小倉秀夫弁護士の「むしろ、読者に斟酌される属性をコントロールしたいのでしょう。」についてです。
名指しのエントリですし、法律論的議論を含むので少しだけ反論しておきます。
小倉弁護士のこのエントリは前半と後半に別れています。
前半は、いわゆる属人論法批判に対する反論のようです。
矢部善朗氏についていえば、わざわざ「モトケン」というハンドルネームを名乗ってまで、「検察ＯＢ」であるという属性を強調しているのであって、論者の属性を捨象して純粋な「論理」のみで勝負しようとはしていないわけです。あのブログの常連コメンテーターの多くもまた、その氏名等は明らかにしないもの、医師だの弁護士だの公務員だの法務業だのというご自分に都合のよい属性は、立派に強調しているわけです。
小倉秀夫弁護士は、ご自身が東京弁護士会所属の弁護士であることを名乗っていることについては、私や常連コメンテイターに向けた批判と同様の批判が当たらないとお考えなのでしょうか？
もしそうならその理由をお聞きしてみたいところです。
後半は、西松建設の不正献金事件における政治資金規正法違反（虚偽記載の罪）の解釈論の問題ですが、小倉弁護士は以下のように言っています。
ある犯罪類型を「形式犯」ではなく「実質犯」と解することによって処罰範囲を拡張することができると考えている法律専門家が彼以外にどの程度いるのかを見てみれば明らかではないかという気がします。
しかし、私は「虚偽記載の罪は実質犯である。」と断定したことはありません。
あるというならご指摘いただきたいものです。
誤解を招く表現があれば訂正いたします。
形式犯と言い切っていいのかについては疑問を呈したかも知れませんし、虚偽記載の罪が形式犯だからという理由で検察を批判した意見については異論を述べたことはあります。
なお、新館ブログの「虚偽記載とその故意（その１）」、「同（その２）」、「同（その３）」は、読んでいただければわかると思いますが、虚偽記載の罪が形式犯に分類されるとしてもという前提で論じています。
また、私は、いかなる文脈においても「ある犯罪類型を「形式犯」ではなく「実質犯」と解することによって処罰範囲を拡張することができる」という考え方を述べたことはありません。
ある刑罰法規が形式犯か実質犯かという問題は、規範解釈の結果として分類されるものであると考えています。
小倉弁護士の論旨が、私が処罰範囲を拡張するために「形式犯」ではなく「実質犯」と解しているということであれば、それは二重の意味で誤りです。
次に、以下の小倉弁護士の文章ですが、
実質犯における「故意」にしても、当該刑罰法規により保護しようとしている法益が侵害され又はその危険は発生することの故意があればそれだけでよいというのではなく、その認識・認容している事実関係自体で当該犯罪の客観的要素を全て構成できることを要すると考えるのが法律専門家の間では一般的でしょう。
私が、ご指摘の「法律専門家の間では一般的」な考え方とは違う意見を述べたところをご指摘願いたいと思います。
私は、ごく一般的な故意概念を前提にして議論しています。
小倉弁護士のこのエントリと３月３０日以前のエントリを合わせて読みますと、「「実質犯だ」と解釈すればどんどん拡張解釈が許されるってものではない」は、特定の個人名は明示していないものの、私を批判したものと読まざるを得ないように思います。少なくとも、多くのla_causetteの読者はそう考えると思われます。
小倉弁護士が私を批判したものと読んだ場合、
犯罪を実質犯と形式犯に分けた上で，実質犯については，それが守ろうとする法益を実質的に侵害する行為については，刑罰法規の文言を無視して，これを適用として処罰しても良いとする奇妙な解釈をする方がおられるようです。
の「奇妙な解釈をする方」というのは私のことになるわけですが、私が、「刑罰法規の文言を無視して，これを適用として処罰しても良いとする奇妙な解釈」を行った事実は存在しません。
小倉弁護士が存在すると主張するのであれば、直ちにその箇所を指摘していただきたいと思います。
指摘できないなら、謝罪を求めます。
小倉秀夫弁護士が、「実質犯だ」と解釈すればどんどん拡張解釈が許されるってものではないは私を批判したものではないと主張されるのであれば、「奇妙な解釈をする方」が誰であるのか明らかにしていただきたい。
明らかにできない場合は、「奇妙な解釈をする方」が私であると読まれることには変わりがないのですから、そのような誤解を招く表現を用いたことについて謝罪を求めます。
追記
「検察ＯＢ」という、「刑事法や刑事手続に熟知している」との推定、「そのような者が刑事法や刑事手続に関して述べていることだから概ね信頼できるのであろう」という推定が読者に働くであろう属性がをその論者自身により読者に提示されている場合に、その推定を障害する属性（彼が過去に担当した事件は捜査過程に重大な問題があったと多くの法律家によって考えられていること、彼の所属する組織は当該被疑者ないしその関係者の評価が批評対象の刑事手続により下落することにつき利益を有していること等）を指摘することは、むしろ議論の健全性に資するのではないかとも考えられるのですが、「属人論法は怪しからん」といっている人々は、それを「怪しからん」といっているようです。
健全な議論をしたいのであれば、まず何が言いたいのか明確にわかる文章を書くべきだと思います。
いかん、また元の路線に戻ってしまいそうです（＾＾；
しかし、普通に反論しても皮肉っぽい言い方になってしまうのはなぜでしょう？
始めからこういうスタンスでいけば良かったのに、と思うのは私だけでしょうか。
明らかな誤読と間違いを淡々と指摘し訂正、謝罪を求めるというのが彼に対する正しい対処法だと思います。素人の私から見ても答えに窮して論点を変えようと必死になっている姿勢が明らかなので、何も低俗なテレビ番組のように外したギャグにもベタベタと乗ってあげる必要はなかったと思っていました。
蛇足ですが、本エントリの対象の１つ前のエントリの最後の
＞高圧的に削除せよと迫られますので（「その考えは間違っている」という指摘を「お前は嘘をついている」という攻撃と同視されてしまうくらいですし），
に対しても（もしこれがモトケンさんへのものだとするならば）言及したほうが方がいいと思います。私としては、組織力を背景として言論弾圧をしたような印象を受けました。電話の内容が分からないだけに判断のしようがありませんから、もしそれが事実だとしたら聞き流すことができません。
まあ、彼自身が身をもって実名公表のリスクを公言してくれたようなものなので、確かに鏡といえば鏡であるわけですが(笑）

