1. Terms

1.) These Terms prescribe terms and conditions for the Services of peepapp operated by eureka Inc. (hereinafter referred to as “Company”)　and apply to all users who browse or use peepapp.
2.) Guideline and Policies provided separately from these Terms also apply to all users as part of substantial components of these Terms.
3.) These Terms are subject to change without consent of users. In the event of change, notification will be made on peepapp.
4.) By browsing or using peepapp, users agree to be bound by these Terms.

2. Services

1.) Company shall provide users with each of the Services prescribed as follows: ・I.) Via this Website, all users can use the Services hereof for purposes including collecting information of/browsing applications owned by others; By download peepapp for use of the Services hereof, users will transmit the information on other applications which they download to their iPhones to the server of Company and will publicize such information on a continuous basis. Users can choose not to publicize certain information which they hope not to; In addition, Company may add new services to the Services hereof or revise them. All users shall use the Services hereof with prior consent to such conditions. The Services available to all users include services with use of Twitter and Facebook, or;
・II.) The services supplementary or related to each of the preceding items.
2.) peepapp makes no warranty of accuracy, objectivity, or usefulness of the information of applications it provides. The information it provides includes information of linked applications. Download of applications shall be performed under personal responsibilities of individual users and Company shall not be liable in any event.
3.) peepapp may pause, change the content of, or terminate the Services without prior notice on grounds such as maintenance, change in market environment and business circumstances, accidents and disasters.

3. Prohibited Acts

1.) Users shall be prohibited from the following acts when using peepapp:
・Ⅰ.) Infringement of proprietary rights of Company, other users, or any third party including their property rights and intellectual property rights;
・Ⅱ.) Violation of privacies, defamation, or damage to credits of Company, other users, or any third party;
・Ⅲ.) Denigration of Company, other users, or any third party;
・VI.) Activities for profit such as advertisement of goods and services without prior consent of Company;
・VII.) Obstruction of smooth operation of the Services by virus programs or unauthorized access:
・VIII.) Copying, editing, distributing, or reselling the information and Services provided by peepapp without permission of Company, or;
・IX.) Any other act offensive to public order and morals or deemed as inappropriate by Company.
2.) In the event a user committed an act as provided in the preceding items, necessary measures will be taken including suspension of use of peepapp, deletion of posted content and damage claim. In such a case, Company shall be liable for no legal responsibility.

4. Privacy

peepapp shall place strict controls on personal information of users and respect their privacies to the utmost extent. Details of our privacy policy are forth in the Privacy Policy provided separately.

5. Disclaimers

In no event shall Company be responsible for any of the following conditions related to use of peepapp by users:
1.) Disadvantages and damage arising out of loss, theft, transfer and lending of Twitter or Facebook accounts by users;
2.) Troubles occurred among users, or between a user/users and any third party (including advertisers);
3.) Defects of devices and networks used by users;
4.) Elimination of registered or posted data due to force majeure such as accidents and disasters;
5.) Elimination of registered or posted data in accordance with the Terms, Guideline, and Policies;
6.) Disadvantages and damage users or any third party incur due to temporary suspension, change of services, or termination (including conditions as prescribed in Item 3.) of 2. SERVICES), or;
7.) Any other disadvantage and damage users or any third party incur due to use of peepapp.

6. Governing Law And Jurisdiction

1. These Terms shall be construed in accordance with the laws of Japan.
2. The Tokyo District Court shall have the exclusive jurisdiction of the first instance over all disputes arising in connection with the Services and Terms of peepapp.
