CASE CONCERNING SOVEREIGNTY OVER PULAU LIGITAN AND PULAU SIPADAN

Sultan国とオランダ東インド会社の1878年忠誠協定の改訂（1893年）により、以下の文書が追加された。
「これらの島々（Tarakan島、Nanoekan島、Sebitik島）に付属する小さな島嶼は、（1891年の条約に示される）領土の境界の南に位置する（the small islands belonging to the above islands, so far as they are situated to the south of the boundary-line）。」
インドネシアは、「付属する小さな島嶼にLIGITAN 島とSIPADAN島が含まれる」と解釈し、権原を主張。
＜判決文＞
裁判所は、３つの島は、周辺にある小さな島嶼に取り囲まれており、これらの島嶼は地理的に「付属」していると言える。しかしながら、LIGITAN 島とSIPADAN島は４０海里（75km）以上離れており、付属する島嶼に含めることはできない。
The Court observes that these three islands are surrounded by many smaller islands that could be said to “belong” to them geographically. The Court, however, considers that this cannot apply to Ligitan and Sipadan, which are situated more than 40 nautical miles away from the three islands in question.
＜サンフランシスコ条約＞
(a)日本国は、朝鮮の独立を承認して、斉州島、巨文島及び欝陵島を含む朝鮮に対するすべての権利、権原及び請求権を放棄する。（Japan, recognizing the independence of Korea, renounces all right, title, and claim to Korea, including the islands of Quelpart, Port Hamilton and Dagelet.）
日本が権原を放棄する領土を規定。放棄しない島々は条約によって法的地位は変更されず、現状維持（日本領のまま）。鬱陵島から90km離れた竹島を、鬱陵島に含めて放棄したとの解釈は不可能。
日本が「竹島」を放棄したとする根拠は何ですか？