しかし、追記で書きましたように、普通に反論しても皮肉っぽくなるのはやはり元々の小倉弁護士の言い方に相当問題があるせいではないかと思えるのですが、いかがでしょう？

とりあえず、これまでの小倉弁護士の表現のパターンに沿って小倉弁護士の発言を理解すればいいのではないかとだけ申し上げます。
小倉弁護士の主張にも沿う判断だと思いますので。
＞組織力を背景として言論弾圧をしたような印象を受けました。
それについては、一切ないと断言いたします。
日本語の普通の読み方のレベルで抗議しただけです。
個別の事象に関するある主張に対して、具体的な反論が出来ないからといって、その主張を誤読曲解し、反論の出にくい一般論で難癖を付け、皮肉や当て擦りで味付けした文章は通常「反論」とは言えません。
モトケン先生のエントリに対する反論なら、la_causetteにトラックバックを送られているこの方のエントリの方が、（その内容の当否は置くとして）「反論」としての体裁をなしていますね。
自分の主義主張とは対立する相手の主張を自分なりに理解し、その主張への対論を丁寧に述べられています。
少なくとも小倉弁護士の無意味なエントリの群れよりもはるかに有効な反論でしょう。
またどうやら小倉弁護士は、モトケンブログに出入りする我々のような読者を「肩書きに騙されるバカ」と仰りたいようですね。
まあ確かに、自己の主義主張の固執し、肩書きや所属、属性に惑わされて、論理的な主張や是々非々の議論をする能力に欠ける方は、少なくとも有能な論者とは見られない事は間違いありませんし、もしそのような方が刑事弁護士であるならば、被疑者被告人はそのような弁護士を選任しないように注意しなければならないでしょうね。
静観するつもりだったのですが、オグリンのブログに謝罪要求！のトラックバックがあったので一言。
モトケンさんは、オグリンが挙げる「極論を言う匿名人」＝モトケンさんと解釈しているようですが、それは違うと思いますよ。オグリンは、単に、極論を言う架空の匿名人を持ち出して、あなたの主張を突きつめるとこのような極論になってしまいますよ、と言っているだけです。オグリンが皮肉を効かせているのは、このようなレトリックが背後にあるからです。冷静に考えれば、分かりそうなものですが。
それを、極論を言う架空の匿名人は自分だ、などと決めつけて謝罪を求めるなんて。。。それこそオグリンの思うつぼかと思われるのですが。
私が謝罪を要求している理由をもう一度お読みください。

