Japanese ISPs To Ban File Sharers

japanpirate.jpgJapan has decided to beat France and the United Kingdom (both who have similar proposals) to become the first country to ban file sharers from the internet.

Oddly the agreement to do so has not come from the Japanese Government, but from Japan’s four internet service provider organizations after pressure (not surprisingly) from the record and movie industries. According to Torrent Freak, the agreement would see copyright holders tracking down file-sharers on the Internet using “special detection software” and then notifying ISPs of alleged infringers. File sharers will initially receive a warning for a first offense, then be disconnected for subsequent offenses, eventually be disconnected from the internet permanently (it wasn’t clear whether the agreement is a three strikes proposal).

The process will formally commence in April and will primarily target users of Winny, the most popular file sharing network in Japan.

    Expect military grade encryption to become the norm and darknets to abound. I wonder if the ISPs will simply make up rules that all encrypted traffic is suspect and then either demand the user prove that they aren’t guilty or be kicked.

    this is just reportage catching up, or else it’s different ISPs getting together on it. I know because I got a note about it from my ISP in Japan in 2004.

    It’s important to remember that Japan is a totalitarian *society* at every level. Groups tend to regulate their members pretty heavy-handedly even when government is not directly involved (as it does not *seem* to be here).

    I wonder if this will push darknets to go wireless? Those that want to share stuff could do so over local wifi networks completely independently of their ISPs. With Japanese population density being what it is, it would do the job pretty well I would think.

    Proposals like this one just make me laugh. There is no way this can work from a practical standpoint. Think about it. Internet subscribers are paying customers of the ISPs. There is no way the ISPs are going to be excessively aggressive since it only hurts them in the long run both in reputation (hurt by angry users) and in the pocket book…

    So what happens then? The copyright owners are going to eventually want everyone who’s file sharing to get punished, and once the large fish are taken care of, then comes the masses. How many customers do you think an ISP is going to axe before they say, hold on a second, we are getting hammered here…

    It’s a direct conflict of interest. Sure, it may allow the ISPs to say “Look, we are trying hard” but in reality they don’t really want file sharing to stop, it’s their bread and butter…

    I know from personal experience that independent artists can’t stay afloat for long and continue to produce content unless they are paid as a means of support, not as a means of greed. I know it’s not it’s not a popular idea but I just had to speak up. We all know a lot of good movies and music are coming from indi-artists and filmmakers right now. I think we should rally in support of original content.

    Japan has never ceased to amaze me with their pioneering of superior principals in Asia. They are taking quite a juxtapose to China, as far as combating piracy goes, and this speaks multitudes for other things. I’m not an Otaku like I was before, but this story is impressive. It’s so ghetto to view pirated media. When did this world become a world of cheapskates?

After all, when the Blue-Ray discs came out, didn’t someone crack and bypass the code in under a week?     I completely agree with number 11 and 13. ISPs want their money, and if it means sacrificrificing (not sure if I spelled that right, I’ve been in a spelling slump.) i.e. allowing file sharing, then that’s a sacrifice they’ll be more than willing to make. Plus, as Riza said, people who engage in illegal behavior on the net, they’ve got mad, mad skillz when it comes to slipping big businesses. I think they work for Microsoft XD!

    Just Kidding, just kidding, but yeah. This might work for a time, but it’s probably going to be a shortlived time. Too much money at risk and too many skill “professionals”(hackers…gotta love ‘em). Peace.

    i’m not really sure what an ISP is, nor am i sure of what it does. but i do know enough to say that this is a really bad idea that will hurt us good folks who don’t do any file sharing. i propose that instead of doing what they propose just fine those who file share and then get rid of sites that allow file sharing. because, honestly, if the sites that allow file sharing are gone, then there will be no file sharing. end of story.

You can’t protect a number. I know people want to make a living off of it but face facts, people will always find a way to steal your stuff. So instead of making $100 million you make $85 million. Sure, this means there will always be pirates and sharers, but most people I know don’t mind paying; it’s just easier to download it free.     haha..when will they learn, no matter how good a company is theres always a better programmer out there somewhere that will break open the new restrictions. Bet at most it will take a month before Japanese file sharing is alive and well again. It’s actually sort of sad that theres so many hackers not getting the credit they deserve out there, even so I’m happy they decide to stay solo rather than look for a job doing it for some company.

    The ISPs agreed to this, not the governments. The entertainment business has strong influence over the ISPs in Japan.

    I also agree with many here that Japan and the US should focus on internet issues that effect the masses…not the rich movie studios and artists.

