PISCATAWAY — Bias charges are being considered against Rutgers students Dharun Ravi and Molly Wei, who are accused of using a camera hidden in a dorm room to transmit online a gay sexual encounter involving Ravi's roommate Tyler Clementi, authorities said tonight.
Clementi, of Ridgewood, committed suicide after he learned of the hidden camera by jumping off the George Washington Bridge. Authorities confirmed a body found in the Hudson River Wednesday was Clementi's.
Ravi, 18, of Plainsboro, and Wei, 18, of West Windsor, face charges of invasion of privacy and transmitting the image over the internet. Both are free pending court hearings.
‘’The initial focus of this investigation has been to determine who was responsible for remotely activating the camera in the dormitory room of the student and then transmitting the encounter on the Internet,’’ Middlesex County Prosecutor Bruce Kaplan said in a statement released this evening.
‘’Now that two individuals have been charged with invasion of privacy, we will be making every effort to assess whether bias played a role in the incident, and, if so, we will bring appropriate charges.’’
Gov. Chris Christie called Clementi's death an "unspeakable tragedy" today and said he would let Attorney General Paula Dow to evaluate whether bias charges would be warranted.
Rutgers University President Richard L. McCormick issued a statement this evening saying he had spoken with Clementi's parents to convey the condolences on behalf of the university.
"The Rutgers University community is in mourning over the death of first-year student Tyler Clementi," McCormick said in the statement. "We grieve for him and for his family, friends and classmates as they deal with the tragic loss of a gifted young man who was a strong student and a highly accomplished musician."
"I have spoken with Tyler’s parents to extend my own and the university’s deepest sympathies, and we will continue to respect the family’s request for privacy. It is up to us at Rutgers to honor this young man’s life by reaffirming, and living up to, our commitment to the values of civility, dignity, compassion, and respect for one another."
Ravi is accused of using a webcam to secretly live stream Clementi during a sexual encounter with another man on Sept. 19 while viewing it in Wei's dorm room on Rutger's Piscataway campus.
Ravi attempted it a second time on Sept. 21, authorities said, and posted on his Twitter account: "Anyone with iChat, I dare you to video chat me between the hours of 9:30 and 12. Yes it's happening again."

These kids are 18 years old, the responsibility lies with RUTGERS!! This victim reported the spying to the residential aide who did NOTHING! If this idiot had a good talking to he may have ceased his spycam game stat! NOTHING was addressed by the adults here or the university! Sad to say but Rutgers is GUILTY!!!!
These kids are 18 years old and should know better!!! They're old enough to vote and join the army. They should know that filming someone without their consent and broadcasting it to humiliate them is just plain wrong. It scares me that my children are going to be growing up in a world where their peers are so heartless, thoughtless, and without moral boundaries. Please stop making excuses for this type of behavior. This is why we have so many spoiled, thoughtless young adults because they haven't ever been properly guided as to what is right and wrong- this is said without any sort of religious overtone- i just mean, what is right and wrong out of a decent person.
First of all there wasn't enough time for the RA to do anything before Tyler committed suicide. Tyler killed himself a day later after talking to the RA, so I don't think Rutgers is liable. Also, Ravi and Wei are both adults by law, and are able to distinguish wrong from right. I think the responsibility should all be placed on them, not Rutgers.
I'm pretty sure Ravi was angry he was getting kicked out of his room by someone violating university policy and state law (sex acts are illegal in state university dorms, and just plain obnoxious when it leads to the disruption of your roommate's life) oh, and for the lynch mob, a suggestion: Get cracking on the 6 kids who committed suicide at Cornell this year. While you're at it, dig into the 1000's of teen collegians who kill themselves every year. Find everyone who ever contributed to their sadness, and hang 'em
You have a good point there, smileybuyer. Yet, I still understand how being asked permission to use the room multiple times for sexual acts (which, by the way, are illegal by law at state university dorms) would be irritating to a roommate. Ravi clearly handled those feelings in a terrible way
