New Delhi, Aug 20: Twenty five-day-old baby "Manji," born to a surrogate Indian mother using a Japanese man's sperms, shall remain with her grandmother for three more weeks, the Supreme Court said today while questioning an NGO's move to seek her custody.
Extending the infant's temporary custody granted to her grandmother Emiko Yamada by another three weeks, a Bench of Justices Arijit Pasayat and Mukundakam Sharma questioned the locus standi (right) of the NGO "Satya" in the matter.
Seeking several details from the NGO, the apex court said it would examine the larger issue of surrogacy rights and law in the country.
"We request the Solicitor General to assist us as some of the issues are of vital importance," the bench in an order stated while posting the matter for further hearing to September 15.
The bench passed the order even as Abhinav Sharma, counsel for the NGO "Satya," kept insisting that the organisation had a right and duty to protect the child, as according to him the so-called surrogacy agreement was a "fictious" effort for child trafficking.
However, the apex court said that at the outset it wanted to know the locus standi of the NGO in seeking the custody of the child.
"What is your right in respect of the child. As an NGO how can you ask for its custody. You first file details of your registration, activities and sources of funding," the bench told the counsel to which the latter submitted that he had already filed the same before the court.