    I was in Japan a couple of months ago…and damn they have great work ethics over there. In NYC we just want to make more money and work less.

    Everything in japan is licenced and nothing in japan are pirated.If they do that then more people from japan will buy softwares and movies and music etc which will cost a lot but it is the rite thing to do.Most of the softwares that people use all over the woirld are pirated i think this is good and i bet all of the other countries will follow this example

    Since I live in Japan, I can’t get the shows from back home that I like, ex: Family Guy. But, when the season comes out on DVD I buy it. So it’s not exactly for wanting something for free or stealing. I actually buy the stuff later on. Grant it, I have to pay maybe 30.00 more for it but I do like owing my shows. It’s what my sanity in this place because J-TV is so damn boring!

    Hmmm, well, I live in Japan and there is not one person I know that does not file share. So I guess everyone is going to be banned from the internet -_- I mean, seriously, most people who use the internet are sharing files. Yeah, they can crack down on certain sites or programs, but in the end people are still going to do it, and they’re going to find ways around it. Also, they’re being kind of vague. Are they going to ban file sharers in general, or specifically people sharing illegal files. Not all file sharing is illegal.

    File sharing programs or websites are NOT ILLEGAL in anyway the act of sharing is. See Napster messed up because they would lets say customer A had a song and customer B wanted the song too. Napster would get the song from customer A and hold it for B until they downloaded the song. That is where they messed up. That’s against the law. But as all the file sharing programs out there now do not do that. They inturn say customer A has this song and customer B wants the song they direct customer B to customer A to get the song. They are just a program to show you who to get the song/movie/app from. Which inturn is not illegal in anyway you are just providing a service of find who has what to share.

    I don’t know very much about the issue other than people chase after each other for money. One thought I have is that file sharing played a huge factor in attracting Internet users when there were only a few big websites. Within the same population many users used those big websites, and without file sharing the Internet community wouldn’t be where it is today.

    People need to strike back at these big industries by boycotting them for a solid month–don’t buy ANYTHING, no CD’s, DVD’s, etc. Show them that we’re the ones that pay their salary…and show them that if they think downloaders are bad, boycotts are a helluva lot worse.

    Then, after that month, tell them that if they infringe upon people’s information sharing, we’ll boycott them again and again, as long as it takes to make the greedy bastards see the light.

    Look at the writer’s strike in the USA…it took a while, but the industry finally backed down when they realized that they couldn’t live without the “little guy” writers. We need to do something worldwide, to make the recording/movie/game industries understand that they can’t live without the downloaders they hate so much.

    BTW, I wouldn’t have bought a single CD from Japan, if I hadn’t been introduced to J-pop via file sharing. Thousands of other non-Japanese are buying Japanese CD’s and the like, for the same reason.

    Downloaders aren’t hurting the industry–they’re giving the industry free advertising. These money grubbers need to STFU and realize they’re gaining far more than they’re losing, from file sharers.

    I find it alarming that so many people in this discussion seem to find it irrelevant that file sharing is illegal… it is theft… stealing. It is wrong. It is not right. People should not be doing it. My goodness! How difficult a concept is that to understand? Musicians and other producers of imaginative content own the creative products that they have generated, and rightly so. I spend a great deal of my hard-earned money on CDs and movies, and would be offended if someone were to suggest to me that i download them for free. It’s not a good way to live, people!

    The four ISP companies who are putting this together will out right loose customers to their smaller competitors, this will turn out to be a huge bungle in the eyes of stock holders(who don’t give two $hits about online piracy or even do it themselves)as smart people will not even bother waiting for their “warnings” or lines to get cut off and be labeled by these companies as a web-pirate.

    Instead their customer base will just look else where for ISP services, and trust me there will be companies who will step in make a boat load of profits from people switching. Hell I bet the Yakuza would even want some of that pie, good profits, and a nice way to launder currency. Glad I am not a stock holder of these companies as news like this would just make me want to.. whats the word im looking for.. oh yeah SELL.

    number 26 just go to ebay for gods sake. Almost every CD I paid for did not cost $30.00 I got them all from bidding sites for less than $2.00 including new releases. The only albums I paid close to a total of $110 for was back in 2005 when I didnt even know anything about ebay or sites that sold stuff for less.

    Likewise they can bann all they want because I’ll just simply buy everything people steal. For one thing file sharing movie sites have lousy quality and they never seem to have anything from the 1980s or 1990s.

