Copying a song, photo or video that you did not create and selling it or giving it away is copyright infringement. The one exception: When the copyright owner gives blanket permission under a Creative Commons license. CC allows artists to specify different levels of rights. For example, some works can be copied only for noncommercial use. Check the Creative Commons Web site and its search engine for details. Also note: Though many music downloads now come without digital rights management (DRM) technology to hinder copying, that's done to improve compatibility and portability of the files. Copyright still applies.

Only if it's commercial. Fair use and the Audio Home Recording Act protect private use.
Giving your friend a mixtape, for example, is fine, despite your statement.
