General Terms

By using the Nippon-Yasan.com Website, THE BUYER (The Buyer) AGREES TO BE BOUND BY ITS TERMS OF USE, LEGAL NOTICES, PRIVACY POLICY and all other policies that appear on the Nippon-Yasan.com Website.

Nippon-Yasan.com reserves the right to make changes to the Nippon-Yasan.com Web site and its Terms of Use and Legal Notices at any time. Each time the Buyer uses the Nippon-Yasan.com Website, the Buyer should visit and review the then current Terms of Use, Legal Notices and Privacy Policy that apply to the Buyer’s transactions and use of this site. If the Buyer is dissatisfied with the Nippon-Yasan.com Website, its content or Terms of Use and Legal Notices, the Buyer agrees that his sole and exclusive remedy is to discontinue using the services on Nippon-Yasan.com Web site.

The Buyer agrees to be perfectly aware that his agreement concerning the contents of these Terms of Use, Legal Notices and Privacy Policy does not require the handwritten signature of this document, insofar as the customer wishes to order online the products presented within the framework of the Nippon-Yasan.com Website. The consumer has the faculty to safeguard or to print the present general terms, being specified the printing of this document concerns his own responsibility.

The Buyer states to have full legal capacity allowing him to engage under the present general terms.

Prices

Prices on the Nippon-Yasan.com Website are indicated in Euro, USD, CHF, JPY, GBP, R$ BRL, $ARS or $ MXN and do not include delivery fees.

Only the price specified in the invoice may be considered as final. Invoice prices include price of the products, handling/packaging fees, storage, and delivery costs.

Product Description

Products are described with necessary details the Buyer shall be aware of before filling-in an order form.

There is no restriction on the number of items that the Buyer may order, in the extent of the available stock dispoyed on the Nippon-Yasan.com Website. Indication on the availability of the products confirmed at the time of ordering.

The company Nippon-Yasan.com has the right to modify and/or replace the products at any time, depending on the products offered for sale by its distributors.

Photographs, and/or graphics depicting a product are only displayed as additional information and Nippon-Yasan.com shall not be liable for them.

In the case when a supplier modifies a product, Nippon-Yasan.com shall not be liable for the accuracy of its graphic representation and this shall not by any means affect the validity of the order.

Order / Sale

This sale is subject to, and Seller's acceptance is conditioned upon, Buyer's assent to the terms and conditions stated herein and on the face hereof, which are in lieu of and replace any and all terms and conditions set forth in any documents issued by the Buyer, including, without limitation, purchase orders and specifications. Any additional, different, or conflicting terms and conditions on any such document issued by the Buyer at any time are hereby objected to by the Seller, and any such document shall be wholly inapplicable to any sale made hereunder and shall not be binding in any way on the Seller.

On the date of signing the order form, the Buyer validates the general conditions of sale. The general conditions of sale will apply from the signing of the order form until the delivery of the order to the Buyer by the company Nippon Yasan.com.

After placing an order, the Buyer shall receive an automatic email confirming the order and notifying him of the details of his order. He shall be informed of further evolutions until shipment of the order (by email, and by accessing “Nippon-Yasan.com > My Account > History”).

The order shall only be held as final when the Buyer receives the confirmation notice, and when Nippon-Yasan.com receives the entire payment for the order.

The company Nippon-Yasan.com strongly recommends that the Buyer keep a hardcopy of such information concerning his order.

Payment

The Buyer shall complete full payment of his order, at the time of his order. In no way shall any kind of payment completed to Nippon-Yasan.com be considered as a partial or advance payment.

Payment is completed to Nippon-Yasan.com when the Buyer validates his order.

All orders may be paid with Euro, USD, CHF, JPY, GBP, $ARS, R$ BRL, or $ MXN.

The Buyer may complete his payment by means of: online credit card payment / Paypal, International money transfer, European money transfer, or French money transfer.

The Buyer certifies the company Nippon-Yasan.com that he is cleared to use the chosen means of payment at the time of completing his order.

The company Nippon-Yasan.com reserves the right to suspend or cancel any order and / or shipment in the case of non payment of any amount due by the Buyer, or in the case of payment failure, whatever the current status of execution of the order.