    And also Marie (number 18) Indi film makers do not make the best movies let alone the best music. Good music depends on your taste. So if thats your opinion then hey its yours to keep. Me personally good music died out after the 1980s and 1990s ended. But I still find Seal’s new album “System” to be a good listener and that came out this year.

    I also still think that its impossible to beat songs like “Beat It” or “Billie Jean”. Or movies like Star Wars and Bloodsport.

    I think this is great, Piracy is a Crime and needs to be regulated, artists and the people who work to make software, movies and music need to be protected. I hope they are able to do it successfully and that this would be implemented in the US soon.

    I have read a few posts where people think ISPs will not want to do this because it alienates their customers, but I think it actually is part of their plan to keep paying customers. I would imagine a lot of heavy file sharers are a small percent of the population and if threatened with being banned from getting internet at their home would be a lot less likely to share. Bandwith is not unlimited and eliminating heavy users helps to keep other people happy with their connection speed and reduce the amount of upgrades the ISPs need to do, which in turn saves them money.

    As a busy owner I would gladly get rid of the 1 or 2% of users who might use 10, 20 or 30% of my ability to do business while not paying anymore then the guy who logs on once a day to read a few news articles and two e-mails. This is a business decision, not a privacy or free speech issue. The ISPs want to reduce the load on their network and at the same time avoid possible costly lawsuits.

    Although I disagree with this proposal, Japan in general is pretty cool. I lived there for several years and the people are wonderful. And contrary to #14’s response, they don’t send or build “cheap stuff.” The Japanese have degrees of manufacturing quality that beats almost everyone in the world. The Koreans are starting to catch up, and the good ‘ole USA may someday build autos that come close to the Japanese. It is a homogenous society, but they are very leading edge on most issues and gadgets.     Information is never free and someone has had to work for it. It is not however bad that there is such a source of information as the internet. How I see it, it is a check and balance system. Producers make something, publish it, and make money. The internet file sharing people prevent them from continously uping the price and getting greedy. If you don’t want something shared, make a product that people want that can’t be replicated at home, like a movie that is a complicated program instead of a series of pics, something home comps can’t reproduce. People may copy it, but won’t be as good.
    Its a first step, and a needed one if internet control is to be had, but I think if companies consentrated more on making products better, cost effective, and easier accessable, it would be a better step.

CD prices are based on recording costs, advertising and the cost of making the CD and its case. Recording costs these days are minimal, since it can be done with a good laptop and a little skill, while downloading eliminates the production and case costs of the CD. Further, with decreased cost would come increased purchases and the price should drop even more. And it costs the same (relatively) for one person to download a song or a million. Once the cost of media goes down to a reasonable level, there will be less incentive for people to get around legitimately purchasing them. The music industry has failed to keep up with the internet age, and are suffering as a result.

Most statistics say a small percentage of the total population uses file sharing, though it is higher in the US, Europe, and Japan. Also the way the Japan government works, I wouldn’t put it past them for the government to give tax breaks and other money back into the ISPs to make sure they can still run. But if the government is not fully behind this act, I do not seeing it being totally effective.

    This will work very easily in Japan. Most net users here are turning away from computers and using mobile internet devices anyway, evidenced in the dwindling sale of computers. The small percentage of people who do file share represent a small amount of income for the ISP companies. They only need to successfully ban one or two people and everyone else will fall in line. As a conformist society the Japanese will be perfectly willing to go along with this voluntarily.

    Japan’s ISP providers are “under pressure” from the entertainment companies, yes, from the music & movies providers, etc. to ban those from the internet who would “share” files that aren’t to be shared…since they’ve been copyrighted, they need to be paid for. If illegal copies are made and shared, the entertainment companies themselves lose tons of money, and so they eventually collapse, they can no longer produce the entertainment, and they’ll have no time to produce movies, music, etc. since they’ll be caught up trying to find another source of money to survive. I’d have to admit, this is a very complicated matter because nobody is going to want to pay $20 for 10 songs. We all think, “Hey, why not just go get them for free!?” At least, that’s how I see it…Hope it helps :l

    Personally, I love file sharing. I’m addicted to music. But I also know that its really not hurting any of the artists we love. AT MOST a band makes 80 cents per album sold and thats if they have already recouped all of their costs from the record company. They get 30 cents from a song sold on itunes. If you want to support a band go watch their live show, if they don’t play a live show, they’re lame. And as far as movies go, if I pay to watch a movie at the theater, I’ve already paid for my Damn right to watch that movie, why the hell should I pay again to rent it and to buy it????? This won’t last, everyone thought p2p was dead when napster got nipped…and then there were torrents :) The culture will adapt and find a way around it. It will be done on smaller levels like it was in the first days before file sharing programs.

