Police: Witness to iPhone theft shoots at suspects, faces own arrest

Gresham police say Witter, 48, was in an AT&T store at 533 Northwest Division Street in Gresham when two men stole multiple iPhones. Witter witnessed the theft and, instead of waiting for police, he took off after the men, firing at their getaway car.
He told police he intended to "shoot out the tires," but it is unclear where the rounds ended up, though police said he fired in a direct line with the Gresham City Hall Max station and the adjacent Park & Ride.
Witter, a customer at the store, told police he didn't feel that his own life – or anyone else's – was in danger. He said he was trying to help police. But instead he got himself into hot water.
"It is important to remember that no matter how frustrated one may be with crime and the criminal justice system, it is not permissible to use deadly force in this type of situation," Gresham Sgt. Rick Wilson said in announcing Witter's arrest. "Those two rounds could've gone anywhere. In fact, we're still not sure where they went. They could've struck an innocent bystander or damaged property."
Wednesday morning, a gun lobbyist said he realized that Witter was trying to do the right thing but didn't show good judgment.
"I understand the person's frustration," said gun lobbyist Kevin Starrett, with the Oregon Firearms Federation, a pro-firearms group. "I can understand his desire to be helpful. But it was not the thing to do. You cant shoot someone's tires out; its just not TV."
The two suspects, who fled in a silver-colored Chrysler, remained at large this morning.
Both are described as 5-foot-10 to 5-foot-11 inches tall, and about 20 to 30 years of age.
One was wearing a gray and black horizontally striped hooded sweatshirt, blue jeans and white tennis shoes. The other was wearing a brown hooded sweatshirt, blue jeans and dark shoes. Their Chrsyler was last seen heading westbound on Northwest Division.
Witter, meanwhile, has been released from jail.
Reached at his Rockwood home this morning, Witter talked to The Oregonian.
"I'm not a cowboy," he said. "I'm not a hero. I was just doing what I always try to do: help."
AT&T employees at the store Wednesday morning declined to talk about the incident, but a spokeswoman for AT&T issued a statement.
"AT&T takes this matter very seriously," said Colleen Smith, spokesperson for AT&T. "We are cooperating with law enforcement and I'd refer you to law enforcement for any further details or comment."

The only thing this guy should be in trouble for is missing the target. Finally someone stands up to the POS's who rob and steal and make our streets unsafe - and he gets arrested? I'll bet the robbers are doubled over in laughter at a law enforcement system that arrests the victim of crime. I support him and wish others would have the courage to take a stand for our community.

Way in the wrong here. This guy was not threatened, and yet used his concealed weapon. Throw the book at him, concealed carry hand guns are for self protection against deadly force, not for property crimes.
The rule here is: Shut up until you talked to your lawyer (what? you don't have a lawyer on retainer and speeddial? give up your handgun!), and remember: The ONLY reason you unholster is because your life was in imminent danger. And the ONLY reason you fire your gun is to kill somebody, again because you are about to be killed.
Chasing after a criminal (unless he has kidnapped your daughter) is foolish. Shooting out the car tires? Unbelievably stupid. Take away his CW permit.

We should all carry guns. I see nothing wrong with shooting people for leaving less than 15% tip on a meal or shooting shoplifters. It's less expensive than measure 11 and will save taxes allowing for more, important tax cuts.

There is no way any person with a brain can defend this moron's actions. You don't have the right to shoot people for shoplifting. There was not physical threat. This guy should have his permit yanked forever and thrown in jail for awhile. I don't care what his intentions were he is nothing more than a crazy lunatic running around with a gun.
Then I guess you would be okay with it if his shots accidentally MURDER YOUR SPOUSE or CHILD... as long as he was trying to do the right things it is okay... let's hope he doesn't accidentally BLOW YOUR MOTHER'S BRAINS out... as you were scraping your mother's brain matter and bloodoff of the sidewalk... would you still think it okay? The moron with the gun was the victim of a crime, the AT&T store was the victim. This wannabe cop is the criminal for endangering innocent lives to prove his wannabe manhood.
robvukovic -- Wrong. This man should be commended, not criticized. If more people had the guts to take action like he did, we would have a lot less crime. My husband once tackled a bank robber who had a loaded gun aimed at the teller. He got the gun away from the robber, saved the teller from harm, and what thanks did he get? The bank was mad at him. But the police told him he did the right thing, that the robber had a record of violence.
If some thief tries to steal my purse, I'm going to fight them. I may lose, but I will put up a fight. I think that's a healthy attitude to have. I won't criticize someone who doesn't fight -- some folks just aren't up to it -- but I also refuse to second-guess those who have the courage to fight back. Hooray for Roger Witter. If I'm ever in a store that's getting robbed, I hope he's there, too.
Sorry, I had to register to respond to this comment. How can you ever compare a situation where a gun is pointed directly at a person to shoplifting? That's like saying an untrained person with a gun should be able to use deadly force whether a persons life is directly in danger OR someone has stolen a Snickers from a gas station. If you think those two situations have equal weight and permit the use of deadly force then I don't know what to say. Your logic is completely lost on me.
Your comparison is not even close to valid. Gun pointed at bank teller versus thieves stealing iPhones and it's not clear they even had weapons. No comparison. Your husband didn't fire wildly in public, putting innocent people in danger of being hit by stray bullets. This guy was an idiot. We can just be glad one of his shots didn't hit someone. It's this kind of stupidity that can result in overly restrictive gun laws.
You cant have common citizens shooting people, thats the Portland Police dept job! Seriously, the guy used poor judgment. He had the right to protect himself with the gun, but no ones life is worth a Ipod.
The NRA is always harping about "enforcing existing gun laws." Here is a perfect example of doing just that. This cowboy is the poster boy for people who should not be carrying.