モトケン先生、朝早くからコメントありがとうございます。スルーしていただいてかまいません。単に、オグリンのブログを言外の皮肉などを捨象して読んでいる人ばかりではないということを伝えたかっただけです。
モトケンさんを批判する人、忠告する人、たくさんいますが、私を含めて反モトケンという人ばかりではないと思います。
弁護士だったら次の手を読んでおられますよね。オグリンが謝罪するわけはないのだから、「謝罪要求 モトケン」というトラックバックが放置されるだけです。世の中には、内容の如何を問わず「謝罪要求」する人が嫌いという人が大勢いるのではないかと推察されます。まして、弁護士なんてそうではないのですか？ そして、モトケンさんが謝罪要求するに至った経緯を理解しようと努める人はそれほど多くはないのかと。
裏目にでるようなことはやめておいた方がよいのではないかと思っただけです。スルー歓迎です。

まさか、その表現までも印象操作なのでしょうか。（普通の言い方だったのに高圧的といってモトケンさんを貶めようとしたと）まあ、今までの言動からするとあり得ないとは言えませんが、そこまでの人なんでしょうか。
＞そうですか。でもそれだったら高圧的という表現をするかなと思います。
小倉弁護士が電話の会話を録音していて、その録音テープを公開したら別ですが、そうでないならこれ以上私から証明する手段はありません。
つまり、私としては、あなたは私のことを信用しない人なんだな、と思うだけです。
すいません。信用しないとかではなくて、私はブログだけしか情報源がないので（実社会では面識がないので）訊ねているだけです。
常識的に考えて、
＞日本語の普通の読み方のレベルで抗議しただけです。
だけならば、今まで通りブログで抗議すればいいはずです。それをメールでもなく電話でしたということは、そこでは言えないこと（公言できないこと、記録として残したくないもの）を言うためにそうした考えるのが論理的だと思います。それが高圧的だったと相手は公言しているわけですから、違うなら抗議するべきです。それは印象操作を通り越して嘘といってもいいレベルなので、抗議しなければ第三者としては抗議できない何か（万が一、録音されていたらという不安とか）があると考えるのが普通だと思います。
はっきりいって私は小倉弁護士のやり方はきたないと思っていますが、直接的な圧力を掛けて言論（それがどんなに姑息な言論であっても）を封殺しようとするのもきたないと思います。
自分の主張に非がないと自信があるなら抗議するべきだと思ったので前回のようなコメントをしました。別に信用してないからとかではありません。気を悪くされたのなら謝ります。ごめんなさい。
メールやブログでなく、電話をしてはいけないのでしょうか？ ブログで抗議しても受け付けないならとか、のらりくらりで埒があかないなら、直接電話とか面談で抗議なんて、民間の商取引では（公務員の世界でも）、よくあります。
あなたはいったい何を問題にしたいんですか？
私が高圧的に抗議したと小倉弁護士が言ったことですか？
それともあなたが、私が組織力を背景として言論弾圧をしたような印象を受けたということですか？
前者は小倉弁護士の私の電話に対する評価の問題です。
後者は、あなたの私の抗議内容に対する評価の問題です。
前者については、私は強く抗議したのは事実であり、それを小倉弁護士が高圧的と評価するのは、表現レベルの問題です。
しかし、後者は、小倉弁護士の物言いの問題ではありません。
あなたが、私が組織の威力を利用したのではないかと推測したのです。
私はそれに対してきっぱり否定しました。
これは、小倉弁護士に対する抗議の問題ではありません。
あなたの推測に対する抗議の問題です。
議論をすり替えるのはやめていただきたい。
あなたは、あなたが私に投げかけた組織利用の疑いに対する私の否定について、その否定は信用できないと言ったのですよ。
小倉弁護士は、私の電話は高圧的だとは言っていますが、組織力を背景として言論弾圧をしたというようなことは言っていません。
そういう印象を受けたと言うのはあなたです。
すなわち、ここで問題になっているのは、小倉弁護士の私に対する印象ではなく、あなたの私に対する印象です。
その文脈で、あなたは、「直接的な圧力を掛けて言論（それがどんなに姑息な言論であっても）を封殺しようとするのもきたないと思います。」と言ったのですよ。
つまり、あなたは、私に対して「きたない」と言ったと、私は理解しています。
気を悪くしない方が不思議でしょう。
あ～、モトケン先生少し冷静になられて下さい。

少なくともと言うのならば、少し検索するなりすれば、小倉弁護士の言う「高圧的な非難」がどの程度のレベルなのかはすぐに分かるはずでしょうがね。

My experience is that we should pretty much live and let live because what one person thinks just -- another person simply doesn't. People are going to do what they want to do. In the end, they always do. The most we can yearn for is to highlight a few things here and there that hopefully, allows them to make just a little better informed decision. Otherwise, great post.