    The real thieves here are the Giant Media companies who create nothing but wind up owning it all. Record labels and music publishers have been ripping off the artists who create the music since the invention of recorded sound. And even if you argue that movie and TV companies fund their own projects, they still rip off the actors, producers, directors on the back-end. You can’t fight them because they have deep pockets for lawyers and it is too expensive for an average person to audit their numbers (like many thousands of $$$).

    Record companies are even worse, because they get paid on blank, recordable media but do not pass that along to the artists. They have been getting this money from the public for years and just putting it in their pockets.

    I have bought the same music 2 or 3 different ways over the years (vinyl, CD, cassette) and the law is that if I record that music to my iPod, I’m within the law, but if I download an MP3 of the same music, I can be sued or go to jail. As usual, their numbers are skewed because they count every download as lost revenue, but in reality teenagers only have a limited amount to spend on CD’s. So a $10 allowance might buy one CD, but maybe the kid downloads 3 or 4 that week. He could still only afford ONE CD.

    The real issue is that the music they try to push down our throats sucks. Big record companies have forgotten that it’s about music, not marketing. I will support (and buy the products of) independent artists, filmmakers, and the like. When a giant media conglomerate tries to sell me something: 1) I know it will pander to the lowest common denominator of taste, 2) I will probably not find it that interesting, 3) They are ripping off the people who created whatever that product is…so I don’t care who rips them off.

    The sooner those companies are forced out of business, the better it will be for people who actually create music, film, etc. It will level the playing field so that the creators will have a chance to own their own creations and new, fairer ways of marketing and exploiting that media will appear once the dinosaurs are gotten out of the way. They are nothing but parasites.

    If the Japanese try to legislate file-sharing, it will only be driven underground…they will stop nothing and hurt many people in the process.

    Why is it that the solution is always one extreme or the other. It’s either ban every attempt or allow all attempts.

    I know that the media industry would not allow it, and people would never completely go for it, but it seems like a good solution would be for the media companies to open up their own share sites. I don’t understand why they don’t try to make their money based on site traffic instead of the product. There are plenty of other companies that run almost solely on site traffic (google comes to mind) and have nothing tangible to offer. At least the media companies could keep a record of download users to send them concert updates and specials for purchasing future hardcopy media as well as turn a pretty penny based on the amount of traffic they could generate.

    Who knows, if they really put their minds into it, they might find a way to use that traffic to generate their own marketing support thereby maximizing profit while minimizing cost.

    Just like “bootlegging” movies and cassette tapes was never stopped, file sharing can never, and will never be stopped. I can’t say I’m for either, but it’s going to happen. It’s like petty theft: you can put up all the security cameras and alarms you want, but theft will always happen. Same thing with people video recording a TV show. Are people using Tivo going to be targeted like those who used VCR’s? Probably not, since the fight against VCR’s was a miserable defeat for copywrite holders.

    In the US, only the actually sharing folder for KaZaA(or similar programs) can be searched. Anything else is against the law. The idea was, that if there were a lot of files in the shared folder, then that person must be pirating copywritten material.

    The problem with file sharing, is that it doesn’t directly violate most copywrite laws since most people don’t try to make money off of it. So, record companies try to find creative ways of fighting it. In the US, record companies are even going after radio stations for playing copywritten music. Issues with that? In the old days, that’s how you got people to know a record exists, and get them to buy it.

    Consumers find any way possible to save money(especially on things we don’t need), and sellers have to be creative and convince people to spend money on things consumers don’t really need.

    You must be a shill for the RIAA and others. Truth is that file sharing in fact has been a boon to truly independent filmmakers and other non affiliated content producers, because they’ve become better known; it only really harms the big sharks, who have been robbing everyone blind and suppressing the little guy for decades. Is it forever sustainable? No, but turning the reins over to the RIAA and groups like them isn’t the way to go about it. Studies have proven people do prefer to do things right, file sharing and the entire music and movie industry needs to be re-envisioned. A service which becomes a mix of iTunes and P2P, where independent content produces set their own prices, and not companies like Apple or Amazon, and where they’re not ignored by Sony Music, Universal, etc. who before had the final say, will win against every other P2P form out there. The proof exists in that music CDs remain the most popular form of distribution and in the correlation that as the array of music grows in services like Amazon and iTunes, the greater those services sales are, and the more the sales of those CDs drop. It should be clear to anyone but the most casual observer that the main problem is the greed of the copyright holders to try to garner every penny they can as if every piece of content they owned was new and gold. If they were to more reasonably pro-rate their work, on a iTunes/P2P-mix network where even the little guy can set their own prices, we’d ALL be a whole lot happier in the long run.

