By registering with MyAmericanShipper.com, you agree to be bound to the Terms and Conditions set forth herein.

CANCELLATIONS

If you wish to cancel your shipment before it arrives at our warehouse, please contact the store where you placed your order.

If you with to cancel your shipment after it arrives at your warehouse, we will ship it back to the sender on your behalf. Your credit card will be charged for the return shipping, plus a $20 USD service fee.

COOKIES

COD (Cash on Delivery)

My American Shipper will refuse all parcels delivered COD to your USA address.

CURRENCY

Visa and Master Card payments will be processed in your local currency. If your local currency is not supported, then payment will be processed in US Dollars. All other payment methods will be processed in US Dollars only.

DAMAGED GOODS

Goods which arrive to our warehouse that are clearly damaged will be returned to the sender and you will be notified.

DISCLAIMER FROM UNFORESEEABLE CIRCUMSTANCES

My American Shipper is not responsible or liable, nor shall it be deemed in default of the Terms and Conditions, for any delay or failure in performance or non-performance of any aspect of this agreement resulting directly or indirectly from any accidents, fires, electrical or electronic failures, equipment failures, shipping delays from either online retailers, international couriers, or others, acts of God, labor disputes, governmental orders or regulations, or any other cause beyond the reasonable control of International Checkout.

DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY

This site and or application is provided by My American Shipper on an "as is" and "as available" basis. My American Shipper makes no representations or warranties of any kind, express or implied, as to the operation of this site and/or application or the information, content, materials, or products included on this site. You expressly agree that your use of this site and/or application is at your sole risk. To the full extent permissible by applicable law, My American Shipper disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. My American Shipper does not warrant that this site, application, its servers, or e-mail sent from My American Shipper and International Checkout Inc. are free of viruses or other harmful components. My American Shipper will not be liable for any damages of any kind arising from the use of this site and/or application, including, but not limited to, direct, indirect, incidental, punitive, and consequential damages. Certain state laws do not allow limitations on implied warranties or the exclusion or limitation of certain damages. DUTIES AND TAXES

My American Shipper does not offer the option to pre-pay Import Duty Taxes at this time.

You are solely responsible for Duties, Taxes, and any related charges when your order arrives in your country.

*Duties and Taxes are calculated and charged by customs in your country.

FRAUD REPORTING

In the event of any investigation of unlawful activities by local, state, national and/or international authorities, My American Shipper reserves the right to disclose personal information as required. Any party or individual conducting unlawful activities on My American Shipper will be reported to the proper authorities, including disclosure of personal information relating to any investigation of said activities.

INSURANCE

All orders are fully insured against loss or damage.

INTERNATIONAL SHIPPING TRANSIT TIMES

International Checkout will get your items to your doorstep as quickly as possible.

UPS SHIPPING arrives to your address in approximately 2-6 business days.

USPS arrives to your address in approximately 5 - 10 business days.

Transit times are estimated and are not guaranteed. We are not responsible for delays by customs or by the store.

LIMITED LIABILITY

My American Shippers aggregate liability shall never exceed $100 USD per shipment. All packages are shipped on a limited liability basis. My American Shipper bears no liability for any punitive, exemplary, special, consequential or any other damages, In no event shall My American Shipper be liable to anyone for any indirect, punitive, special, exemplary, incidental, consequential or other damages of any type or kind, direct or indirect, unless as the result of willful misconduct or gross negligence.

My American Shipper shall be held blameless for any direct or indirect damages resulting from Major Forces or Acts of God.

MISCELLANEOUS

This agreement will be governed by the laws of the United States and the State of California, without reference to rules governing choice of laws. Any action relating to this agreement must be brought in the federal or state courts located in Los Angeles, California, and each party irrevocably consents to the jurisdiction of such courts. Neither party may assign this agreement, by operation of law or otherwise, without the prior written consent of the other party. Subject to that restriction, this agreement will be binding on, inure to the benefit of, and enforceable against the parties and their respective successors and assigns. A failure by either party to enforce the strict performance of any provision of this agreement will not constitute a waver of said party's right to subsequently enforce such provision or any other provision of this agreement.

MODIFICATIONS

My American Shipper may modify any aspect of this agreement at any time at its sole discretion without prior notice. Any modification to the Terms and Conditions shall be effective immediately once posted on the web site. Check the web site regularly if you are interested in reviewing any changes. Your use of the web site and the International Checkout service after modifications have been posted constitutes your acknowledgment of such modifications and your agreement to be bound by the terms and conditions of these changes.

NON-PAYMENT

If My American Shipper is not able to charge your card because it is declined, entered incorrectly or any other reason, My American Shipper may sell, destroy or otherwise dispose of all merchandise which has been stored for more than 45 days with no liability to you or any other party whatsoever.

PAYMENT VERIFICATION

To minimize the risks associated with card-not-present transactions, our Verification Team may require its users to:

Verify a small deposit amount credited to your credit card.
Present copies of the original credit card, photo ID and credit card statement including billing address.
Provide a confirmed account and/or address for Pay Pal.

REFUSED SHIPMENTS/DELIVERY FAILURE

You will be held liable for return shipping (if applicable), duties and taxes (if incurred), and for all other associated fees when any of the following circumstances occur. Your package will be abandoned and you will be billed for any additional fees. Absolutely no refunds will be issued.

You refuse delivery of your parcel for any reason.
The carrier makes 3 unsuccessful attempts to deliver your parcel to your address because you are not at home and/or do not pay duties and taxes.
You provided an invalid address.
Your parcel is refused by customs because your merchandise is restricted from import into your country.
You refuse to pay duties and taxes.

RESTRICTED PRODUCTS AND MERCHANTS

Sometimes an item is restricted from international shipment. If this is the case you will be notified and your shipment will be cancelled. You are responsible for all expenses related to any and all items which are restricted from delivery to your country due to your country's customs or laws. My American Shipper will return any restricted items to the store or seller which they were ordered from. A $20 USD fee plus cost of return shipping will be charged. My American Shipper reserves the right to refuse fulfillment of any product, based solely on its own discretion and in accordance to any and all US and international laws. This right shall exist at all times, even after an order confirmation has been placed.

RETURNS/EXCHANGES/DEFECTIVE MERCHANDISE

If you need to return or exchange any items, including defective items, you will need to ship them directly to the store that you purchased them from. You can usually find the store's return address on the invoice that was included in your package. DO NOT ship your return or exchange to My American Shipper. We will not return your items to the store.

If you are making an exchange, you may direct the store to ship the replacement items to your My American Shipper USA address. We will forward your items to you and will charge your credit card for the shipment at our normal shipping rates.

SECURITY

Your account is your sole responsibility, including the protection of your password and all activities and services which occur on your account. If you believe that your account's security has been jeopardized, it is your responsibility to notify My American Shipper promptly in writing. You agree to provide and maintain accurate and current information. Failure to comply with these Security guidelines may result in termination of your account.

Parcels addressed to any person other than the name listed on your account will be refused by My American Shipper and returned to the sender.

STORAGE

My American Shipper will store your items for up to 45 days from the date the first item arrived. All items shipped to your USA address will be automatically shipped and your credit card will be charged on the 45th day.
