているわけで、二重に度し難いと感じるわけです。
人による軽重はあるにせよ、信心する人にとっての信仰は、その人にとってどれだけ尊く重要かという点にあまりにも小倉先生は無神経でしょう。
正直、そこまでされても何とか穏当な手段で解決を図ろうとするモトケン先生の自制心に敬意を表したく、書かせていただきました。
見ている人は見ていますし、わかっている人はわかっています（って、わかっている人が大半でしょうけど）。
怒られておいてまたコメントするのも申し訳ないですが、昔から気になっていたので教えてもらえたら嬉しいのですが。

これは一般論としてどのくらい確からしいのでしょうか。
質問の意味が曖昧と怒られそうですが、普通に考えてあれで名誉毀損にならなけばネット上では誹謗中傷し放題ということになりませんか。
例えば、中学生とか高校生があのブログを見ていて、
「個人名さえ出さずに第３者が特定できないように気をつけさえすれば、相手にどんな不快感を与えてもいいんだ」などと考えてしまうとしたら怖いことだと思うわけです。
これがイジメに応用されかねないとは考えられないでしょうか。
そんなことを言ったらネットなんか見てられないという意見もあるでしょうが、現役の弁護士（モトケンさんも含まれますが）が実名で遣り合っているというのがどうしても昔から気になっています。
誰が、どうすべきだとお考えなのでしょうか？

暗喩や比喩でも、その部分社会内で容易に個人が特定される記述なら、名誉毀損罪も侮辱罪も成立します。旧試験の択一レベルの常識問題で、戦前の大審院（戦後の最高裁）以来、一貫した確定判例です。
私が恐れるのは、モトケン先生の意思を超えて（大学組織は、モトケン先生個人の人格権とは別個独立した保護法益の享有主体です）、大学なり、大学学部なり、大学ローなりが、法人に対する名誉毀損罪や侮辱罪で小倉先生を告訴することです。そこまでいかなくても、弁護士会に懲戒申し立てをすることです。
モトケン先生との議論では不必要無関係で有害無益なのに、モトケン先生を個人攻撃する道具として、某大学の学部やローを嘲笑し、事実の証明なくして社会的評価を低下させる行為をしたからです。
モトケン先生への純粋な個人攻撃誹謗中傷なら、モトケン先生が我慢すれば何とかなりますが、もはやモトケン先生個人の手を離れてしまった感があります。
それを恐れたモトケン先生が、同業者のよしみ（プロの答礼）で、同業者の人間関係でネット外で先輩に注意・指導してもらって、何とか密かに収めようとするのは自然なことだと思います。

ちなみに小倉秀夫先生自身は、質の低い言論（＝名誉毀損・侮辱？）は社会的制裁（＝法的制裁？）で淘汰されるべきだとの論旨を展開され、その根拠理由の見解も公開されています。この問題を検討するのに参考になると思います。

＞まずひとつに、どんな表現活動を行っても法的な責任を負わないだけでなく、「こんな発言をすれば社会的に恥ずかしい」「評判が下がる」といった社会生活上の不利益をこうむる心配がなくなります。つまり、表現活動にともなう責任を負う必要がなくなるわけです。こうなってしまうと、「なにをやっても大丈夫だ」という神になったかごときの全能感が生まれ、他人を見下すようになります。そして、他人が自分に従うのは当然だという気分が醸成される。私が推測するに、この全能感こそが祭りや炎上やコメントスクラムの発生要因になっているのではないか。
＞さて、ブログの世界を見渡しますと、気に入らない言論があったときにコメントスクラムというかたちでその言論を抑えにくる人々がいます。彼らの特徴をどう捉えるのか。最近ekkenさんが「粘着君のガイドライン」というものをつくられていますが、それに近い話ですね。まず、彼らは相手が完全に屈服しなければ気が済まない。これはコメントスクラムにのみ関する事例ではありませんが、2005年には「のまネコ騒動」*1というものがありました。この事件で見られたのは、思うとおりの行動をするまでエイベックスを許さないという態度だったといえます。エイベックス側もちょこちょこと譲歩しながら事態を収めようとしていましたが、中間時点の譲歩では気に入らず、コメントスクラムを仕掛ける側はとことん行けるとこまで行こうとした。