    An excellent point. If you expel the sharers from the internet, with technologies like wimax and the population density considered, a new network inevitably would form. This network would be more difficult to regulate and control and allow the worse forms of human behavior a free haven.

    This is troubling. At what point does banning P2P evolve into censorship and then banning all political dissent? If the private interest is allowed the ability to control what their customers can do or say, is not fascism and despotism the only logical result?

    actually this is going to hurt independent artist too, file sharing is a way of unknowns to get known without the hassle of going through the big brother companies like sony or time warner. the future isnt in making money from your product, its from making money from advertisers who pay for the traffic on your site of for the advertising attached to your product, such as a 5 second spot before a song or a 30 sec commercial before and after a movie. the problem is that large companies are trying to put a bandaid on hemophiliac, doesnt work, and instead of forward thinking or old fashioned make a lemon lemonade they continue to think in a past tense. in truth, file sharing could be the next biggest market for advertisers, yes, let people bandie files back and forth, and piggie back on them. what revenue movie companies lose on downloading they will make back in advertising revenue, and there will always be a core of people who insist on quality, and want the extras that one buy a dvd for, same with music….the extras that go along with the music. but that would mean CEO’s in these mega giants would have to become intelligent and compitent, one thing most executive officers in modern day corporations are not…think locust with ego.

    Honestly, so many people replything to this thing are so rediculous. “There won’t be any more porn?” Who cares.

    Secondly, piracey is illegal. You aren’t “sharing” anything. It’s just a eufimisom for “STEALING,” and that’s exactly what it is. It cheats the creator out of their money. For those of you who believe it doesn’t hurt the person (i.e. Nicole Kidman) because they are rich, perhaps you are right. However, it doesn’t make it less of theft and it doesn’t make it less wrong. Anyone who got as far as they did now, did it through hard work and is still working hard; it’s their money and they deserve it. Stealing files means that one person buys it rather than the thousand that “share” it. If America follows suit it will be a good thing.

    On that note however, a full out ban does seem a little extreme. There is a similar law going on in parts of America, the offender found downloading songs has to pay for them in the end, and much more than buying the albums would have cost. One college student was charge over 30,000 dollars I believe. For those of you who are so up in arms about this, regardless of the fact that it’s punnishment for a crime, just like jail time for a bank robber, stop being stupid, it doesn’t affect you that greatly yet, and likely wont.

    Except for those in Japan, you wont get banned for sharing files right now. Secondly, for those in America, it’s highly unlikely that OUR government with all it’s nuances and tendencies to crumble under pressure, will pass any law even similar to Japan’s.

    Now as a last note, for all the morons:
    China is more controlling of it’s people than Japan (duh) there are certain BROADCASTED tv shows that are not allowed to air, some of them for a simple “emphasis on the powerful and rich.”
    Japan is neither a communist or totalitarian government, they have a House of Representatives and a Prime Minister, and it’s not the government that pushed the law in the first place.
    There are more important issues to protest than the right to commit a crime. No one would protest jail time to a serial killer, would they? Instead of claiming that the government should not enforce the law, why don’t we get bothered over things like China’s invasion of Tibet, or genocide in Africa, or issues like forcing preteen girls to get vaccinations that they don’t need, letting people who have KILLED others get away with it because it “wasn’t their fault, they fried their brain with drugs.”

    I’m not trying to digress from the point at hand, but there are greater things to argue and protest than the just punishing of a crime.

    Have you guys actually read the entire article? The proposal was not from the Japanese government, but rather the Internet providers from the pressure of the entertainment industry. The purpose of file sharing is getting entertainment for free and the entertainment industry wants a crackdown of it because it causes them to lose money. If anyone remembers Napster, it was a filesharing program until it was forced by the entertainment industry to either shut down or their users have to pay for their downloads. It has nothing to do with government, it has to do with the royalities.

Have to agree with the majority who say that file sharing cannot be stopped. Instead of trying to abolish file sharing, they should just find ways to monetize it.

    Just a few days ago, Yahoo! featured an article that said shutting down napster is the biggest record company mistake ever made. maybe they should learn a thing or two from that.