The company Nippon-Yasan.com reserves the right to ask for a copy of official identification documents from the Buyer, for any payment by credit card.

 

 

Pre-Orders

You have 2 solutions for pay the Pre-Orders:

- Pay all when you make the order.

- Pay later, chose the method of payment, PRE-ORDERS ONLY, in this case, you don't have to pay anything at the time of order. You will receive 2 to 3 weeks before the official release the invoice, you will have until one day before the official release to pay the full amount. In case of non-payment until one day before the official release, the pre-order will be canceled without notice!

(The official release date will be indicated in the invoice you will receive)

For an order made in another currency that Japanese Yen, we can update the price in the order following the Yen value.

 

Pre-orders are sent on the day of the official release in Japan.

 

All pre-order can not be canceled (even if no payment was made.)

If the client still wants to cancel his pre-order (or if he does not pay on time) this will result in the cancellation of all pre-orders currently on the site (including paid pre-orders that will be reimbursed intégralitée in 1 week)

All the orders with items in stock ordered with an item in pre-order will be sent with the pre-order. (The item in stock will be in the same package as the pre-order.)

In the case of a deferred payment, we will ask you to pay within 5 days the objects that are not pre-order.

If you want the shipment of the product in stock immediately, please make a separate order.

In the case of an order of several pre-order items, the shipment of the package will be completed once the last of the pre-orders out. (Payment will be ask item by item according to the release date.)

Shipment and Delivery

The products are delivered to the address indicated in the order form by the Buyer, who undertakes to take delivery of the products ordered. On delivery, the Buyer is obliged to check the condition of the packaging and the goods, and indicate any damages to the company Nippon-Yasan.com within 2 business days following the delivery, by email.

The Buyer shall chose a shipment method through the Nippon-Yasan.com Website. Available shipment method are: Boat (Registered), Economic SAL (Registered or not), Airmail (Registered or not), Registered Airmail, and EMS Express (the fastest, and safest, similar to Fedex). Shipment costs are calculated automatically at the time of order.

A notification email is sent to the Buyer when his order is shipped. The Buyer may follow the evolution of his order through his personal account on the Nippon-Yasan.com Website.

Average time of shipment from Nippon-Yasan.com warehouse to Europe / the Americas are as followed:

- Boat: About 2 months

- Economic SAL (Registered or not) : 2-3 weeks

- Airmail (Registered or not): 8-10 days

- EMS Express : 3 to 4 business days

Please bear that those are average values, and provided as informational. Shipment may take more time, depending on mail traffic conditions.

Any shipment taking more time than indicated as above, does not give right to any kind of compensation, suspension, or cancellation of the order by the Buyer.

Problems of Quality or Non-conformity

In the case of receiving a product that differs with the order (dis-functioning or non-conform), the Buyer must file his claim within 7 business days of receiving the shipment.

Claims shall be sent as Registered Airmail to Nippon-Yasan.com at the aforementioned address, and must include:

- The Buyer's address and identity.

- The references of the product.

- The motivations of the claim.

Product returns shall be done within 7 business days from the attribution of a return identification number by Nippon-Yasan.com Service Center.

In any other case, Nippon-Yasan.com may not proceed in any refund or any exchange of returned products.

All products to be exchanged or refunded shall be returned as Registered Airmail to Nippon-Yasan.com in their original packaging. The products must be complete with all their accessories, as in the original order.

Shipping costs are to be paid by the Buyer.

The Buyer remains responsible for all risks and damage resulting in the return of his shipment.

In the case of non respect of the above procedure, the Buyer may not file any claim for non-conformity or defect of the delivered products.

Right of Retractation

The Buyer has a period of 7 business days from the date of delivery of the order to return the products at his expense. The products, which must be returned with a copy of the invoice, will be exchanged or reimbursed by the company Nippon-Yasan.com. The products must not have suffered any damage: they must be returned by Registered Mail in perfect condition and in their original packaging. All returns must be reported in advance to the Customer Service of the company Nippon-Yasan.com, by email or by logging on the Nippon-Yasan.com Website under the heading "Follow your order".

Only products returned in their original packaging, intact and in mint condition for resale will be accepted. Any product that has been damaged or whose original packaging has been damaged, will not be refunded or exchanged.