はっきり言ってしまうと、ここまでくれば傍から見れば喧嘩両成敗ということになると思います。
例えば、こういう状況を想定してみます。
中学生がブログで、自分の嫌いな人を愛称（ニックネーム）で罵ったとします。
それは学年やクラスの生徒が見れば明らかに誰か特定できるが、外部の人間が見れば誰かは判らないように書かれていたとします。先生がそれを発見して注意するためその生徒を呼び出した時、その生徒は
「だって弁護士の先生もこんなこと言ってるし、やっているんだよ」
とこのブログと「la_causette」を示したときの先生を困惑を想像してみていただけないでしょうか。
そこまで考えたら弁護士はブログやれなくなってしまうとお考えでしょうか。
通常の常識のある人ならそうは思わないと思います。議論のやり方や進め方にはもっとちゃんとした大人のやり方があると思います。だから私は前のコメントで言いました。低俗なテレビ番組を見ているようだと。
もちろん、小倉弁護士がきっかけであることは私も理解していますし、彼がいろんなところで同様のことを繰り返しているもの知っています。でもだからといってモトケンさんはやりすぎたと思っています。（もし彼が、モトケンさんのいうように知恵者であるなら、まんまと罠に嵌ったといえるでしょう。私はそうは思いませんが）
さて、どうするかということですが、私も弁護士会などを持ち出すほど高尚な問題ではないと考えてますし、みっともないと思います。ここはひとつネット上で擬似裁判なんていかがでしょうか。おりしも、もうすぐ裁判員制度が始まることですし。 お２人が自ら裁判官という位置づけでもいいんですが、裁判員は観客ということで。
私は、以下のような判決を提案します。
判決は喧嘩両成敗。双方ともやりすぎ。ネット社会を混乱させた罪は重い。
よって、小倉弁護士は一年間のネット活動の完全中断、および「la_causette」の完全削除。
モトケンさんは、３か月のブログエントリの更新の中断、およびこのブログを完全削除。
いかがでしょうか。
あくまで私の印象ですが・・・。
モトケン先生と小倉弁護士の”論戦”はお互いにとって生産的でないと思います。
小倉弁護士は、山口母子殺害事件での懲戒請求騒動や国籍法騒動では至極真っ当な見識を述べられていたと思います。その点はモトケン先生も同意されていました。
今までブログを読んできた感じでは、案外政治的なスタンスでは小倉弁護士もモトケン先生もそれほど違いがないのではないでしょうか？
小倉弁護士のブログは、国籍法騒動でのゼノフォビア（外国人嫌悪）批判や、あるいは行き過ぎた新自由主義批判、またもちろん、ご専門の著作権関連の話題は面白いと思いました。その方向での活動を期待したいです。
法曹の方を相手に、素人が仕切る裁判ごっこなどやっても無意味でしょう。

その後電話帳などが続いて9番目にla_causette、このブログも結構上位で出てきますね。
だから小倉さんのことを教えてあげるのが善意かおせっかいかは微妙かなと思います。
法科大学院の教授の業績について、批判的な指摘をすること自体は、公益性があると思います。やはり、教授という以上は、論文・著書等での理論的水準が担保されているか、実務法曹としての実績（著名事件での弁護人・代理人を務め、判例時報等に多数掲載された等の実績）が要求されることは、無理な注文とまでははいえないかなと思いました。
公益性があるから正当化されるというものではありませんよ。
あなたは私が法科大学院の実務家教員としての資格がないとおっしゃりたいのですか？
法科大学院の教授は文科省の審査を受けているのですが、あなたはその審査手続の内容をご存じですか？
あなたが書き込んだ内容は、あなた自身が「公益性があると思います。」とおっしゃっているように軽いものではないですよ。
返答しだいでは、小倉弁護士ともどもそれなりの対応を取らせていただく可能性があります。
ちなみに、研究者では教えることができない内容があるから実務家教員というものがあるのです。
著名事件と言えば、私は山形マット死事件の主任検事です。
小倉弁護士はその一審（家裁）の結果をとらえて私を批判していますが、高裁、最高裁で山形県警および山形地検の捜査処理の正当性が認められています。
なお、山形マット死事件は少年法改正のきっかけの一つにもなった重要事件です。
また私は検事の中から選抜される検事研究の研究員にも選ばれています。
こういうことまで言わないと文科省の審査は信用できないと言われるのでしょうか？
というか、教員としての能力というのは教え方の巧拙なんですよ。
どれだけ学生に法律の基本をわかりやすく理解させることができるかどうかです。
全国の法科大学院の実務家教員の経歴と比較して、私の経歴が特に劣っていて教え方もへたくそだというのなら私も反省しますけどね。
小倉弁護士の個人攻撃を真に受けるのは結構ですが自己責任ですよ。
小倉弁護士にここでも釘を刺しておきますが、もし上記の私のコメントに反応するつもりなら、池田信夫blogのトレードオフを否定する人々の一法曹さんのコメント（2009-04-10 23:34:58）を読んでからにしたほうがいいですよ。
あなたの私に対する攻撃を真に受ける人がいるということは私の行動選択において無視できない要素です。

当該教員の実務法曹としての経歴・実績、教授としての指導等に関して詳細に検討し、事実に基づく合理的な根拠を元に客観的かつ妥当な指摘をするのであれば批判にも公益性はあるでしょうが、そうした前提を怠り批判者自身の勝手な想像（誤読も含む）、憶測などに立脚したそれは、ただの誹謗中傷であり、公益性など微塵もないと思います。
居酒屋等で友人と飲みながらウダ話の一つとして批判される程度ならともかく、少なくとも公の場で実在の人物を批判されるのであれば、批判の根拠となる客観的な事実を明示すべきと思います。

そういえば学部生時代に習った、刑法と憲法の調整を図った付加改正立法（公共利害関連性・公益目的・真実性の証明）は、「表現の自由」のあり方として指導的なものである、というのを思い出しました。その解釈は最高裁のサイトで判例を参考にされてください。英米法の解釈では「ABSENCE OF MALICE」という概念に相当するらしいです。
