Background Information

Governing Law: Official public holidays in Saint Martin are the same as those in France and are regulated by Article L222-1 du Code du travail (Labour Code), to which is added Abolition Day.  Carnival is not an official public holiday, but both Carnival Monday and Carnival Tuesday are treated as a customary (common law) days off. The same is true of Ash Wednesday and mid-Lent.  The island of Saint Martin voted to secede from Guadeloupe and in 2007, the island became a French overseas collective. The southern part of the island is part of the Netherland Antilles.  Weekend Public Holidays: Public holidays that occur on a weekend remain on that date (ie. they are not moved to another date, such as the following Monday, for example).  Schoelcher Day on July 21st and All Souls' Day on November 2nd are also observed by many. Whit Monday was no longer recognized as one of the public holidays as of 2005, to help fund health care for elderly persons following the high number of elderly deaths during the heat wave of the summer of 2003.