In order to benefit from the Right of Retractation, returned products must be unsealed.

Right of Retraction may be exerted without penalty, with the exception of delivery costs. In the event of exercising his Right of Retraction, the Buyer may choose between a refund, or changing to another product. In that case, delivery costs shall be handled by the Buyer.

In the event of exercising the Right of Retraction, the company Nippon-Yasan will reimburse the Buyer as soon as possible. However, due to the technical caracteristics of some products and the necessity of testing them, this period may be extended.

In that case, the Buyer shall be reimbursed according to the original chosen means of payment.

Waranty

Only video game systems & accessories are subject to guarantee, for a length of one year and in Japan only. This guarantee covers only production defects (damage due to shock or the presence of liquid is not covered by guarantee).

If the Buyer were to encounter a problem with a video game system or accessory bought on the Nippon-Yasan Website in one years time from the order, he may contact Nippon-Yasan.com and send back the product at his own cost (as Registered Airmail only , to : Nippon-Yasan, address aforementionned). Nippon-Yasan.com shall then send the product back to the maker in order to exercise product guarantee. Nippon-Yasan.com shall ask the Buyer to participate in subsequent delivery cost when repair is completed or product is exchanged.

All returns are subject to the Nippon-Yasan.com's explicit agreement. No return shall be accepted by Nippon-Yasan.com without such agreement.

In no event shall the company Nippon-Yasan.com be liable for any indirect, special, incidental or consequential damages resulting from the company’s performance or failure to perform under this sale, or the furnishing, performance or use of any, whether due to a breach of contract, breach of warranty, strict liability, the negligence of the company Nippon-Yasan.com, or otherwise. The company Nippon-Yasan.com is not the producer of the products it presents in its Nippon-Yasan.com Website. The Buyer expressly understands and agrees that the the company Nippon-Yasan.com cannot be held responsible for any deficiency in the products.

Force majeure

The company Nippon-Yasan.com shall not be liable for any delay in performance directly or indirectly caused by or resulting from acts of God, fire, flood, natural disasters, accident, riot, war, government intervention, embargoes, strikes, labour difficulties, equipment failure, late delivery by suppliers or any other difficulties which are beyond the reasonable control of the company Nippon-Yasan.com, such as a general lack of the goods and services required to establish the service contracted, unforeseeable delays on the part of suppliers or other third parties on which the company Nippon-Yasan.com depends and general transport problems. This includes also any failure of any electronic device and/or difficulties with communications networks. During the periods of force majeure the obligations of either party shall be suspended. The party concerned by the Force Majeure shall immediately advise the other within ten working days on the date the force majeure had occurred. In the delay of one month, the parties will come together and check whether their contractual obligations shall be furthermore suspended or not. The contractual obligations can be terminated by the injured party if the force majeure is still active after a period of three months.

Partial Non Validation

If one or several provisions of these general sales conditions are considered or declared invalid in application of a law, a regulation or the final decision of any competent jurisdiction, the other provisions shall remain in full force and effect.

Non Waver

The fact that one of the parties fails to exercise it rights with regard to a breach by the other party of any obligation whatsoever specified hereunder, shall not be construed in the future as any waiver of the breach concerned.

Headings

The section headings used herein are for convenience or reference only and do not form a part of these terms and conditions, and no construction or inference shall be derived therefrom.

Governing Law

In case of dispute, the Buyer shall come to an amicable settlement with the company Nippon-Yasan.com.

"Informatique et Libertes" Privacy Law

By ordering via the Nippon-Yasan.com Website, the Buyer consents to the use by the company Nippon-Yasan.com of the personal information about the Buyer which he has given or which has been collected over the Nippon-Yasan.com Website. This information is needed for the company Nippon-Yasan to process your order.

According to article 78-17 of the "Informatique et Libertés" law of 6 January 1978 on the processing of personal data, the Buyer has a right of access, rectification and deletion of the data that is held about him.

To exercise this right, the Buyer should send an email to the company Nippon-Yasan.com.

The company Nippon-Yasan.com may share the personal information collected with any third parties of their choice involved in the supply of the products proposed. Such information is provided when necessary to the performance of the services and is kept in strict confidence.
